Terms of Service
Last updated: 28 August 2026
dataHabibi is a Dubai real-estate data and intelligence platform. We surface building records, new-project data, area-level analytics, market transaction data, and tools such as our Rent vs Buy calculator, drawing on information derived from public registry sources.
These Terms of Service are a binding contract between you and dataHabibi L.L.C-FZ. By creating an account or using the platform you agree to them. If you do not agree, do not use the platform.
Your subscription, billing, auto-renewal, and refund terms live in section 7 (Subscriptions and billing). Business data and API rights live in section 9 (Intellectual property and data licences). Sections 4 and 5 explain that we are not a broker or valuer and that registry data can contain gaps or delays. Read them before relying on anything you see.
1. Who we are
dataHabibi is a Dubai real-estate data and intelligence platform (the "platform" or the "service") operated by dataHabibi L.L.C-FZ, a free zone limited liability company registered in Meydan Free Zone, Dubai, United Arab Emirates. In these terms, "we", "us", and "our" refer to dataHabibi L.L.C-FZ, and "you" means the person or entity using the platform. We operate the website at datahabibi.ae and the products available through it. You can reach us at info@datahabibi.ae for general matters and support@datahabibi.ae for support, privacy, and data requests.
2. Acceptance of these terms
By accessing or using the platform, creating an account, or subscribing to a paid plan, you confirm that you accept these terms and agree to be bound by them. If you are using the platform on behalf of a company or other organisation, you confirm that you have authority to bind that organisation, and "you" includes that organisation.
You must be at least 18 years old and able to enter into a binding contract to use the platform. These terms incorporate our Privacy Policy and any product-specific or plan-specific terms we present to you. If those terms conflict with these on a specific point, the more specific terms control for that point.
Business data terms. Business Data Services means any API, data feed, licensed export, or other structured data delivery service that we expressly provide to you. A Business Data Agreement means an order form, licence schedule, plan, or other written agreement between you and us that sets the scope of those services. Licensed Data means the data, records, fields, metrics, estimates, outputs, or files identified in that agreement.
3. The service
The platform provides Dubai real-estate data and intelligence, including the following surfaces:
- Buildings. Building records, price signals, and recent transactions at /dubai/buildings.
- New Projects. Pre-completion projects, launch pricing, handover information, and payment plans at /dubai/new-projects.
- Intelligence. Area-level market analytics at /dubai/intelligence.
- Market transaction data. Records derived from public registry sources, processed by us.
- Business Data Services. APIs, data feeds, licensed exports, and related data delivery for approved business customers under a separate Business Data Agreement.
- Rent vs Buy calculator. A modelling tool at /rent-vs-buy-calculator that produces estimates from inputs you provide.
- Help Center. Guidance and answers at /help.
We offer a free tier and a paid Pro subscription. Pro does not include Business Data Services unless we say so at the point of purchase or in a Business Data Agreement. We may add, change, or remove features, surfaces, and data at any time. Some features depend on the data available to us and may not be present for every building, project, or area.
4. We are not a broker or valuer
dataHabibi is an information and analytics platform only. We are not a real-estate broker, agent, agency, or brokerage. We do not hold a RERA brokerage licence, we do not list properties for sale or rent on behalf of owners or agents, and we do not introduce, represent, or act for buyers, sellers, landlords, or tenants. We are not a party to, and take no part in, any transaction, negotiation, or contract between you and any third party.
We are not a property valuer, surveyor, appraiser, or licensed valuation provider. Nothing on the platform is a valuation, appraisal, or survey, and nothing on it is regulated valuation advice.
Nothing on the platform is investment, financial, legal, tax, or other professional advice, and nothing on it is an offer, solicitation, or recommendation to buy, sell, lease, or finance any property or to enter into any transaction. The platform is general information and does not account for your circumstances or objectives. Before you act, you must carry out your own due diligence and obtain independent professional advice from a licensed broker, valuer, lawyer, financial adviser, or other qualified professional. Any decision you make, and its consequences, are yours alone.
5. Data sources and accuracy
Market, transaction, and building data on the platform is derived from the Dubai Land Department (DLD) and other public registry sources, and is then processed and transformed by us. dataHabibi is an independent platform. We are not affiliated with, authorised by, sponsored by, or endorsed by the DLD or any government authority, and our use of registry-derived data does not imply any such relationship.
The platform is not an official record. Figures may lag behind official records, may be incomplete, and may contain inaccuracies present in the source data or introduced in processing. Any price estimate, index, signal, average, or other derived figure is a computer-generated estimate produced by our proprietary methods and models from the data available to us. It is an estimate of market activity only, not an official valuation, not a survey, and not the opinion of a qualified or licensed expert.
Non-reliance. All data, estimates, and outputs are provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of accuracy, completeness, currency, merchantability, or fitness for a particular purpose. You acknowledge that the platform is a tool for orientation and research, not a source of record, and you agree that you will not rely on it as your sole or primary basis for any purchase, sale, lease, financing, valuation, or other decision. Where an official figure is required, you must verify it against the relevant official record or registry. To the extent permitted by law, you release us from any claim arising from your reliance on the platform's data or estimates.
6. Accounts
To access certain features you must create an account. You agree to provide accurate and current information and to keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us at support@datahabibi.ae without delay if you suspect any unauthorised use of your account.
Your account is for your own use. You may not share, sell, transfer, or sublicense your account or its access, and you may not let others use it. We may suspend or close an account that we reasonably believe has been compromised, is being shared, or is being used in breach of these terms.
API and feed credentials. API keys, feed credentials, and other access tokens are confidential account credentials. You may use them only in the systems and applications approved in your Business Data Agreement. You may share them only with staff or contractors whom that agreement permits and whom you bind to suitable confidentiality and security duties. You remain responsible for their use.
7. Subscriptions and billing
The platform offers a free tier and a paid Pro subscription. Fees, billing periods, and what each plan includes are shown at the point of purchase. All fees are stated and charged in UAE Dirhams (AED) and, unless stated otherwise, are exclusive of any applicable taxes, which you are responsible for.
Payment processing. Pro subscriptions are billed through our third-party payment processor, Stripe. Your full card details are entered with and held by Stripe and never reach dataHabibi servers. Your use of Stripe is subject to Stripe's own terms, and we are not responsible for the acts or omissions of the payment processor.
Auto-renewal. Paid subscriptions renew automatically at the end of each billing period at the then-current rate, using your saved payment method, until you cancel. By subscribing you authorise these recurring charges. We may change subscription fees, and will give you reasonable notice before a change applies to your next renewal.
Cancellation and refunds. You may cancel at any time through your account. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. Deleting your account is different: any active subscription is canceled immediately, access ends at deletion, and there is no refund for the remaining period — see how to delete your data. Fees already paid are non-refundable, and we do not provide partial or pro-rated refunds for unused time, except where a refund is required by applicable law. If a payment fails or is reversed, we may suspend or downgrade your access.
Business Data Services. The scope, fees, term, billing, renewal, authorised users and applications, data fields, history, update schedule, support, service levels, and usage limits for Business Data Services are set out in the applicable Business Data Agreement. Business Data Services may be billed by invoice or another method stated in that agreement. If that agreement conflicts with these terms on a point about Business Data Services, that agreement controls.
8. Acceptable use
You may use the platform only for your own lawful purposes and in line with these terms. Unless a Business Data Agreement expressly allows it, you must not:
- scrape, crawl, harvest, spider, or use bots or any automated means to extract data, or carry out bulk or systematic extraction or downloading of data from the website; this does not stop an approved customer from using an API, feed, or export that we expressly provide, within its stated limits;
- copy, resell, redistribute, sublicense, republish, syndicate, or otherwise commercially exploit raw or substantially complete platform data, or make it available in a way that lets another person extract or rebuild it;
- use the platform or its data to build a competing data service, substitute database, or shared or general-purpose model;
- share an API key, feed credential, export, or bulk data file with a person or system that your Business Data Agreement does not authorise;
- reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or underlying data models of the platform, except where this restriction is prohibited by law;
- circumvent, disable, or interfere with any access control, rate limit, security feature, or usage limit, or access the platform other than through the interfaces we provide;
- upload or transmit malware, or take any action that imposes an unreasonable load on, disrupts, or impairs the platform or its infrastructure; or
- use the platform in breach of any applicable law, to infringe any third party's rights, or in a way that misrepresents our data as official or as a valuation.
We may monitor use to enforce these limits and may restrict, suspend, or terminate access for conduct we reasonably believe breaches this section.
9. Intellectual property and data licences
The platform, including its software, interfaces, design, text, the compilation, structure, and presentation of data, our derived figures, estimates, methods, and models, and the dataHabibi name and logo, is owned by us or our licensors and is protected by intellectual property and database rights. The underlying public registry records remain those of their respective sources; our rights subsist in our selection, processing, transformation, and presentation of that data.
Standard platform licence. Subject to these terms and to your plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the website and platform for your own internal, non-commercial reference, or, if you subscribe as a business, for your own internal business use. A business subscriber may include a limited number of screenshots, charts, or figures in its internal reports if it keeps any source notice and does not expose bulk records or enable another person to rebuild our dataset. This standard licence does not include API access, a data feed, bulk extraction, external publication, resale, or redistribution.
Business data licence. If you have an active Business Data Agreement and have paid all fees due, we grant you a limited, non-exclusive, non-transferable, revocable licence during its term to access and use the Licensed Data for the users, systems, applications, websites, territories, customers, and purposes that agreement approves.
To the extent your Business Data Agreement allows, you may:
- integrate Licensed Data into your internal systems, databases, dashboards, applications, analytics, and research;
- copy, cache, and store Licensed Data as reasonably needed to run the approved services during the agreement term;
- combine Licensed Data with your own data and create your own analyses, charts, reports, and other derived outputs;
- present selected records and derived insights in approved websites, applications, dashboards, client reports, presentations, and marketing materials; and
- share approved reports and outputs with your customers or users, provided they cannot extract raw or substantially complete Licensed Data from them.
Attribution. For any external display, report, or marketing use, you must show any attribution stated in your Business Data Agreement. Unless that agreement states otherwise, the attribution must read "Data: dataHabibi" and link to datahabibi.ae where links are possible. You must also show the relevant public registry source when we require it and must not imply that dataHabibi is an official government source, broker, or valuer.
Business data limits. A Business Data Agreement does not allow you to sell, sublicense, publish, or supply raw or substantially complete Licensed Data as a standalone product; act as a data broker for it; give a third party access to our API or feed; offer a bulk download; create a substitute or competing database or service; remove required attribution; infer or expose fields that we suppress; or exceed the agreed fields, history, users, applications, territories, call limits, or retention period. You may not use Licensed Data to train a shared or general-purpose artificial-intelligence model, or send it to a model provider that may keep it for training, unless the Business Data Agreement expressly permits that use.
Ownership of customer work. You keep ownership of your own software, branding, and original content. We and our licensors keep all rights in the platform, Licensed Data, data compilation, processing, structure, methods, models, and any material we provide. Your licence to use Licensed Data does not transfer ownership of it.
When business data access ends. When a Business Data Agreement ends, you must stop calling the API or feed and, within 30 days, delete raw and cached Licensed Data unless the agreement or applicable law lets you keep it. You may keep static reports and aggregate outputs that you created lawfully during the term if they do not expose records or allow our dataset to be rebuilt. The Business Data Agreement may set different deletion or retention rules, in which case those rules control.
All rights not expressly granted are reserved. You must not remove or obscure any proprietary notice.
10. Third-party links and services
The platform may link to or integrate with third-party websites, content, and services, including our payment processor. We provide these for convenience and do not control, endorse, or take responsibility for them, their content, or their accuracy or availability. Your use of any third-party site or service is at your own risk and is governed by that third party's own terms and privacy practices. We are not liable for any loss arising from your use of, or reliance on, any third-party site, service, or content.
11. Availability and changes to the service
We aim to keep the platform available but do not guarantee that it will be uninterrupted, timely, secure, or error-free. Access may be suspended, withdrawn, or restricted for maintenance, updates, technical issues, or reasons outside our control, and data coverage may vary over time. We may change, suspend, or discontinue any part of the platform, including features, surfaces, datasets, and plan contents, at any time. Where a change materially reduces a paid feature you rely on, we will give reasonable notice where practicable. You are responsible for arrangements needed to access the platform, including your device and internet connection.
12. Our liability
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for fraud or fraudulent misrepresentation.
The platform and all data, estimates, and outputs are provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions, and representations not expressly stated in these terms, including any implied warranties of accuracy, completeness, satisfactory quality, or fitness for a particular purpose.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, anticipated savings, opportunity, goodwill, or data, in each case however arising. In particular, we are not liable for any loss arising from a property, financing, investment, or other decision you make in reliance on the platform, or from any inaccuracy in, or lag or gap in, our data or estimates.
Liability cap. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these terms or your use of the platform, whether in contract, tort (including negligence), or otherwise, is limited to the greater of the total amounts you paid to us in the 12 months before the event giving rise to the claim, or AED 1,000.
13. Indemnity
You agree to indemnify and hold us, and our officers, employees, and agents, harmless from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these terms, your misuse of the platform or its data, your breach of section 8 (Acceptable use), or your infringement of any law or any third party's rights. We may, at our own cost, assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence.
14. Termination
You may stop using the platform at any time and may close your account, subject to the subscription terms in section 7. We may suspend or terminate your access, in whole or in part, with or without notice, if you breach these terms, if we are required to by law, or to protect the platform, our users, or our rights. On termination, your right to use the platform ends and we may delete your account and associated data, subject to our Privacy Policy and any legal retention obligations.
Survival. Sections that by their nature should survive termination — including those on data accuracy and non-reliance, intellectual property, data deletion and retention, liability, indemnity, and governing law — survive.
15. Changes to these terms
We may update these terms from time to time, for example to reflect changes to the platform, to our practices, or to the law. When we make a material change we will update the "last updated" date and, where appropriate, give notice through the platform or by email. Changes take effect when posted unless we state otherwise. Your continued use of the platform after a change takes effect means you accept the updated terms. If you do not agree to a change, you must stop using the platform. A change to these terms does not alter a signed Business Data Agreement during its current term unless that agreement allows it or both parties agree in writing.
16. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or the platform (including non-contractual disputes or claims), are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. You and we submit to the exclusive jurisdiction of the Courts of Dubai.
17. General
Severability. If any provision of these terms is found to be invalid, illegal, or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.
Waiver. If we do not enforce a provision of these terms, or delay in doing so, that is not a waiver of our right to enforce it later, and no single or partial exercise of any right prevents any further exercise of it.
Assignment. You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign or transfer ours, including to an affiliate or in connection with a merger, acquisition, or sale of assets, without your consent.
Entire agreement. These terms, together with the Privacy Policy, any plan-specific terms, and any Business Data Agreement between you and us, are the entire agreement between you and us regarding the platform and supersede any prior understanding on that subject.
Notices. We may give you notices through the platform or by email to the address on your account. You may send us formal notices at info@datahabibi.ae.
Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
