SECTION 5: TERMS AND CONDITIONS
General Conditions and Student Responsibilities
1. As a Victoria University student, you are bound by the University's statutes, policies and rules, including the
Student Charter: http://www.vu.edu.au/about-us/vision-mission/student-charter. Breaches may result in your
enrolment being suspended or cancelled and this may affect your student visa.
2. You must commence each course on the start date specified in this agreement and on your eCoE. Failure
to start on this day will result in your eCoE being cancelled in accordance with the ESOS legislative
framework. This may result in your student visa being cancelled. To seek permission to arrive later than

3. In instances in which a student's course enrolment (or package of course enrolments) changes, the
University will consult with the student before making the necessary administrative changes, and will notify
the student by email of these changes. The student's eCoE will be adjusted to reflect the student's updated
enrolment, but no new letter of offer will be issued. If the change extends a student's total study duration, it
is the student's responsibility to contact Department of Home Affairs (DHA) for advice about their student
visa.
4. You must advise the University within 7 days of any change to:
1. your current residential address, mobile number, and email address
2. whom to contact in emergency situations
5. This offer is dependent upon you remaining on your current visa for the duration of the course(s) stipulated
in section 1. Should your circumstances change in future, VU reserves the right to re-assess your
application according to the University's Admissions policy.
6. You must not work more than the 40 hours each fortnight when your course is in session, but may work
unlimited hours during formal holiday periods. Holders of a Postgraduate Research visa who have started
their course have unrestricted permission to work. Work is not guaranteed and any work that you undertake
must not impact upon your studies.
7. You must attend classes during compulsory study periods. Leave of Absence can only be taken during
study periods if approval has been granted by Victoria University, and will not result in a refund. Approval is
granted only for compassionate or compelling circumstances. Students who fail to obtain approved Leave
of Absence during compulsory study periods may be refused re-entry to Australia by the Department of
Home Affairs (DHA). For further details regarding international student Leave of Absence are provided at

8. Your enrolment may be cancelled if you do not return to study following a holiday period or approved Leave
of Absence; due to misbehaviour; or failure to pay tuition fees by the specified due date. Further details
about the University's procedures for deferment, suspension and cancellation of studies are provided at

9. VU expects students to be active and engaged learners. In accordance with the Enrolments Procedure,
students enrolled in block study periods who do not actively engage in study in the first week will be
withdrawn from that unit. This may have implications for your course progression and any external
sponsorship arrangements. Repeated non-engagement will lead to course discontinuation and
cancellation of your COE.
10. You must complete your course by the end date of your CoE. To achieve this, a standard study load of 48
credit points must be maintained in each half year. TAFE students must average at least 20 hours per week
over a semester with no less than 36 weeks in an academic year. Further details are provided at

11. You are required to participate actively in all classes and any agreed additional English language or
academic support in order to improve your English language proficiency over the course of your studies. If
you fail to attend at least 80% of classes, and to submit all assignment work, you will not be considered as
having made a reasonable effort to study that course.
12. Please note if your offer includes recognition of your prior learning/experience, this means the University
has given you academic credit towards your chosen course either because you have successfully applied
for it, or because of a formal pathway arrangement the University has with an education institution at which
you have studied. As a result, the anticipated duration of your studies will be shorter than usual, as you will
have fewer units of study to complete the course in order to graduate. By accepting this offer, you
acknowledge that:
a. The shorter period of study will be recorded in the eCoE issued to you by the University;
b. The University cannot reverse or cancel the academic credit you have received or extend the duration
of your enrolment unless it is in accordance with the strict and limited grounds set out in the National
Code of Practice for Providers of Education and Training to Overseas Students 2018 (National Code).
13. You are liable for the payment of any units of study that must be repeated as a result of academic failure.

14. To avoid incurring a debt to the University, tuition fees must be paid by the due date specified on invoices
issued by the University each semester. As at March 2020, there is a $158 penalty for the late payment of
tuition fees that will be applied to your account if you fail to pay your tuition fees by the due date. There is a
further $158 penalty if you remain enrolled and your case is referred to a debt collection agency for the
recovery of unpaid tuition or materials fees. Failure to pay at this stage may incur legal action, which may
incur additional penalties.
If your enrolment is cancelled for the non-payment of fees and is subsequently reinstated, a $158
reinstatement fee will apply (as at March 2020).

15. The University applies fines to items borrowed from its libraries if they are not returned. As at March 2020:
a. Items more than 28 days overdue (or less than 28 days for short-term loan items) will attract an
infringement penalty of $20
b. Overdue items with a hold placed on them are issued a Recall Notice; if the item is not returned within
7 days from the date of notice, there is an infringement penalty of $20 per recalled item.
c. Items overdue from participating CAVAL libraries will also attract an additional Victoria University
infringement penalty of $20.
d. Items that are not returned, lost or damaged normally attract a penalty of $125 per item.

16. If you incur an outstanding debt (e.g. tuition fees or library fines), your enrolment will be encumbered until
the debt has been paid in full. The encumbrance will cause the following restrictions to apply:
a. Loss of access to library borrowing and other library services;
b. Loss of access to Victoria University's computer systems, including internet and email;
c. Loss of access to enrolment records, examination results and academic transcripts; and
d. Inability to graduate or receive your award until the outstanding debt is cleared.
17. Changes to your study program after the census date will incur financial charge. Census dates are
published on the VU website.
18. You are responsible for keeping a copy of this Written Agreement, and copies of receipts for the payment of
tuition fees or non-tuition fees.
19. If you wish to defer your commencement date or change your course preference, please go to

Preference-A220_AU.pdf. All course academic and English language entrance requirements are subject to
change. Any applications to defer will be subject to the current Academic and English language entrance
requirements for the course at the time of applying. Qualifications and evidence of English proficiency will
be checked to ensure its validity for the new deferred intake.
20. If you wish to transfer to another institution, you must apply for approval from the University if you have not
completed six calendar months of your principal course of study. 'Principal Course' means the highest level

21. If you apply for a student visa under Simplified Student Visa Framework (SSVF) arrangements and seek to
transfer to a different course, you may be required to make a new visa application to continue to study in
Australia.
22. If your student visa application has been refused, a new eCoE will not automatically be issued. Evidence of
the reason for refusal needs to be supplied to Victoria University International before your request for a new
eCoE will be considered.
23. If you are under 18 years of age, you must maintain adequate arrangements for your accommodation,
support and general welfare during your stay in Australia. You must not change these arrangements
without prior written approval from Victoria University International.
24. In accepting this offer to study at Victoria University in Australia, you agree that you have the financial means
to support yourself and any dependents for the duration of your studies specified in this agreement, at a
level no less than the total tuition fees stated in this agreement and the minimum annual living costs
recommended by the Department of Home Affairs (DHA) which is currently $21,041 per year.
25. As part of the Simplified Student Visa Framework arrangements, Victoria University and/or the Department
of Home Affairs (DHA) may request evidence that you have sufficient financial means to support yourself
and your studies for the duration of your stay in Australia. You cannot rely on income earned from part-time
employment in Australia to reduce the level of funds required for tuition fees and living costs.
26. Any school-aged dependants accompanying you to Australia must attend school and you are required to
pay full fees for the course whether they are enrolled in a government or private school, which involves a
minimum cost of $8,000 each year.
27. VU will provide you with an email address and access to an online student portal. You must regularly check
this email address and portal, since VU will use it to send you important information, including enrolment
information and invoices. Any email sent to your VU email address will be taken as read by you on the date
that it was sent.

Student Rights and Benefits
1. As an international student studying at an Australian campus of Victoria University, your interests are
protected by the Education Services for Overseas Students Act 2000 (ESOS Act). Details of the ESOS Act
are available at https://internationaleducation.gov.au/Regulatory-Information/Education-Services-for-
Overseas-Students-ESOS-Legislative-Framework/ESOS-Regulations/Pages/default.aspx.
2. In the event of the University:
a. failing to provide the course to you at the location on the agreed starting day; or the failing to start
providing the course at the location on the agreed starting day; or
b. ceasing to deliver the course at the location after the course starts but before you complete it,
this constitutes Provider Default. The University will fulfil its obligations under the ESOS Act within fourteen
(14) days of the default occurring. This can be either through:
a. offering you a place in an alternative course that you choose to accept; or
b. providing a refund of unspent tuition fees that you have paid.
If the University does not discharge its obligations under the ESOS Act within fourteen (14) days, the Tuition
Protection Service (TPS) will assist you in finding an alternative course or to get a refund if a suitable

3. Victoria University offers accommodation to international students, subject to availability. For detailed
information, including associated costs and application procedures, please visit

4. If you experience academic, English language or personal difficulties at any time during your enrolment,
you are able to access Victoria University's full range of academic, English language and/or welfare
services at no additional charge.
5. Victoria University has a policy framework to assist students in resolving any complaints or concerns they
have, including the provision of free and confidential services to support you. When appropriate, you are
encouraged to resolve your complaint at the local level. If you are unable to do so, the Integrity Office can be
contacted to lodge a complaint through it. The University will commence assessment of your complaint
within ten working days of receiving it, and determine an outcome as soon as is practicable. If you are
unable to resolve your complaint to your satisfaction using the University's internal processes, the Victorian
Ombudsman independently investigates complaints about universities. They are impartial and do not act
on behalf of students or universities. The Victorian Human Rights and Equal Opportunity Commission and
the Australian Human Rights Commission are also able to assist with complaints involving discrimination,
harassment, and vilification.

6. This written agreement, and the right to make complaints and seek appeals of decisions and action under
various processes, does not affect the rights of the student to take action under the Australian Consumer
Law if the Australian Consumer Law applies.
Privacy Statement

Victoria University is committed to the responsible collection and handling of your personal information in
accordance with all relevant legislation, including the Privacy and Data Protection Act 2014 (Vic.) and the Health
Records Act 2001 (Vic). The personal information collected on this form and the additional documentation
supporting your application will be used by VU and may be provided to third parties for the purposes of
assessing and processing your application and managing your enrolment. If you are a sponsored student,
Victoria University may provide information about your academic performance, academic progress, attendance
and conduct to your sponsor.

Your personal information may be disclosed to Commonwealth and State Government Agencies pursuant to
reporting obligations under applicable Australian legislation. Your personal information will also be disclosed to
your overseas student health care provider and, if you are under 18 years of age, to the carer appointed for you
under the National Code made under the Education Services for Overseas Students Act 2000. Your information
will not be disclosed to other third parties without your consent. Information contained within your application to
study at Victoria University may be verified with relevant authorities in the country of issue by VU staff member or
nominated representative.

In the event that Victoria University requires information regarding your student visa entitlements, you agree to
Victoria University accessing your student visa information through the Australian Department of Home Affairs'
online Visa Entitlement Verification Online (VEVO) system.

Permission to Release Information

I authorise Victoria University to collect and relay the information in the categories listed below to my nominated
sponsor or loan organisation. I also agree to complete and return progress reports (if requested) by the dates
specified, advise the University promptly of any change of address, and to seek approval from the VUI
Scholarships Team prior to initiating any change to my enrolment status, including (but not limited to) requests
for:

• Deferral
• Intermission/Leave of Absence
• Change of citizenship or residence status
• Advanced Standing
• Under-loading/overloading
• Cross-institutional enrolment (outbound)
• Change of course
• Extension of candidature/eCoE
• Discontinuation
Information that may be provided to my nominated sponsor or loan organisation may include:

• Financial information relating to tuition fee and other education costs, such as OSHC, stipend, service fees,
textbook and equipment cost estimates
• Information regarding enrolment, and changes to status of enrolment
• Academic results and/or Academic progress issues, or other related issues impacting on progress as
discussed and agreed with Victoria University staff
• Student welfare issues as discussed and agreed with Victoria University staff
• Information regarding study periods in academic years
• Information for tax purposes
Acknowledgement of Personal Fee Liability

I understand and acknowledge that:

• I am responsible in obtaining an official Financial Guarantee (FG) from my sponsor specifying their
financial obligations (including tuition fees, Overseas Student Health Cover, course material fees and other
charges) to Victoria University
• I will ensure payment of my fees will be made before the prescribed due date or upon receipt of payment
from my sponsor (where applicable), whichever comes first
• my enrolment may be discontinued by Victoria University for non-payment of fees
• I will pay any outstanding fees (including any administrative fees) before my enrolment may be reinstated
• I am responsible for meeting and adhering to my student visa conditions
• changes in my enrolment status will be reported to Department of Home Affairs (DHA)
• discontinuation of my enrolment due to non-payment of fees may lead to the cancellation of my Electronic

Part D - Fee Refunds

(55) Where the student has cause to cancel their enrolment during the year the Director, Student Administration,
or their nominee, may approve or authorise the refunding of all or part of any fees and charges.

Eligibility - International Onshore Students

(59) Eligibility for full or partial refunds are summarised in the table above, and detailed below.
(60) References to Census Date for international students in regards to Fee Refunds means the Census Date of
the first study period in each Semester/Trimester.
(61) An international student will be entitled to a full refund of tuition fees and any deposit paid for a study period
at VU in the following circumstances:

a. In the event that an offer is withdrawn by the University;


b. In the event that the University is unable to provide the course (provider default). In this situation, new
commencing students will also be eligible for a refund of the application processing fee;
c. Where a student was unable to attain the level of English language required to commence a course, as set
out in the Letter of Offer, and is able to prove that they made reasonable efforts to meet that condition. In this
situation, the refund applies only to study periods that have not commenced;
d. Where a student has been excluded by the University for failure to meet course progression rules and
where tuition fees were paid in advance of notification of exclusion (the refund in this subclause will be only
for those periods of study not yet started, and will not include the non-refundable deposit);
e. When illness or disability prevents the student from enrolling in the course;
f. When the death of a close family member (parent, sibling, spouse or child) occurs, and the Student
withdraws from their course before commencement for VU English course, or Census Date for other
courses, or after these dates at the discretion of the Senior Vice-President, Future Students and Planning;
or

g. When a political civil or natural event prevents the student from studying or paying tuition fees, before
commencement for VU English course, or Census Date for other courses, or after these dates at the
discretion of the Senior Vice-President, Future Students and Planning.
Partial Refunds for International Onshore Students

(62) A student who has paid any tuition fees for a study period for an English language course, and gives written
notice of a withdrawal or an inability to study before the commencement date, will be entitled to a refund of tuition
fees paid for the study period, less any non-refundable deposit, as set out in the student's written agreement
(signed Letter of Offer).

(63) A student who has paid any tuition fees for a study period for a course other than an English language
course, and gives written notice of a withdrawal or an inability to study, before the census date, will be entitled to
a refund of tuition fees paid for the study period, less any non-refundable deposit, as set out in the student's
written agreement (signed Letter of Offer).
(64) Where a student's enrolment has been cancelled for non-payment of tuition fees, the student will be entitled
to a refund of any partial payment made less any non-refundable deposit, as set out in the student's written
agreement (signed Letter of Offer). Any application fee paid will not be refunded.

(65) Where:

a. Australian Government authorities refuse to grant a student visa; or


b. the student visa is not granted in time for the student to start the course; or
c. a student withdraws their visa application with the Australian Government before the commencement of the
Course; or
d. the student does not submit a visa application; or
e. the student fails to provide additional information to support their application, as requested by the University
(e.g. statement of purpose or certified documents); or
f. where the University withdraws an offer based on incorrect, false or incomplete information provided by the
student or their agent,
The student will be entitled to receive the total amount of the pre-paid fees the University received for the course
in respect of the student minus the lesser of:
a. 5% of the total amount of pre-paid fees that the provider received in respect of the student for the course
before the default day; or,
b. $500.
No Refunds - International Onshore Students

(66) Any student who withdraws from their course after Census Date in a semester, or after the commencement
of their VU English course, will not be eligible for any refund of Tuition Fees paid for that semester except on
extraordinary humanitarian grounds at the discretion of:

a. The Senior Vice-President, Future Students and Planning, or


b. In the case of VU English students, the General Manager, VU English.
(67) A student who gives notice in writing of an inability to undertake a course, or withdraws from the course at
any time, will not be eligible for a refund of the Application Processing Fee.

International Students Who Obtain Permanent Resident Status

(68) A student who is granted Permanent Resident status will be eligible for a refund of Tuition Fees paid for a
semester, less a five hundred dollar ($500) service charge for the current semester, only if:

a. The Permanent Resident status is granted on or before the Census Date for that semester, and,
b. The student presents evidence of their Permanent Resident status to VU International.
(69) Permanent Resident status is recognised from the date officially recognised by the Department of Home
Affairs, not the date on which the application for status is made.
(70) A student who is granted Permanent Resident status after the Census Date for a semester will not be
eligible for a refund of tuition fees paid for that semester. The student will be classified as an international
student for the remainder of that semester.

(71) A student who is granted Permanent Resident status prior to Census Date in a semester will lose their full-
fee student place and must re-apply for course entry in competition with other course applicants for either
government-supported places, or for domestic fee paying places.

(72) A continuing student who seeks to become a local fee paying domestic student following a grant of
Permanent Resident status, may have their pre-paid tuition fees carried over in the appropriate semester.

Student Services and Amenities Fees (SSAF)

(73) HE Students and VET students (at or above Diploma level) who withdraw from their course before the
census date are eligible for a refund of SSAF. Eligibility for International Onshore Students are detailed in Table
1.

(74) VET students at Certificate I-IV level are eligible for:

a. A full refund if they withdraw before the course start date; or,
b. For a continuing student, a full refund if they withdraw within 28 days from the course study period start date
for the year.
Late Fees & Charges

(75) Students may apply for a refund of the following late fees and charges:

a. Late enrolment charges;


b. Re-instatement of enrolment charges;
c. Late enrolment amendment charges; or,
d. Late fee payment charges.
(76) Late fees and charges determinations are made within 4 weeks of receipt of the request by Student
Administration in consultation with Student Support as appropriate.

Ancillary and Materials Fees & Charges

(77) Students who have withdrawn from any course of study are eligible to have any ancillary or material fees
refunded if they have not received the materials. If materials have been supplied, no refund will apply.

Overpayments

(78) Where a Student makes an overpayment of tuition fees, the overpaid amount will be refunded upon
application without financial penalty. A memo is required from VU English to support English language
overpayments.

Refund Application Process

(79) Students are required to provide documentary evidence in support of an application for a refund.
(80) The relevant form must:

a. be lodged within 12 months of paying the fee or charge;


b. provide evidence of the circumstances which are the basis for the claim; and,
c. provide proof of having paid the fee or charge (a receipt).
(81) Student Administration determine the application and update the Student Management System, where
required. Finance Services process approved refund requests.
International Students (83) Students can apply for a refund by completing the Refund of International Fees
online form per https://www.vu.edu.au/sites/default/files/eca-withdrawal-refund-application-form.pdf and sending
to [email protected].

Processing of refunds
(85) Where the Overseas Student Health Cover (OSHC) premium has been previously paid to the University, it is
the responsibility of the student to claim the OSHC refund from their insurer directly.

(86) Where a tuition fee has been paid by a sponsoring body or scholarship agency, any refund payable will be
made to the sponsoring body or scholarship agency.

(87) Before a refund can be processed, the funds covering the tuition fee must be available to the University, i.e.
cheques and drafts cleared and telegraphic transfers received.

(88) Refunds will be processed within four (4) weeks of receiving a written claim, provided that all the relevant
documentation has been received from the student.

(89) A student who is granted intermission or reduced study load will have any Tuition Fees paid held as a credit
on their account and treated as a payment against future study periods.

(90) Any notice given must be written in English and actually received by the University.

Review

(91) A student whose refund application is not approved may apply to have the decision reviewed by the Director,
Student Administration or the Campus Director and Principal (for VU Sydney students).
(92) The application should be submitted within 10 working days of the date on which the notification of the
decision was sent to the student. The decision of the above delegates is final and there are no further appeal
avenues within the University. External appeals may be available depending on the circumstances.

Refund of library fines


(93) All library fines issued for recalled or lost items must be paid by the due date.

(94) Generally, no refund of fines will occur unless a fault in the basis for issuing the fine is established.

(95) If the student wishes to dispute the fine on the basis that they believe it was mistakenly issued (i.e. that an
item was returned earlier than stated), or apply for a refund on exceptional grounds of financial or personal
hardship, they may do so by contacting their most convenient campus library.
(96) The Associate University Librarian, Education & Research Services (or their nominee) determines the
matter. Where applicable, a refund will be paid to the student.
