Powers of the Ombudsman
The ombudsman being a body above the public functionaries is by law granted certain
powers to promote the spirit and the function for which this office was created, else the
"Watchdog" would just watch being handicapped. The Statutes of the Ombudsman,
regardless of the State, give them power to accept complains, hear the complains,
summon the government officials. Further more, where the find "Maladministration"
present in any act of a public functionary, the Ombudsman possesses the power to
prosecute such Government Official. The report of the Ombudsman and it's finding
have an important value and is regarded when it's in the file of a government servant, it
might hamper the promotion of such officer. To give it a strong root, specifically in
Pakistan, the Ombudsman of various types have been granted the same powers as are
vested in a Civil Court under the code of civil procedure for summoning and enforcing
the attendance of any person; compelling the production of documents; receiving
evidence on affidavits and issuing commission for examination of witnesses.
The Ombudsman also possesses the power to award compensation, damages or cost.
Section 14(4) of the Punjab Office of the Ombudsman Act 1997, allots the power to
award Damages to the Government Agency or public servant where the complaint is
found to be frivolous and vexatious. Whereas the opposite is stated in Article 22 of the
Office of Ombudsman Order 1983, which states that Ombudsman shall have the power
to award damages to the Complainant for any loss or damage.
