REGULATION OF THE MINISTER OF PUBLIC WORKS AND PUBLIC HOUSING OF


THE REPUBLIC OF INDONESIA
NUMBER 21 OF 2021 CONCERNING
GREEN BUILDING PERFORMANCE ASSESSMENT

BY THE GRACE OF ALMIGHTY GOD

MINISTER OF PUBLIC WORKS AND PUBLIC HOUSING OF THE REPUBLIC OF


INDONESIA,

Considering : that in order to implement the provisions of Article 123 of


Government Regulation Number 16 of 2021 concerning the
Implementation of Law Number 28 of 2002 concerning
Building, it is necessary to stipulate a Regulation of the
Minister of Public Works and Public Housing concerning
Green Building Performance Assessment;

Considering: 1. Article 17 paragraph (3) of the 1945 Constitution of the Republic of


Indonesia;
2. Law Number 28 of 2002 on Building (State Gazette of the
Republic of Indonesia of 2002 Number 134, Supplement to
State Gazette of the Republic of Indonesia Number 4247);
3. Law Number 39 of 2008 concerning the Ministry of State
(State Gazette of the Republic of Indonesia of 2008 Number
166, Supplement to State Gazette of the Republic of
Indonesia Number 4916);

and Work Procedures of the Ministry of Public Works and
Public Housing (State Gazette of the Republic of Indonesia
Year 2020 Number 473);

DECIDE:
Establish: A REGULATION OF THE MINISTER OF PUBLIC WORKS AND
PUBLIC HOUSING ON GREEN BUILDING PERFORMANCE
ASSESSMENT.

CHAPTER I
GENERAL PROVISIONS

Article 1
In this Ministerial Regulation, what is meant by:
1. Building is a physical form of construction work that is
integrated with its location, partially or entirely above
and/or in the ground and/or water, which serves as a place
for humans to carry out their activities, both for residential
or living space, religious activities, business activities,
social, cultural, and special activities.

2. Green Building, hereinafter abbreviated as BGH, is a


Building that meets Building Technical Standards and has
significant measurable performance in saving energy, water,
and other resources through the application of BGH
principles in accordance with the function and classification
in each stage of its implementation.
3. Community Green Residential Building, hereinafter
referred to as H2M, is a group of buildings with a simple
classification in the form of a single dwelling house in an
administrative or thematic environment unit that meets the
provisions of the H2M building plan.
4. Hazardous and Toxic Materials, hereinafter abbreviated as
B3, are materials that due to their nature and/or
concentration and/or amount, either directly or indirectly,
can pollute and/or damage the environment, and/or can
endanger the environment, health, human survival and
other living things;
5. Green Area is an area on one stretch with an area of at least 1
hectare (10,000 m2) and consists of at least 2 (two) buildings
and is under the ownership of one manager.
6. City Plan Description, hereinafter abbreviated as KRK, is
information about building and environmental planning
provisions imposed by the regency/city government at a
particular location.
7. Basic Building Coefficient, hereinafter abbreviated as
KDB, is a percentage number based on the ratio between
the area of the entire ground floor of a Building to the area
of land mapping or planning area in accordance with
KRK.
8. Communities are individuals, groups, legal entities or
businesses, and institutions or organizations that

activities in the field of Building, as well as customary law


communities and expert communities, who have an interest
in the Implementation of Building.
9. Building Approval, hereinafter abbreviated as PBG, is a
license given to the Building owner to build new, change,
expand, reduce, and/or maintain the Building in
accordance with Building technical standards.
10. Building Function Certificate, hereinafter abbreviated as
SLF, is a certificate given by the Local Government to
certify the feasibility of the Building function before it can
be utilized.
11. Preservation is an activity of care, restoration, and
Maintenance of Building and its environment to restore the
reliability of the building in accordance with the original
or in accordance with the state according to the desired
period.
12. Demolition is the activity of dismantling or demolishing
all or part of the Building, components, building materials,
and/or infrastructure and facilities.
13. Maintenance is an activity to maintain the reliability of the
Building and its infrastructure and facilities so that they
are always fit for function.
14. Community Green Housing Work Plan, hereinafter
referred to as H2M Work Plan, is a plan document for the
fulfillment of BGH Technical Standards in H2M.
15. Building Owner, hereinafter referred to as Owner, is a
person, legal entity, group of persons, or association,
which is legally recognized as Building Owner.
16. Applicant is the Building Owner or authorized to apply for
the issuance of PBG, SLF, RTB, and/or SBKBG.

17. Data collection is the activity of collecting data on a


Building by the Central Government or Local Government
which is carried out simultaneously with the PBG process,
SLF process, and Building Demolition, as well as
recording and registering existing Building.
18. Manager is an organizational unit, or business entity that is
responsible for Building operational activities,
implementation of operations and maintenance in
accordance with established procedures efficiently and
effectively.
19. BGH Technical Standards are criteria that must be met to
realize BGH performance at the programming, technical
planning, construction, utilization, and demolition stages.
20. Building User, hereinafter referred to as User, is the
Owner and/or non-owner based on an agreement with the
Owner, who uses and/or manages the Building or part of
the Building in accordance with the specified function.
21. Visitors are all people other than Users who have activities
in the Building.
22. Construction Service Provider is a provider of construction
services.
23. Building Implementation is a development activity that
includes technical planning and construction
implementation, as well as utilization, preservation, and
demolition activities.
24. Implementation of BGH is a development activity that
includes technical planning and construction
implementation, as well as utilization, preservation, and
demolition activities that meet Building Technical Standards
and have significant measurable performance in saving
energy, water, and other resources.

through the application of BGH principles in accordance


with the functions and classifications in each stage of its
implementation.
25. Maintenance is the activity of repairing and/or replacing
parts of the Building, components, building materials,
and/or infrastructure and facilities so that the Building
remains fit for function.
26. Building infrastructure and facilities are facilities inside
and outside the Building that support the fulfillment of
Building functions.
27. Professional Expert Team, hereinafter abbreviated as TPA, is
a team consisting of Professional Experts appointed by the
Regency / City Government to provide technical
considerations in the implementation of Building.
28. Customization is an effort to adjust the performance of a
Building that has been utilized to meet the requirements of
BGH.
29. The Construction Safety Management System, hereinafter
abbreviated as SMKK, is part of the construction work
implementation management system in order to ensure the
realization of construction safety.
30. Building Management Information System, hereinafter
abbreviated as SIMBG, is a web-based electronic system
used to carry out the process of implementing PBG, SLF,
SBKBG, RTB, and Building Data Collection accompanied
by information related to the implementation of Building.
31. Standard Operating Procedure, hereinafter abbreviated as
SOP, is a series of standardized written instructions
regarding various processes of organizing organizational
activities, how and when to do, where and by whom to do.
32. Building Technical Standard, hereinafter referred to as
Technical Standard, is a reference that contains provisions,
criteria, quality, methods, and/or procedures.

which must be fulfilled in the process of Building


Implementation in accordance with the function and
classification of Building.
33. The Programming stage is the initial planning process of
the BGH to establish goals, strategies, actions to be taken,
timelines, resource requirements, especially funding and
stakeholder involvement to ensure the desired performance
of the BGH is met.
34. The Technical Planning Stage is the stage of the process of
making technical plans for BGH and its completeness,
including the pre-planning stage, plan development and
preparation of working drawings, cost budget plans,
calculations and technical specifications.
35. The Construction Implementation Stage is the stage of a
series of implementation activities to realize the physical
BGH that has been determined in the technical planning
stage.
36. The Utilization Stage is the stage of activities to utilize
BGH in accordance with the functions and classifications
that have been determined, including maintenance, care,
and periodic inspection activities in accordance with BGH
requirements.
37. The Central Government is the President of the Republic of
Indonesia who holds the power of government of the
Republic of Indonesia assisted by the Vice President and
ministers as referred to in the 1945 Constitution of the
Republic of Indonesia.
38. Regional Government is the regional head as an element of
regional government organizers who lead the
implementation of government affairs which are the
authority of autonomous regions.
39. Minister is the minister who organizes government affairs
in the field of public works and public housing.

CHAPTER II
ORDER OF FULFILLMENT OF BGH TECHNICAL STANDARDS

General Part One

Article 2
(1) The order of fulfillment of BGH Technical Standards
consists of:
a. Building Building new with category
(mandatory);
b. New building with recommended category;
c. Existing buildings are categorized as mandatory;
d. Building Building which already existing
recommended category;
e. H2M with recommended category;
f. Green Area with the recommended category;
and
g. Existing Green Area with recommended category;
(2) New Building with mandatory category as referred to in
paragraph (1) letter a and existing Building with mandatory
category as referred to in paragraph (1) letter c include:
a. Class 4 (four) and 5 (five) Building above 4 (four)
floors with an area of at least 50,000 m2 (fifty thousand
square meters);
b. Class 6 (six), 7 (seven), and 8 (eight) Building above 4
(four) floors with a floor area of at least 5,000 m2 (five
thousand square meters);
c. Class 9a building with an area above 20,000 m2 (twenty
thousand square meters); and
d. Class 9b Building with an area above 10,000 m2 (ten
thousand square meters).

(3) New Building with recommended category as referred to in


paragraph (1) letter b and existing Building with
recommended category as referred to in paragraph (1)
letter d include Building other than Building as referred in
paragraph (2).

Article 3
BGH principles include:
a. formulation of common goals, understanding and action
plans;
b. reduce the use of resources, whether in the form of land,
materials, water, natural resources or human resources
(reduce);
c. reduction of waste generation, both physical and non-
physical;
d. reuse of previously used resources;
e. use of recycled resources;
f. protection and management of the
environment through conservation efforts;
g. mitigation of safety, health, climate change and disaster
risks;
h. life cycle orientation;
i. orientation towards achieving the desired quality;
j. technological innovation for continuous improvement; and
k. upgrade support institutional support,
leadership and management in implementation.

Article 4
(1) BGH must meet the Technical Standards which consist :
a. Building planning and design standards;
b. Building construction implementation and
supervision standards;

c. Building utilization standards; and


d. Building Demolition standard.
(2) In addition to the Technical Standards as referred to in
paragraph
(1) BGH must meet the BGH Technical Standards at every
stage of the organization including:
a. programming;
b. technical planning;
c. construction implementation;
d. utilization; and
e. Demolition.
(3) BGH is organized by:
a. Central Government for state-owned BGH, or
Regional Government for regionally-owned BGH;
b. Owner BGH who incorporated legal entity or
individual;
c. Users and/or managers of BGH who are legal entities
or individuals; and
d. Provider Services who competent
at Building field.
(4) In the implementation of BGH, the service provider as
referred to in paragraph (3) letter d involves BGH Experts.
(5) BGH experts as referred to in paragraph (4) are experts who
have a BGH Work Competency Certificate (SKK) in
accordance with the provisions of laws and regulations, or
experts in the field of building construction who have
received a certificate of BGH performance assessment
training.
(6) During the transitional period, the Minister shall determine
the trainers of the BGH performance assessment training
certification as referred to in paragraph (5), which shall then
serve as the basis for the issuance of the BGH SKK for the
trainers for the first time.

Second Part
BGH Implementation Stage for New Buildings

Article 5
The implementation stage as referred to in Article 4 paragraph (2)
for new Building includes stages:
a. programming;
b. technical planning;
c. construction implementation;
d. utilization; and
e. Demolition.

Article 6
BGH programming stage as referred to in Article
5 letter a must be done from the beginning by considering the
availability and sustainability of resource fulfillment.

Article 7
(1) Implementation Stage Programming
BGH as referred to in Article 6 include:
a. identification stakeholders kepentingan who are
involved in the organization of BGH;
b. determination conception early and
methodology for organizing BGH;
c. preparation of studies on the feasibility of organizing
BGH from technical, economic, social, and
environmental perspectives;
d. establishing criteria for competent service providers;
e. preparation of BGH programming documents;
f. implementation of programming at all stages;
g. risk management; and
h. drafting report final report Stage
BGH Programming.
(2) Provisions at the BGH Programming Stage as referred to in
Article 6 include:
a. site suitability;

b. determination Object Building Building


that will be designated as BGH;
c. BGH performance according to the level of need;
d. method of organizing BGH; and
e. BGH eligibility.
(3) Site suitability as referred to in paragraph (2) letter a is
intended to avoid the construction of BGHs on
inappropriate sites and reduce environmental impacts in
accordance with the provisions of district/city spatial
planning and building codes.
(4) Determination of Building object that will be determined
as BGH as referred to in paragraph (2) letter b must have
been determined in the general plan or master plan of
Building development determined by the Owner.
(5) Determination of the level of performance achievement of
BGH in accordance with the needs as referred to in
paragraph (2) letter c is intended to set measurable and
realistic/reasonable performance achievement targets as
BGH.
(6) Determination of the method of organizing BGH as referred
to in paragraph (2) letter d must be adjusted to the target of
achieving BGH performance and the ability of available
resources.
(7) The assessment of the feasibility of BGH as referred to in
paragraph (2) letter e is intended to reconfirm the fulfillment
of the suitability of programming requirements for the BGH
development plan.

Article 8
(1) The provisions of the BGH Technical Planning Stage as
referred to in Article 5 letter b consist of:
a. site management;
b. energy use efficiency;
c. water use efficiency;
d. air quality;
e. use of environmentally friendly materials;
f. waste management; and

g. wastewater management

Article 9
(1) The provisions of the BGH Construction Implementation
Stage as referred to in Article 5 letter c are a confirmation
of the fulfillment of the provisions at the Technical
Planning Stage as referred to in Article 5 letter b on
Buildings that have been built and have obtained PBG.
(2) The implementation of BGH construction as referred to in
paragraph (1) is carried out with the principle of green
construction implementation.
(3) The principles of implementing green construction as
referred to in paragraph (2) include:
a. green construction process;
b. green behavioral practices; and
c. green supply chain.

Article 10
(1) Provisions for the BGH Utilization Stage as referred to in
Article 5 letter d in the form of implementing utilization
management include:
a. preparation of SOP for BGH utilization;
b. implementation of the SOP for BGH utilization; and
c. maintenance of BGH performance during the
utilization period.
(2) In the case of an existing Building that does not yet have a
BGH Certificate at the Technical Planning Stage and the
BGH Construction Implementation Stage, the provisions
referred to in paragraph (1) letter b do not apply.
(3) In the case of an existing Building that has never had a
BGH Certificate at the Technical Planning Stage and the
BGH Construction Implementation Stage, the provisions
of the BGH Utilization Stage as intended in paragraph (1)
are added to the provisions of BGH performance for
existing Buildings during the utilization period.

Article 11
The provisions of the BGH Demolition stage as in Article 5 letter
e include:
a. Dismantling methods are carried out by not causing
damage to materials that can be reused; and
b. efforts to improve the quality of the site after Demolition.

Third Part
Stage of BGH Implementation for Existing Buildings

Article 12
(1) The implementation stage as referred to in Article 4
paragraph (2) for existing Building includes stages:
a. utilization; and
b. Demolition.
(2) The implementation of BGH in existing buildings that have
never had a BGH Certificate at the Technical Planning Stage
and the BGH Construction Implementation Stage is carried
out by following:
a. the principle of adaptation; and
b. application of adaptation.
(3) The principle of adaptation as referred to in paragraph (2)
letter a in the existing Building includes:
a. fulfillment of the proper function and provisions of
the Building;
b. consideration of operational costs of utilization and
calculation of the rate of return received on savings;
and
c. significant achievement of measurable performance
targets as a BGH.
(4) The application of adaptation as referred to in paragraph
(2) letter b is an effective method used for

applying the principle of adaptation to existing buildings.


(5) The application of adaptation as referred to in paragraph
(2) letter b is carried out on:
a. An existing building, but without changes or
additions to the function and without the addition of
new parts;
b. Existing buildings with changes or additions to
functions that can result in the addition of new parts;
and
c. Preserved cultural heritage buildings.
(6) The implementation of BGH adaptation in Building as
referred to in paragraph (5) letter a is carried out in stages
and/or partially in accordance with BGH Technical
Standards through Retrofitting.
(7) The application of BGH adaptation in Building as referred
to in paragraph (5) letter b is aimed at:
a. Existing buildings are carried out in stages and / or
partially in accordance with the provisions of laws
and regulations; and
b. Additional building in accordance with the provisions
of laws and regulations
(8) The implementation of BGH adaptation in Building as
referred to in paragraph (5) letter c is carried out gradually
and/or partially in accordance with the provisions of BGH
Technical Standards through Retrofitting and Preservation
provisions.

Fourth Part
BGH Implementation Stage for H2M

Article 13
(1) A collection of dwellings can organize a BGH through the
H2M mechanism.

(2) H2M as referred to in paragraph (1) is organized collectively


on the joint initiative of the Community.

Article 14
(1) The implementation of H2M as referred to in Article 13
paragraph (2) is carried out by the Community with the
assistance of district / city Regional Government assistance
by meeting performance indicators.
(2) Implementation of H2M as referred to in paragraph
(1) includes:
a. preparation of the H2M Work Plan document;
b. construction implementation;
c. utilization; and
d. Demolition.
(3) The implementation of H2M is outlined in the H2M Work
Plan document.
(4) The H2M Work Plan consists of a program with the
community and a program to guide community members
in meeting BGH Technical Standards.
(5) H2M performance indicators as referred to in paragraph (1)
can be:
a. reduction in energy consumption by an average of
25% (twenty-five percent);
b. reduction in water consumption by an average of 10%
(ten percent);
c. independent waste management;
d. use of local and environmentally friendly building
materials; and
e. optimization function space open space
green space.
(6) H2M performance indicators as referred to in paragraph
(1) implemented with methods and technologies that
prioritize functional feasibility, affordability, and
measurable performance.

Fifth Section
Stage of BGH Implementation for Green Areas

Article 15
(1) The implementation of Green Areas can be carried out based
on the scope of one overlay area with residential, business,
socio-cultural, religious, special or mixed functions.
(2) The Green Area Order consists of:
a. New Green Areas; and
b. Existing Green Areas.
(3) The implementation of new Green Areas as referred to in
paragraph (2) letter a includes stages:
a. technical planning;
b. construction implementation;
c. utilization; and
d. Demolition.
(4) Implementation of existing Green Areas as referred to in
paragraph (2) letter b includes stages:
a. utilization; and
b. Demolition.
(5) Green Area assessment requirements as referred to in
paragraph (1) consist of:
a. residential area of at least 1 (one) hectare or 10,000 m2

(ten thousand square meters);


b. there are at least 2 (two) buildings; and
c. the entire expanse is owned by 1 (one) manager.

CHAPTER III
BGH PERFORMANCE APPRAISAL PROCEDURE

General Part One

Article 16
(1) BGH performance assessment is carried out by conducting
a quantitative assessment of the fulfillment of Technical
Standards

BGH as per with parameters and criteria set.


(2) BGH performance assessment as referred to in paragraph
(1) is carried out against:
a. Building Building new with category
(mandatory);
b. New building with recommended category;
c. Existing buildings are categorized as mandatory;
d. Building Building which already existing
recommended category;
e. H2M with recommended category;
f. New Green Areas with recommended category; and
g. Existing Green Area with recommended category;

Article 17
BGH performance assessment for new buildings with
mandatory category as referred to in Article 16 paragraph (2)
letter a, and new buildings with recommended category as
referred to in Article 16 paragraph (2) letter b, is carried out at
the stage:
a. technical planning;
b. construction implementation;
c. utilization; and
d. Demolition.

Article 18
(1) BGH performance assessment for existing Building with
mandatory category as referred to in Article 16 paragraph
(2) letter c, and existing Building with recommended
category as referred to in Article 16 paragraph (2) letter d,
is carried out at the stage:
a. utilization; and
b. Demolition.

(2) The Utilization Stage BGH performance assessment as


referred to in paragraph (1) letter a includes technical
planning for retrofitting, and construction of retrofitting.

Article 19
BGH performance assessment for H2M as referred to in Article
16 paragraph (2) letter e is carried out at the stage:
a. preparation of the H2M Work Plan document;
b. H2M construction implementation;
c. utilization of H2M; and
d. H2M Disassembly.

Article 20
(1) BGH performance assessment for new Green Areas as
referred to in Article 16 paragraph (2) letter f is carried out at
the stage:
a. technical planning of Green Areas;
b. implementation of Green Area construction;
c. utilization of Green Areas; and
d. Demolition of Green Areas.
(2) Assessment of BGH performance for existing Green Areas
as referred to in Article 16 paragraph (2) letter g is carried
out at the stage:
a. utilization of Green Areas; and
b. Demolition of Green Areas.

Second Part
BGH Performance Assessment for New Buildings

Paragraph 1
Technical Planning Stage Performance Assessment

Article 21
(1) Technical Planning Stage performance assessment as
referred to in Article 17 letter a consists of parameters:
a. site management;

b. energy use efficiency;


c. water use efficiency;
d. air quality;
e. use of environmentally friendly materials;
f. waste management; and
g. wastewater management.
(2) Parameters management site as referred
to in paragraph (1) letter a consists of criteria:
a. Building orientation;
b. processing site including accessibility or
circulation;
c. management land contaminated land waste
hazardous and toxic materials (B3);
d. private green open space;
e. provision of pedestrian paths;
f. management of the basement footprint;
g. parking lot provision;
h. outdoor lighting systems; and
i. Building construction on and/or in land and/or
water and/or public infrastructure or facilities.
(3) Energy use efficiency parameter as referred to in
paragraph (1) letter b consists of criteria:
a. building envelope;
b. ventilation system;
c. air conditioning system;
d. lighting system;
e. transportation system in the building;
f. energy efficiency calculations; and
g. electrical system.
(4) Parameters efficiency Usage water as referred to
in paragraph (1) letter c consists of criteria:
a. water source;
b. water usage; and
c. use of water-saving sanitary appliances (water
fixtures).

(5) Indoor air quality parameters as referred to in paragraph


(1) letter d consist of criteria:
a. smoking ban;
b. control of carbon dioxide (CO2) and carbon monoxide
(CO); and
c. control of refrigerant usage.
(6) The parameters for the use of environmentally friendly
materials as referred to in paragraph (1) letter e consist of
criteria:
a. control of the use of hazardous materials; and
b. use of eco-labelled certified materials.
(7) The waste management parameters as referred to in
paragraph 1 letter f consist of criteria:
a. application of the 3R principle (reduce, reuse, recycle);
b. implementation of a waste handling system; and
c. implementation of a waste generation recording
system.
(8) Environmentally friendly wastewater management
parameters as referred to in paragraph (1) letter g consist
of criteria:
a. provision of wastewater management facilities prior
to discharge into municipal sewers; and
b. recycling of water derived from domestic wastewater.

Article 22
(1) Performance assessment of the Construction
Implementation Stage as referred to in Article 17 letter b

a. suitability of BGH construction implementation
performance;

(1) The demolition of BGH as referred to in Article 17 letter d
is carried out through a deconstruction approach.
(2) The deconstruction approach as referred to in paragraph
(1) is carried out by breaking down building components
with the aim of minimizing construction waste and
increasing the use value of materials.

Demolition as referred to in Article 17

BGH Performance Assessment for H2M Buildings

Paragraph 1
Community Green Housing Performance Assessment

Article 27
(1) H2M Work Plan document preparation stage as referred to in
Article 19 letter a, H2M construction implementation stage
as referred to in Article 19 letter b, H2M utilization stage as
referred to in Article 19 letter c, and H2M Demolition stage
as referred to in Article 19 letter d are contained in the
performance assessment parameters.
(2) H2M performance assessment can be done based on the
scope of the administrative area or the scope of the
neighborhood.
(3) The scope of the administrative area as referred to in
paragraph (1) has an assessable residential area of at least
1 hectare (one acre) or 10,000 m2 (ten thousand square
meters).
(4) The minimum number of dwellings that can be assessed
based on the administrative area consists of:
a. 10 (ten) dwellings for RT administrative unit;
b. 100 (one hundred) dwellings for RW administrative
unit; and
c. 1,000 (one thousand) dwellings for urban village units.

(5) The scope of the residential neighborhood (neighborhood) as


referred to in paragraph (1) has characteristics including:
a. Residential neighborhoods consist of several groups of
houses;
b. group of houses consists of several blocks of houses;
c. Neighborhood units may fall within one administrative
area or several administrative areas.
d. appropriate pattern of location of residential
neighborhood facilities.
(6) The minimum number of houses that can be assessed by
neighborhood consists :
a. 30 (thirty) dwellings for a housing block neighborhood
unit;
b. 40 () dwellings for a residential neighborhood unit;
c. 100 (one hundred) occupancy for
unit residential neighborhood; and
d. 300 (three hundred) dwellings for a residential
neighborhood unit.

Article 28
(1) The preparation of the H2M Work Plan document as
referred to in Article 19 letter a consists of criteria:
a. reduction in energy consumption;
b. reduction in water consumption;
c. independent waste management;
d. use of local and environmentally friendly building
materials;
e. optimization of the function of yard and
environmental green open space; and
f. site management.
(2) Performance indicators The community members of the
H2M group must collectively strive to reduce the use of
energy consumption as referred to in paragraph (1) letter a
by at least 25% (two percent).

fifty-five percent) of the previous average energy


consumption usage monitored monthly.
(3) Performance indicators The community members of the
H2M group must collectively strive to reduce the use of
water consumption as referred to in paragraph (1) letter b
by at least 10% (ten percent) of the previous average

(4) Performance indicators The community members of the
H2M group must collectively strive to reduce their waste
management waste generation independently as referred to in
paragraph (1) letter c, such as sorting waste starting from
their respective home environments, among others by
making efforts to recycle waste, participating in the waste
bank program, optimizing the use of used goods that can be
reused, and making compost or carrying out the 3R principle
(Reduce, Reuse, Recycle).
(5) Performance indicators The community members of the
H2M group must make the most of every green open space
in the yard as referred to in paragraph (1) letter e both in
the yard of their respective homes and open space in the
street environment or community social facilities in their
neighborhood as green open space both horizontally and
vertically.
(6) Optimizing the function of yard and environmental green
open space as referred to in paragraph (1) letter e consists
of yard and environmental green open space, planting
greening vegetation, and planting consumption crop land.
(7) Site management as referred to in paragraph (1) letter f
consists of processing residential sites and residential
environments as well as the existence of sharing roads in
residential environments.
(8) The H2M construction implementation stage as referred to
in Article 19 letter b consists of criteria:

a. suitability of construction implementation performance;


b. green construction process; and
c. green supply chain.
(9) The suitability of construction implementation
performance as referred to in paragraph (8) letter a is a
confirmation of the achievement of the results of the
assessment of the suitability of the criteria for reducing
energy consumption, reducing water consumption, waste
management, using local and environmentally friendly
building materials, optimizing yard and environmental
green open space, and site management for the
implementation of construction.
(10) Green construction process as referred to in paragraph
(8) letter b regulates the application of construction waste
management and water conservation in the implementation
of construction on environmental facilities.
(11) The green supply chain as referred to in paragraph (8)
letter c regulates the use of construction materials and the
selection of material and/or tool suppliers in the
construction of environmental facilities.
(12) The stage of utilization of H2M as referred to in Article 19
letter c with criteria namely organization and governance
of green environment, the performance assessment
consists of:
a. community adherence to green norms; and
b. environmental conservation procedures.
(13) Community adherence to green norms as referred to in
paragraph (12) letter a is assessed from the existence of
norms and customs that protect the preservation of nature
and natural resources and institutions that maintain and
manage the protection of biodiversity.
(14) The procedure for environmental preservation as referred
to in paragraph (12) letter b is realized by the ownership of
documents on the realization of green environmental
management, documents on efforts to save water use and
utilization of rainwater/surface water, documents on
efforts to save energy and use renewable energy,
documents on efforts to improve the environment,

documents on waste management measures, and


documents on communal waste management measures.
(15) H2M Dismantling Stage as referred to in Article 19 letter d
consists of criteria:
a. demolition material management; and
b. environmental footprint restoration.
(16) The management of demolition materials as referred to in
paragraph (15) letter a requires the availability of locations
for the collection, sorting, and disposal of demolition
materials.
(17) Environmental site restoration as referred to in paragraph
(15) letter b ensures that there are efforts to restore the
environmental site after Demolition.

Fifth Section
Performance Assessment for New Green Areas

Article 29
(1) The Green Area Technical Planning stage as referred to in
Article 20 paragraph (1) letter a, the Green Area construction
implementation stage as referred to in Article 20 paragraph
(1) letter b, the Green Area utilization stage as referred to in
Article 20 paragraph (1) letter c, and the Green Area
Demolition stage as referred to in Article 20 paragraph (1)
letter d are contained in the performance assessment
parameters.
(2) Green Area technical planning as referred to in Article 20
paragraph (1) letter a consists of Green Area performance
indicator criteria in the form of:
a. improving the welfare of the local population;
b. improvement of service functions of infrastructure
and facilities in the area;
c. microclimate control and ecosystem preservation within
the area;

d. reduction of thermal impact on other areas in the dry


season;
e. reduction in the burden of infrastructure and facilities;
and
f. use of environmentally friendly materials.
(3) The Green Area Construction Implementation Stage as

performance;
b. green construction process; and
c. green supply chain.
(4) The suitability of construction implementation
performance as referred to in paragraph (3) letter a consists

green area construction work; and

(2) Green Area Utilization Stage as referred to in Article 20
paragraph (2) letter a consists of Green Area performance
indicator criteria in the form of:

CHAPTER IV BGH RATING


AND CERTIFICATION

Section One BGH


Ranking

Article 31
(1) The ranking of BGH is carried out based on the Order of
BGH as referred to in Article 2 paragraph (1) and the stages
of organizing BGH as referred to in Article 4 paragraph (2).
(2) BGH ranking as referred to in paragraph (1) shall be the
basis for issuance of BGH Certificate.
(3) The ranking of BGH as referred to in paragraph (2) is carried
out to determine the ranking of BGH consisting of:
a. BGH Pratama;
b. Intermediate BGH; and
c. Main BGH
(4) The BGH rating as referred to in paragraph (3) is based on
the fulfillment of the performance assessment achievement
value.

Second Section BGH


Certification

Article 32
(1) BGH certification is given to orderly development and
encourage the implementation of buildings that have
significant measurable performance, are efficient, safe,
healthy, easy, comfortable, environmentally friendly, save
energy and water, and other resources.

(2) The Owner or Manager submits output documents at each


stage of BGH implementation to the Regency / City
Government in obtaining a BGH Certificate as referred to in
Article 31 paragraph (2) in accordance with the BGH ranking
criteria.
(3) The output documents as referred to in paragraph (2) are in
accordance with statutory provisions.
(4) The BGH Certificate as referred to in paragraph (2) may be
in the form of a Certificate of technical planning,
construction implementation, and/or utilization.
(5) In the event that the Building is included in the BGH Order
of new Building with mandatory category, the BGH
certificate as referred to in paragraph (4) must be owned at
the Technical Planning Stage, Construction
Implementation Stage, and Utilization Stage.
(6) In the event that the Building is included in the existing
Building BGH Order with a mandatory category, the BGH
certificate as referred to in paragraph (4) must be owned at
the Utilization Stage.
(7) BGH certification for H2M is given at the stage of
preparing the H2M Work Plan document, the H2M
Construction Implementation Stage, and/or the H2M
Utilization Stage.
(8) BGH certification for new Green Areas is given at the
Green Area Technical Planning Stage, Green Area
Construction Implementation Stage, and/or Green Area
Utilization Stage.
(9) BGH certification for existing Green Areas is granted at
the Green Area Utilization Stage.

Article 33
(1) The BGH performance assessment process is conducted
by the service provider using the BGH performance
assessment checklist.
(2) Register see assessment performance BGH as
referred to in paragraph (1) is uploaded into SIMBG.

(3) The list of BGH performance assessment similes that have


been uploaded as referred to in paragraph (2) along with
the evidentiary documents are verified by the district/city
TPA.
(4) The verification process as referred to in paragraph (3) is
carried out by means of:
a. document check;
b. face-to-face; and/or
c. field observation.
(5) Based on the results of the verification as referred to in
paragraph (4) the district/city TPA and determine the BGH
ranking.
(6) The district/city TPA issues a recommendation to the head
of the district/city technical service based on the BGH
ranking that has been determined as referred to in
paragraph (5).
(7) The head of the district / city technical service issues a
Certificate based on the recommendation as referred to in
paragraph (6).
(8) Electronic issuance of BGH Certificates as referred to in
paragraph (7) is carried out through SIMBG free of charge.
(9) The process of issuing a BGH Certificate as referred to in
paragraph (8) is carried out in accordance with the
stipulated time period.
(10) The BGH Certificate as referred to in paragraph (7) may be
printed in an exclusive edition and/or may be made in the
form of a BGH Plaque.
(11) BGH Certificates in exclusive editions and BGH Plaques
as referred to in paragraph (10) are made by the head of
the district/city technical service at the request of the
Applicant.
(12) The cost of the BGH Certificate in the exclusive edition and
the BGH Plaque as referred to in paragraph (10) shall be
the responsibility of the applicant.
(13) The validity period of the BGH Certificate is the same
period as the SLF, which is for 5 (five) years.

Article 34
(1) Technical Planning Stage BGH certificates and plaques are
given to Building Owners or Managers who have PBG and
fulfill the provisions of BGH Technical Standards in
accordance with the established ranking criteria.
(2) BGH Certificates and plaques for Construction
Implementation Stage are given to Building Owners or
Managers who already have SLF and fulfill the provisions
of BGH Technical Standards in accordance with the
established ranking criteria.
(3) Utilization Stage BGH Certificates and Plaques are given
to Building Owners or Managers who have SLF extension
and meet the provisions of BGH Technical Standards in
accordance with the established ranking criteria.
(4) In the case of existing buildings that have never had a BGH
Certificate at the Technical Planning Stage and the
implementation of BGH construction, BGH certificates
and plaques at the Utilization Stage are given to Building
Owners or Managers who have SLF and meet the provisions
of BGH Technical Standards in accordance with the
established ranking criteria.

Third Section
BGH Incentives

Article 35
The owner and/or manager of BGH can obtain incentives from
the provincial government and regency/city government in
accordance with the provisions of laws and regulations.

CHAPTER V BGH
COACHING

General Part One

Article 36
(1) Guidance on the implementation of BGH is an integral
part of the guidance on the implementation of Building
that is carried out in accordance with the provisions of
laws and regulations.
(2) Guidance on the implementation of BGH as referred to in
paragraph 1 is carried out through activities:
a. setting;
b. empowerment; and
c. surveillance.
(3) Development activities for the implementation of BGH as
referred to in paragraph 2 are carried out so that BGH
development is carried out in accordance with the road map
for organizing BGH.
(4) The road map for the implementation of BGH as referred to
in paragraph (3) shall be stipulated by the Minister.

Second Section
Acceleration of BGH
Development

Article 37
To accelerate the process of fostering BGH as referred to in
Article 36, the Central Government in collaboration with BGH
organizers must make efforts:
a. capacity building for BGH guidance across provincial and
district/city governments, including issuing BGH Training
Certificates for state civil servants as organizers;
b. qualitative and quantitative capacity building of BGH
Experts with the issuance of SKK BGH;
c. BGH data collection.

Article 38
(1) Regulation as referred to in Article 36 Paragraph (2) letter a is
carried out by the Central Government with the preparation and
dissemination of national norms, standards, procedures and
performance assessment of BGH.
(2) Formulation and dissemination of norms, standards, procedures
and performance appraisal of BGH as referred to in paragraph
(1) can be done by considering the opinion of the provincial
Regional Government and/or regency/city Regional
Government as well as the Building organizer.
(3) The Central Government may provide technical assistance in
the preparation of regional policies in the field of BGH carried
out by provincial Regional Governments and district / city
Regional Governments.
(4) Dissemination of norms, standards, procedures and
performance assessment of BGH may be delegated to the
Regional Government.

Article 39
(1) Empowerment as referred to in Article 36 paragraph (2) letter b is
carried out to the Regional Government and BGH organizers.
(2) Empowerment to provincial and district / city Regional
Government officials and BGH organizers in the form of:
a. increasing awareness of rights, obligations and roles in the
process of BGH Implementation through socialization,
dissemination, piloting, and law enforcement including
providing incentives and disincentives; and
b. capacity building of local government officials and BGH
administrators through socialization, dissemination, and
training.

Article 40
(1) Supervision as referred to in Article 36 paragraph (2) letter c is
carried out through monitoring the implementation of the
application of laws and regulations in the field of BGH.

(2) The Central Government supervises the implementation of


BGH in provinces and regencies/cities by conducting
performance evaluations on technical substance in accordance
with the provisions of laws and regulations.
(3) If there are problems in implementing this government
regulation, the Regional Government can consult the Minister.

Article 41
(1) The Minister acts as the person in charge of organizing the BGH.
(2) The Minister assigns an organizational unit as the executor of
BGH development.
(3) BGH Development Executive as referred to in paragraph
(2) is authorized to accelerate institutional development in the
implementation of national BGH, for the following purposes:
a. accelerate the development of national BGH operations;
b. capacity building for BGH development in all provincial
Local Governments, and regency/city Local Governments,
including in issuing BGH training certificates for state civil
apparatus and construction workers with expert qualifications
as BGH organizers;

CHAPTER VI
CLOSING PROVISIONS

Article 43
When this Ministerial Regulation comes into force, Minister of
Public Works and Public Housing Regulation Number
02/PRT/M/2015 on Green Building (State Gazette of the
Republic of Indonesia Year 2015 Number 309), is revoked and
declared invalid.

Article 44
This Ministerial Regulation shall come into force on the date of
promulgation.
