Section 1 GENERAL INFORMATION

The Sacramento County Superior Court has adopted the following bail schedule pursuant to Penal Code
section 1269b(c). This schedule is to be used in setting bail for people who have been arrested without a
warrant for the alleged commission of any offense, prior to the person’s appearance before a judge.

• For any felony offense for which no presumptive bail is set forth, bail is fixed at $10,000.

• For any misdemeanor offense for which no presumptive bail is set forth, bail is fixed at zero.

• Bail shall be zero dollars ($0) for an individual who has been arrested in connection with a
proceeding in another state regarding an individual performing, supporting, or aiding in the
performance of an abortion in this state, or an individual obtaining an abortion in this state, if the
abortion is lawful under the laws of this state.

• When a person is booked on multiple felony charges, the presumptive bail amount shall be the
largest amount specified in the schedule for any one of the felony charges, plus applicable
enhancements (i.e. no “stacking” unless deemed appropriate in the court’s discretion).

• When a person is booked on multiple felony charges, two or more of which constitute a “violent
felony” (Penal Code Section 667.5(c)) or a “serious felony” (Penal Code Section 1192.7(c)), the
presumptive amount shall be the aggregate of each such charge, unless punishment for a
particular charge would be barred by PC 654 (i.e. “stacking” permitted).

• Bail for all arrests when the person is on misdemeanor probation, felony probation, parole, post-
release community supervision, or mandatory supervision, may be set in accord with the Court’s
bail schedule, according to the underlying offense for which the defendant is subject to
supervision.

• The amount of bail for any offense listed as “no bail” will be determined at the first appearance.

In light of the California Supreme Court’s opinion in In re Humphrey (2021) 11 Cal.5th 135, this bail
schedule is intended only to be used in setting an initial bail amount upon a person’s arrest prior to
arraignment.

In accord with In re Humphrey, once an arrested person has been arraigned, the court will make an
individualized assessment of whether victim and public safety can be adequately safeguarded, and the
arrested person’s attendance at future court dates can be adequately ensured, by allowing the person to
be released pre-trial subject to non-financial conditions such as monitored release.

If the court determines that victim or public safety, or the arrested person’s appearance at future court
dates can only be ensured by a financial condition, the court will make an individualized assessment of
the person’s ability to pay in setting an affordable bail amount. An arrested person will not be detained
pre-trial on bail that exceeds what the person can afford to pay or on no-bail status unless the court finds
by clear and convincing evidence that no condition short of detention could suffice to protect public or
victim safety or to ensure the person’s attendance at future court dates.
