PLEASE TAKE NOTICE that upon the annexed affirmation of Rahul
Manchanda dated June 5, 2025 and the exhibits annexed hereto, and upon
all the pleadings and prior proceedings heretofore had herein,
Plaintiff Rahul Manchanda files this Notice of Motion for Contempt
against Judges James Hyer, Rolf Thorsen, and Family Court Support
Magistrate Rosa Cabanillas-Thompson before this Honorable Court
located at 111 Dr. Martin Luther King Jr. Blvd, White Plains, NY 10601
for an returnable Friday June 13, 2025 at 9:00 AM pursuant to CPLR §
5104 and JUD § 756, and for such other and further relief as this
Court may deem just, proper, and equitable.

Rule 2214(b) A notice of motion and supporting affidavits shall be
served at least eight days before the time at which the motion is
noticed to be heard. Answering affidavits shall be served at least two
days before such time. Answering affidavits and any notice of
cross-motion, with supporting papers, if any, shall be served at least

Plaintiff, Rahul Manchanda, in support of his Notice of Motion
for Contempt Against Judges James Hyer, Rolf Thorsen, and Family
Court Support Magistrate Rosa Cabanillas-Thompson, alleges:
THE LAW
1. Pursuant to CPLR § 5105 and JUD § 756, an application to
punish for a contempt punishable civilly may be commenced by
notice of motion returnable before the court or judge
authorized to punish for the offense, or by an order of such
court or judge requiring the accused to show cause before it,
or him, at a time and place therein specified, why the accused
should not be punished for the alleged offense.
2. The application shall be noticed, heard and determined in

accordance with the procedure for a motion on notice in an
action in such court, provided, however, that, except as
provided in section fifty-two hundred fifty of the civil
practice law and rules or unless otherwise ordered by the
court, the moving papers shall be served no less than ten and
no more than thirty days before the time at which the
application is noticed to be heard.
3. The application shall contain on its face a notice that the
purpose of the hearing is to punish the accused for a contempt
of court, and that such punishment may consist of fine or
imprisonment, or both, according to law together with the
following legend printed or type written in a size equal to at
least eight point bold type:

BACKGROUND AND FACTS
5. As the Exhibit shows, this Judge James Hyer emailed me
yesterday his attached “voluntary recusal” because he “wants
to avoid the appearance of impropriety” after wasting an
entire week of precious time (such a nice ethical guy),
Plaintiff was forced to ask the Court Clerk to at least tell

if he signed off on the Order to Show Cause/TRO/Preliminary
Injunction or not?
6. Because that was the REAL issue.
7. Also as per the attached, a formal judicial misconduct
complaint was then filed against Westchester County Supreme
Court Judge James Hyer who apparently found no problem denying
my emergency order to show cause for a temporary restraining
order, or preliminary injunction, or temporary reduction in
child support based on having ZERO income for the past 6
months, which was returnable on June 2, 2025, and for which
decision I never received, but then yesterday, June 4, 2025,
this abominable bastard decided to "voluntarily recuse" from
the case itself all by himself, due to his wanting to "avoid
the appearance of impropriety" because he "works with some of
the defendant judges on" my lawsuit herein.
8. But obviously, since he denied my emergency child support
reduction, he already did more damage than could possibly be
imagined.
9. Then, also per the Exhibit, and further to the above, we were
forced to file another formal support magistrate/judicial
complaint against New Rochelle NY Westchester Family Court

Support Magistrate Rosa Cabanillas-Thompson, who then
yesterday issued the attached "Order on Motion," without
conducting any hearing, fact finding, motion practice, or
trial, the next scheduled fact finding hearing supposedly
scheduled for July 7, 2025 before I had filed the instant
Notice of Appeal to the Westchester Supreme Court case index
no 63333/2025 including/referencing both petitions (including
the one she ruled on).
10. Do these people have any respect for, or knowledge of, the
law?
11. FCSM Rosa Caaillas-Thompson had no right or jurisdiction to
rule on this more than 1 month before our next scheduled
hearing, out of spite.
12. Please hold these government employees in contempt of court,
and punish these hypocritical, dangerous scumbags, to the
fullest extent possible.
