1. Description of Service

Spokenly is a speech-to-text dictation application for macOS, Windows, Linux, and iOS. The app provides voice transcription using both local on-device models and cloud-based AI services. Some features require an active subscription.

Spokenly also offers a plugin for ChatGPT that transcribes audio files you choose, plays them back alongside a timestamped transcript, and lets you ask ChatGPT about selected excerpts. The initial version of the plugin is free to use within shared usage limits and does not require a Spokenly subscription. Other Spokenly products remain subject to the subscription and payment terms below.

Spokenly also offers a plugin for Claude with the same features. It is free to use within the same shared usage limits and does not require a Spokenly subscription.

2. Acceptable Use

You agree to use Spokenly only for lawful purposes and in accordance with these Terms. You may not use the service to process, transcribe, or generate content that is illegal, harmful, abusive, or violates the rights of others.

Abusive usage is prohibited, including excessive automated requests, account sharing, reselling access, or circumventing usage limits. If we detect misuse, we may restrict your account. If you believe this was a mistake, contact us at admin@spokenly.app.

3. Subscriptions and Payments

Spokenly offers subscription plans that provide access to premium features. Payments on spokenly.app are processed by our payment partners, Polar and Paddle. The partner that processes your order acts as the Merchant of Record for that transaction and handles billing, invoicing, and applicable sales taxes on our behalf.

Purchases made through the Apple App Store are governed by Apple's terms and conditions.

4. Refunds

Purchases made on spokenly.app include a 14-day money-back guarantee. To request a refund, contact us at admin@spokenly.app within 14 days of purchase and we will issue a full refund. For App Store purchases, refunds are managed by Apple through their standard process.

5. Intellectual Property

Spokenly and its original content, features, and functionality are owned by Spokenly and are protected by copyright and other intellectual property laws. You retain ownership of any content you create using the service, including your transcriptions.

6. Disclaimer of Warranties

Spokenly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that transcriptions will be completely accurate, uninterrupted, or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, Spokenly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

8. Termination

We reserve the right to suspend or terminate your access to the service at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

9. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms.
