RE: Special Election September 16, 2025, Neil J. Gillespie for Mayor (updated)
Neil J. Gillespie
Thank you to my supports in my quest to be your next mayor, but I did not qualify.
A Special Election was called when no candidates qualified. Under the special election rules I
was required to obtain 25 petitions signed by eligible voters who live within the city limits of the
City of Ocala, Florida, and provide them to the City Clerk, Angel B. Jacobs, by 12 Noon on
Friday, July 18, 2025. I submitted 41 petitions, but only 12 were accepted.
Under Florida election law, a candidate generally has the option to either pay the filing fee, or
obtain candidate petitions. However in the City of Ocala, a candidate must pay the filing fee
AND obtain 25 petitions. I paid the filing fee for the General Election, and for the Special
Election. I turned in 41 candidate petitions on July 18, 2025. Marion County Supervisor of
Elections Wesley Wilcox only accepted 12 of my 41 candidate petitions. I contend the petition
requirement is unconstitutional because I paid the filing fee for each election.
Separately, Mr. Wilcox contends I do not live in the City of Ocala, Florida because my address is
not recognized as residential by the post office. Therefore I am filing a federal voting rights
lawsuit under 52 U.S. Code § 10502 - Residence requirements for voting, seeking relief, and
52 U.S. Code § 10504 - Judicial relief; civil actions by the Attorney General; three-judge district
court; appeal to Supreme Court.
Attached is my Candidate Petition Signature List prepared by Mr. Wilcox showing the 12
petitions he accepted out of 41 total. Check your name on the list to see if your petition was
accepted. Thanks again for your support.
