01 / AGREEMENT
Who these terms are with
These Terms of Service are an agreement between you and Serin Technologies, LLC ("Serin", "we", "us"), a Delaware limited liability company that operates Clair, including the website at clair.im, the dashboard, the documentation, and the APIs at api.clair.im (together, the "Service").
By creating an account, issuing an API key, or using the Service, you accept these terms and our Privacy Policy. If you use the Service on behalf of a company or other organization, you confirm that you may bind it, and "you" means that organization.
You must be at least 18 years old and able to enter into a binding contract. The Service is offered for business and professional use.
02 / THE SERVICE
What Clair is
Clair provides read-only data APIs over publicly accessible web pages. Each API fetches a source page when you call it and returns documented fields as JSON. Current APIs cover search engine results and map listings, news publishers, job listings and salary pages, online marketplace listings, company profiles, reviews, product launches, and the contact details that companies publish on their own websites.
Each call fetches pages identified by the documented query parameters, identifiers, or domain. Callers do not submit arbitrary crawl jobs, and no large language model generates, summarizes, or interprets responses in the request path.
The endpoints, parameters, fields, sources, and limits of each API are those documented at the time of the call. We may add, change, or retire APIs, endpoints, and fields. We will try to give reasonable notice before removing an endpoint or making a breaking change to a paid API, but source websites change without notice, and a response may change when its source does.
03 / ACCOUNTS
Accounts and API keys
Provide accurate account information and keep it current. You are responsible for activity under your account and for every call made with your API keys. Keep keys secret, rotate a key you believe is exposed, and tell us promptly about unauthorized use.
Do not share keys outside your organization, create accounts to obtain additional free requests, or pool keys or accounts to avoid a plan's limits.
04 / PLANS AND BILLING
Plans, payment, and cancellation
Free tier: each API includes a monthly allowance of free requests without a payment method. When the month's allowance is used, that API stops answering until the next month. We may change or withdraw the free tier.
Paid plans are sold per API. A subscription is one plan of one API, is billed monthly in advance, and renews automatically each month until canceled. A plan includes a number of requests each billing period; included requests that are not used expire at the end of the period.
Overage and pay as you go: requests beyond a plan's included requests, and every request on pay as you go, are charged at the per-request rate shown for that plan and are billed in arrears for the period. Each plan has a published monthly request ceiling; once it is reached, further requests are refused until the next period. Rate limits apply per plan.
What counts as a request: a call is counted when Clair answers it. A call rejected before processing because of invalid parameters is not charged. A call that fails because of an error on Clair's side, including when a source cannot be reached (an HTTP 5xx response), is not charged, or is refunded to your allowance. A completed answer about your input, such as a not-found result for an identifier that does not exist, is charged.
Payment is processed by Stripe. Clair does not store full card details. Prices are in US dollars and exclude taxes, which are added where required. You authorize us, through Stripe, to charge your payment method for subscription fees, usage, and applicable taxes. If a payment fails, we may suspend paid access until it succeeds.
Price changes: we may change plan prices and per-request rates for future billing periods. We will give at least 30 days' notice before a change applies to an existing subscription; a change never affects a period you have already paid for. If you do not accept a change, cancel before it applies.
Cancellation: you can cancel a subscription at any time from the billing dashboard. Cancellation takes effect at the end of the current billing period, and access continues until then. Except where required by law or stated in these terms, fees are not refundable, including for partial periods and unused requests. Usage incurred before cancellation remains payable.
If you buy access to Clair through a third-party API marketplace, that marketplace's terms govern your purchase, billing, and refunds, and these terms govern your use of the Service.
05 / USE OF RESULTS
What you may build and what you may not do
Subject to these terms and your plan, you may call the APIs and use the results in your own products, internal workflows, analysis, and applications. Keep source attribution and links to the original page wherever the context reasonably permits.
Do not resell, sublicense, or redistribute the Service itself, or results in whole or in substantial part, as a competing data feed, dataset, archive, or API.
Do not circumvent metering, rate limits, or ceilings, reverse engineer access controls, or disrupt, overload, probe, or degrade the Service or another customer's access.
Do not use the Service in violation of applicable law or third-party rights, or to facilitate unlawful discrimination, stalking, harassment, abusive surveillance, fraud, or other harm.
06 / THIRD-PARTY CONTENT
Publisher and source rights
Pages that Clair fetches are written and controlled by their publishers, platforms, employers, sellers, reviewers, and other source owners. Clair does not own that material and grants you no rights in it. Responses may contain metadata and bounded extracted text as documented for each API.
You are responsible for your use of that material, including any republication, and for complying with applicable copyright, database, and other law and any obligations that apply to you. Clair makes no representation that any particular downstream use is permitted.
Clair does not verify the truth, completeness, legality, or continuing availability of third-party material, including prices, ratings, reviews, salaries, company facts, job openings, and contact details. Derived, normalized, and timestamp fields describe how Clair retrieved and processed a page, not an endorsement or guarantee of the underlying record.
Clair is not affiliated with or endorsed by the websites it fetches. Their names and marks belong to their owners and are used only to identify the source.
07 / PERSONAL DATA
Personal data and contact data in results
Results can include personal data that a source has published, such as names in news articles and reviews, business contact details on company websites, recruiter and executive names, and public professional profiles. For personal data you receive from the Service, you decide how it is used and you act as an independent controller under applicable data-protection law.
You are responsible for having a lawful basis for your use of that data, for honouring the rights of the people concerned, and for complying with data-protection, privacy, and marketing laws, including the GDPR and UK GDPR, the California Consumer Privacy Act, CAN-SPAM, the TCPA, CASL, and ePrivacy and electronic-marketing rules where they apply.
Do not use contact data from the Service to send unsolicited messages where the law requires consent, to build profiles of private individuals, or to contact people who have objected. Do not use the Service to collect sensitive categories of personal data about individuals.
Clair is not a consumer reporting agency, and results are not consumer reports. Do not use the Service to furnish consumer reports or as a factor in decisions about a person's eligibility for credit, insurance, employment, housing, or similar purposes covered by the Fair Credit Reporting Act or comparable laws.
08 / NO ADVICE
Not financial, employment, or professional advice
Clair is an information retrieval tool. It is not an investment adviser, broker-dealer, recruiter, employment agency, or fiduciary, and nothing it returns is investment, financial, employment, legal, or tax advice.
Results, including news, company data, prices, and funding information, are not a recommendation, solicitation, or endorsement to buy, sell, or hold any security, asset, or strategy, and must not be presented to anyone as such. Clair returns records that match your inputs; it expresses no view on them.
A job or salary result is not an offer, a guarantee of availability or pay, an assessment of an employer, or a recommendation about a candidate. A review, rating, or contact result is not an assessment of the business or person concerned.
You are solely responsible for decisions you make. Verify material information at the original source and consult a qualified professional when appropriate.
09 / AVAILABILITY
Availability and support
We work to keep the Service available and accurate, but unless we agree otherwise in a signed writing, no uptime, latency, coverage, or support response time is guaranteed.
Source websites can block, change, or remove pages at any time, so coverage varies by API, source, location, and period. Clair does not warrant that any particular page, listing, company, article, or result is returned. Do not rely on the Service as the only source for time-sensitive, safety-critical, or consequential decisions.
10 / INTELLECTUAL PROPERTY
Intellectual property and feedback
Serin retains all rights in the Service, including its software, documentation, schemas, and branding. These terms grant you only the rights stated in them.
You retain any rights you have in the inputs you submit. You authorize Serin and its service providers to process them as needed to authenticate, secure, meter, operate, and answer your requests.
If you send suggestions or feedback, we may use them without obligation to you.
11 / SUSPENSION
Suspension and termination
You may stop using the Service at any time and may delete your account from dashboard Settings. Deleting an account cancels any active subscription immediately; usage incurred before deletion remains payable.
We may suspend or terminate access, with notice where reasonably practicable, if you breach these terms, fail to pay, create risk or legal exposure for Serin or others, or threaten the integrity of the Service for other customers. We may discontinue the Service or any API; if we discontinue a paid API during a period you have paid for, we will refund the unused portion of that period's fee.
Sections that by their nature should survive termination survive it, including those on payment owed, third-party content, personal data, no advice, disclaimers, liability, indemnity, and governing law.
12 / DISCLAIMERS
Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, Serin Technologies, LLC and its members, managers, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service, even if advised of their possibility.
To the maximum extent permitted by law, total liability arising out of or relating to the Service is limited to the greater of USD 50 and the amounts you paid for the affected API in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain warranty exclusions or liability limits. In those jurisdictions, these clauses apply only to the extent permitted by law.
13 / INDEMNITY
Indemnity
You will defend and indemnify Serin Technologies, LLC and its members, managers, employees, and contractors against third-party claims, and resulting losses, damages, fines, and reasonable legal fees, arising from your use of results, your breach of these terms, or your violation of law or of another person's rights, including claims by publishers, source owners, or people whose data you used.
14 / COMPLIANCE
Export controls and sanctions
You may not use the Service if you are located in, or are owned or controlled by a person in, a country or region subject to comprehensive U.S. sanctions, or if you are on a U.S. government restricted-party list. You will not use the Service in violation of applicable export control or sanctions laws.
15 / GOVERNING LAW
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over disputes arising out of or relating to these terms or the Service, and both parties consent to that jurisdiction.
Before starting proceedings, please email us so we can try to resolve the matter informally. Nothing in this section limits mandatory rights you may have under the law of the country where you live.
16 / GENERAL
General terms
These terms, the Privacy Policy, and the plan details shown at checkout are the entire agreement about the Service and replace earlier understandings. If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver.
You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
We may send notices to the email address on your account. Send notices to us at the address below.
17 / CHANGES
Changes to these terms
We may update these terms from time to time. The current version is always published here with the date it took effect.
For material changes, we will give notice on this page and, for customers with an account, by email before the change takes effect. Continued use of the Service after updated terms take effect constitutes acceptance.
