Terms of Service

Please read these Terms of Service carefully before using any of the Harbor resources (Harbor SaaS Platform and Harbor Chrome Extension). By accessing or using any of the Harbor resources, you agree to be bound by these Terms of Service. If you disagree with any part of these Terms of Service, please do not use any of the Harbor's resources.

1. Introduction & Acceptance

These Terms of Service ("Terms") constitute a binding agreement between Work In Biotech LLC d/b/a Harbor ("Harbor," "we," or "us") and the entity or individual accessing our services ("Customer" or "User"). By installing the Harbor Chrome Extension or accessing findharbor.com and all subdomains, you agree to these Terms.

2. The Services

2.1 Access: Harbor grants Customer a non-exclusive, non-transferable right to access the Harbor SaaS Platform and use the Harbor Chrome Extension solely for internal business purposes (recruiting and applicant tracking).

2.2 The Chrome Extension: The Extension is provided to facilitate data entry and workflow automation. Crucial Warning: You acknowledge that the Extension interacts with third-party websites (e.g., LinkedIn, GitHub). You are solely responsible for ensuring your use complies with the Terms of Service of those third-party websites. Harbor is not responsible for any account suspensions or restrictions imposed by third parties.

3. User Obligations & Restrictions

You agree not to:

• Use the Service to scrape data in violation of third-party platform rules.
• Reverse engineer, decompile, or attempt to discover source code of the Extension or SaaS Platform.
• Sell, resell, or lease the Service to unauthorized third parties.
• Upload sensitive data (e.g., PHI, SSNs) not required for recruiting purposes.

4. Data Ownership & Privacy

4.1 Customer Data: You retain all rights to the candidate profiles, notes, and messages you input into Harbor ("Customer Data"). You grant Harbor a license to process this data solely to provide the Service.

4.2 Aggregated Data: Harbor may collect anonymized, aggregated usage data to improve the platform. This data will not identify you or your candidates.

4.3 Security: Harbor maintains industry-standard security measures (SOC 2 or equivalent standards recommended) to protect Customer Data.

5. Fees & Payment

5.1 Subscription: Services are billed in advance on a Monthly basis.

5.2 Cancellation: You may cancel at any time. No refunds are issued for partial month unless legally required.

5.3 Late fees: Unpaid invoices automatically place your account into restricted mode. You can view your data, but you cannot create, edit, or delete items.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS." HARBOR SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE EXTENSION WILL ALWAYS FUNCTION IF THIRD-PARTY PLATFORMS CHANGE THEIR CODEBASE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• INDIRECT DAMAGES: HARBOR SHALL NOT BE LIABLE FOR LOST PROFITS, DATA LOSS, OR COST OF SUBSTITUTE GOODS.
• CAP: HARBOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

Customer agrees to indemnify and hold Harbor harmless from any claims arising out of Customer's use of the Service in violation of third-party rights (e.g., violating LinkedIn's User Agreement) or applicable laws.

9. General Provisions

• Governing Law: State of Nevada.
• Updates: We may update these Terms by posting a new version. Continued use constitutes acceptance.
