1. Acceptance of Terms

By accessing and using AIPetGen ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

AIPetGen is an AI-powered creative platform that provides image generation (Create) and video generation (Animate). We offer limited free quotas (e.g., guest trials, daily uses) and optional paid credits. We may adjust model availability, free limits, or pricing in response to infrastructure costs or policy changes.

3. Age Restriction

The Service is intended for users who are 18 years of age or older, or the age of majority in your jurisdiction. By continuing, you confirm that you meet this requirement. You may not use the Service to create content prohibited by these Terms, including pornographic or sexually explicit content.

4. AIGC Use Rules and Prohibited Content

You must not ask the Service to generate, upload, or share any of the following six categories of content. AIPetGen does not allow pornographic or NSFW output, whether or not it is non-consensual, and does not allow output that infringes copyright or trademarks. Violations may result in immediate suspension and the withholding of remaining credits. We will cooperate with the competent authorities when required.

1. Content that violates law, endangers national security, honor, or interests, leaks state secrets, or undermines national unity, social stability, or ethnic unity.
2. Obscene, pornographic, or sexually explicit content, including any NSFW image or video. This prohibition is not limited to non-consensual sexual content. Sexual content involving minors is always prohibited.
3. Violent, terrorist, gory, or self-harm content, or content that incites crime.
4. Content that infringes another person's reputation, privacy, or likeness, and deepfakes or forgeries of real people, including public figures and private individuals, made without consent.
5. Content that infringes another person's copyright, trademark, or other intellectual property.
6. Rumors, fraud, hate speech, and any other content prohibited by law or regulation.

5. User Generated Content & Liability

AIPetGen is provided “AS IS”. You are solely responsible for the prompts and outputs you create. The generation of content does not imply AIPetGen’s endorsement. You agree to indemnify, defend, and hold AIPetGen harmless from any claims arising from your violation of these Terms or your distribution of generated content.

6. Quotas, Credits, and Payments

Free quotas reset daily and cannot be hoarded, transferred, or re-sold. Guest usage is rate-limited by visitor fingerprint and IP to prevent abuse. Paid credits are sold through Stripe, Waffo, or other approved processors, hold no monetary value outside the Service, and all sales are final due to GPU/server costs. Video generation (Animate) requires paid credits only; there is no free tier for video. We may compensate downtime with bonus credits at our discretion but do not offer cash refunds.

7. Intellectual Property

You retain ownership of the content you generate, subject to a non-exclusive license granted to AIPetGen to host, display, and review that content. You represent that your prompts, reference images, names, and results do not infringe anyone else's copyright, trademark, or other intellectual property. All underlying technology and branding remain the property of AIPetGen.

8. Limitation of Liability

AIPetGen shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service.

9. Reporting & Removal

If you believe your rights are being infringed or content violates these Terms, please contact us at hello@aipetgen.com with relevant details. We will review and respond to takedown notices in accordance with applicable law.

10. Data Retention

Generation history and prompts are kept until you delete them. Reference uploads may be stored to provide the Service. Guest/IP quota logs are kept for up to 7 days. We may preserve information longer to comply with legal obligations.

11. Local Compliance

You are responsible for ensuring the Service is legal in your jurisdiction. We may restrict or terminate access in regions where our offerings conflict with local regulations.
