Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and FiveToClose (“Company,” “we,” “us,” or “our”) governing your access to and use of wheretheyask.com and the WhereTheyAsk application (collectively, the “Services”). By creating an account or signing in, you represent that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms. If you do not agree, do not use the Services.

2. Description of services

WhereTheyAsk is a free community. You get a profile, a feed, pages, groups, events, and live rooms. Sign-in is Google, then a confirmation link sent to that email. The Constitution of the United States is the law of this site. We believe in freedom and in America. The First Amendment and the Second Amendment are upheld vehemently. Lawful speech stays up. Lawful pictures of guns and shooting stay up. Killing and suicide do not go up.

Act your age. Act like an adult, not a child. Do that and you will be fine. Harassment reports and other support issues go to support@fivetoclose.cloud. That address is for these legal pages and for mail we send. It is not a public sales address.

3. Accounts and eligibility

You must be at least eighteen (18). You sign in with a Google account you are allowed to use, then you open the confirmation link we email to that address. You are responsible for activity under your account. If the account is compromised, email support@fivetoclose.cloud. We do not ban you for a point of view, for selling, or for a lawful firearm. We remove posts about killing and suicide. We remove content that is illegal under the Constitution and the laws of the United States.

4. Price

The Services are free. There is no charge for a profile, a page, a group, an event, or a live room. Advertising may be sold later, after there is an audience. It is not sold now.

5. License and intellectual property

The Services, including software, copy, trademarks, and trade dress, are owned by FiveToClose or its licensors. We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services.

You may not resell the Service, scrape it, reverse engineer it, or use it to build a competing product.

You retain rights in content you submit. You grant us a limited license to host and show that content so the Services work for the people allowed to see it.

6. Acceptable use

Act like an adult. The Constitution of the United States is the law of this site. You may speak, sell, and show lawful guns and shooting. You may post pictures, video, and audio. An occasional nude photo is not a ban. All-out pornography does not go up. Killing and suicide do not go up. Sexual content involving minors is illegal and does not go up. The account stays. We do not ban people. Groups and pages may be private. Open discussion is encouraged.

If a post offends you, you can leave. BlueSky and other places exist for people who want a tighter room. We do not take a post down because someone is offended. Harassment reports go to support@fivetoclose.cloud.

7. Your posts

You are responsible for what you post, including pictures, video, audio, and live video. We do not log into your other accounts. We do not ban you for ordinary speech, selling, or an occasional nude photo.

8. No warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT A POST, PAGE, GROUP, EVENT, OR LIVE ROOM WILL PRODUCE AN AUDIENCE, TRAFFIC, CUSTOMERS, REVENUE, OR ANY PARTICULAR OUTCOME. THIRD-PARTY SITES MAY CHANGE OR FAIL.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVETOCLOSE AND ITS OFFICERS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ACCOUNTS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, REGARDLESS OF THEORY OF LIABILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless FiveToClose and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, content you submit or publish, your violation of these Terms, or your infringement of any third-party right.

11. Third-party services

Sign-in uses Google. A pasted webinar link plays on that host. Your use of those services is governed by their terms. We are not responsible for third-party acts, outages, or policy changes.

12. Modifications

We may modify the Services or these Terms at any time. Material changes will be indicated by updating the effective date. Continued use after changes become effective constitutes acceptance of the revised Terms.

13. Governing law and disputes

The Constitution of the United States is the law of this site. These Terms are governed by the Constitution and the laws of the United States. The speech and arms rules above follow the First Amendment and the Second Amendment. Courts in the United States are the venue for disputes, except where a consumer-protection statute requires otherwise.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FiveToClose regarding the Services and supersede prior understandings on the same subject.
