Fair Use in the Entheogen Chrestomathy

Excerpts used in the Chrestomathy are intended to provide the reader with a sense of the book while still making it useful for the reader to purchase the book in its entirety. We believe this use fits within the fair use guidelines. The fair use doctrine is based on the following points:

  1. Use is non-commercial
    CSP is a non-profit organization. The Chrestomathy is provided as a public service without charge.
  2. Use is for purposes of criticism, comment, parody, news reporting, teaching, scholarship, or research
    The Chrestomathy is provided as an educational service to readers and to aid researchers and scholars.
  3. Work is primarily fact
    Only a small number of Chrestomathy entries represent works of fiction.
  4. Work is published
    Excepting a few dissertations, Chrestomathy entries are for published works.
  5. Use of only a small part of the original work
    The excerpts are quite short relative to the lengths of the full works. In the case of works which are out of print, some of the excerpts are slightly longer.
  6. Use of a relatively insignificant part of the original work (as opposed to the most important part)
    The excerpts have been chosen for their relation to the overall subject of the Chrestomathy, religion and psychoactive sacramentals. These excerpts convey a sense of the book but are not intended to, nor do they, encapsulate the entire content.
  7. Addition of a significant amount of new content
    The Chrestomathy, as a whole, provides a new and much more comprehensive view of its subject than can be found in any of the works excerpted.
  8. Use leaves unaffected any profits that the copyright owner can make
    We believe that the Chrestomathy is likely to increase interest in and sales of the works excerpted in it.
