PROFESSION
Introduction:
Profession is the mastery of specific activities demanding prolonged
period of study and practice in any discipline before they can be
completely applied.

A professional architect, engineer, doctor or lawyer has nothing to sell


except his disinterested personal service. The central theme of any
profession is to provide an unselfish service to mankind.

To profess means to take a vow of service and to live one’s career by a


high standard than is expected of others.
Characteristics of a profession are:
 Corpus of Knowledge
 Prolonged period of study and practice
 Membership of a professional association
 Code of conduct
 Social responsibility
A professional architect is required to satisfy all the above characteristics.
A professional in general, and an architect, in particular, has abundant
social responsibility. His obligation to the society in which he operates
is termed as social responsibility.

1. Preservation of environment,
2. elimination of poverty,
3. best value for clients money,
4. judicious us of depleting natural resources,
5. conformance to building byelaws and regulations
are some of his social responsibilities

PROFESSION OF ARCHITECTURE

Architecture is a social art that touches all human beings at all levels of
their existence everywhere and everyday. This is the only discipline, which
encompasses the four major fields of human endeavour :
Humanities,
Science,
Art, and
Technology

actually putting into practice the professional inputs drawn from them. In
sum, Architecture is the matrix of human civilization - an authentic
measure of the social status, and an evocative expression of the ethos of
an era. When conserved, it is heritage and when in ruins, it becomes
archaeology, reconstructing tell-tale pictures of the past civilizations.

The professional services, rendered by Architect means the services rendered pursuant to the
conditions of engagement and the
agreed scale of charges entered into between the Client and the Architect in their
agreement.
“Service”, under the consumer protection Act 2019, means service of any description
which is made available to potential users & includes the provision of facilities in
connection with banking , financing insurance, transport, housing construction etc ,. But
does not include the rendering of any service free of charge. Professional service by an
Architect , falls under the ambit of “Service” and service tax has to be
paid for his services by the client.

An architect has to register for professional tax in commercial tax office of the jurisdiction.
Comprehensive Architectural Services on any undertaken project

The Architect is required to provide services in respect of the following :
1.1 Taking Client's instructions and preparation of design brief.
1.2 Site evaluation, analysis and impact of existing and / or proposed
development on its immediate environs.
1.3 Design and site development.
1.4 Structural design.
1.5 Sanitary, plumbing, drainage, water supply and sewerage
design.
1.6 Electrical, electronic, communication systems and design.
1.7 Heating, ventilation and air conditioning design (HVAC) and
other mechanical systems.

Code Of Professional Conduct
ARCHITECTS ACT 1972
Background :
The Legislature intention to achieve with the passing of the Act:
Since Independence and more particularly with the implementation of Five Year plans,
the building construction activity in our country has expanded almost on a phenomenal
scale. A large variety of buildings, many of extreme complexity and magnitude, like
multi-storied office buildings, factory buildings, residential houses, are being constructed
each year. With this increase in building activity, many unqualified persons calling
themselves as architects are undertaking the construction of buildings which are
uneconomical and quite frequently unsafe, thus bringing in to disrepute the profession of
architects. With passing of the Act, it will be unlawful for any person to designate
himself as architect unless he has the requisite qualifications and experience and is
registered under the Act.

In the parliamentary debates on the 1972 Bill, Professor S.Nurul Hasan, the then
Minister of Education, noted that “..any engineer or other qualified professional person
can continue to engage himself in design, supervision and construction of buildings as
long as he does not style himself as and architect”
Present legal status:
It is a settled legal position that a statute must be construed so as to prevent the mischief
and advance the remedy according to the true intention of the makers of the statute,
which protects the use of the style and title of architect.

Architects have to comply with professional conduct , and etiquette and code
of ethics of the Architects regulations 1989 , violations of any
of the provisions shall constitute professional misconduct(section 30 of 1972
Act).
Architecture is primarily the art & science of designing spaces for
multifarious activities ,where various engineering services are rationally
combined with Architecture’s basic elements of Space ,Structure & Form.
In its broadened scope & baffling complexity, Architecture has
generated specializations such as Structural Design , Urban Design
,Landscape Architecture, Interior design , The Recent specializations also
include Retrofitting of buildings, Architecture conservation & Construction
Management.
Architectural design is essentially a product of an individual mind but
realized through association of experts from allied fields who
contribute in the process of construction for ensuring the high quality of the
end product. The practice of the Architecture profession is
regulated by the Architects Act 1972.The Council of Architecture has
prescribed the conditions of engagement and scale of charges under the
Architect’s professional conduct regulation 1989.
