AFFIDAVIT OF CONTEST/PROTEST
I, _______________, of legal age, Filipino citizen, with residence and postal
address at ___________________________, after having been sworn to in
accordance with law, hereby depose and state that:
1. On September 2, 2024, I have received an email from [email protected]
containing 2 attached documents named Notice of Traffic Apprehension and
Temporary Operator’s Permit;
2. On the said documents, it alleged that I have committed a violation of
non-wearing of helmet last August 30, 2024, at 16:30 with the following
details:

3. The details of the apprehending officer was listed as:

4. I immediately checked the LTO Portal to check whether the said


documents sent were authentic;

5. Upon checking the portal, the said documents were uploaded in the
undersigned’s profile and was listed under the tab “Violations”;
6. I am contesting the validity of the citations of the above-mentioned
apprehending officer. Below are the true circumstances when the citations
mentioned occurred:
a. I was at ___________ on August 30, 2024 from 13:03 to 17:36;
b. The said apprehension was made on August 30, 2024 at 16:30 in
affiliation to Mamburao Extension Office, which is in Occidental
Mindoro;
c. I have never been to Occidental Mindoro;
d. I have never driven the motorcycle listed above, nor I am in any
way related or acquainted to the owner of the motorcycle listed above.
e. It is physically impossible for me to have committed the alleged
violation, as during the same day the alleged violation was committed,
I was driving my own motorcycle vehicle to and from work within
Manila City with details:

f. To the best of my knowledge and recollection, I was never


apprehended for any traffic violation at that date and time, in fact, I
am in possession of my Driver’s License, nor was there a time that I
lost possession to it due to apprehension.

7. To attest the truthfulness of the above-mentioned circumstances, I have


attached the following proof:

a. A copy of the Notice of Traffic Apprehension and the Temporary


Operator’s Permit
b. Screenshots of the email received and of my LTO Portal containing
details of the violation.
c. A copy of my Driver’s License
d. A copy of the OR/CR of the vehicle that I actually drove that day.
e. A copy of the logbook kept by the security guard in _________
showing my attendance for August 30, 2024.

8. I am executing this affidavit to protest and contest the validity of the


violations alleged in the Notice of Apprehension and Temporary Operators’
Permit received.

9. This affidavit is executed to attest the truthfulness of the foregoing facts


and for all intents and legal purposes it may serve.
