HUD DISCLOSURES / INFORMATION - NONPAYMENT OF RENT

HUD DISCLOSURES (Applicable to HUD Handbook-4350.3/24 CFR 247.4 covered tenancies):


In accordance with the HUD Handbook 4350.3, the dollar amount of the total balance due on your rent account is $_____________
(insert total balance of unpaid rent only)a, which said amount was calculated on the following date: ______________________ b.
Please note that the foregoing information is being provided to you solely for informational purposes pursuant to HUD requirements.
You may avoid termination by paying the amount specified in the termination notice to which this disclosure is attached.

Notice Enforcement: If you remain in the leased unit on the date specified for termination, we will enforce the termination only by
bringing a judicial action at which time you may present a defense. You have ten days within which to discuss this eviction with
management. This 10-day period commences on the earlier of the day the notice is hand-delivered to your unit or the day after it is
mailed. The discussion period does not extend the date for termination. Persons with disabilities have the right to request an
accommodation to participate in the process.

Service (also applicable to RD): Notice Served by one of the methods listed above, AND mailed to Unit AND:
1. Attempt to serve the notice personally to any adult answering the door. If unable to do that:
2. Attempt to slide the notice through the door (mail slot) or under the door. If unable to do that:
3. Post the notice on the door at eye level.
AND for Rural Development projects, mail a copy to the RD office.

HUD INFORMATION FOR TENANTS: (Applicable to HUD Notice PIH 2021-29/H 2021-06-covered tenancies):

The U.S. Department of Treasury’s (“Treasury”) Emergency Rental Assistance (ERA) program makes funding available to assist
households that are unable to pay rent or utilities. The funds were provided directly to states, U.S. territories, local governments, and
(in the case of the first program, ERA1) to Indian tribes or Tribally Designated Housing Entities, as applicable, and the Department of
Hawaiian Home Lands. Grantees use the funds to assist eligible households through existing or newly created rental assistance
programs.

In guidance and FAQsc, Treasury advised that participants in HUD-assisted rental programs (including the Housing Choice Voucher
(HCV), Public Housing, or Project-Based Rental Assistance programs) are eligible for the ERA program and may receive assistance
for the tenant-owed portion of rent or utilities that is not subsidized. In FAQsd for PHAs and HCV landlords, PIH clarified that this
assistance can include rent arrearages and utilities owed over the utility allowance. The FAQs include additional guidance on interim
reexaminations, income calculations, and additional considerations for private landlords participating in the HCV program.

Leases may not be terminated due to nonpayment of rent until at least 30 days have passed after a tenant receives this notice.
