SUBJECT: RESOLUTION DATED MARCH 04, 2025 OF THE
COURT EN BANC IN A.M. NO. 10-4-1-SC '(RE: 2022
INTERIM AMENDMENTS TO THE 2010 RULES OF
PROCEDURE FOR MUNICIPAL ELECTION CONTESTS)
For the information, guidance, and strict observance of all concerned, is
the Resolution dated March 04, 2025 of the Court en bane in A.M. No. 10-4-1-
SC, which RESOLVED to:
(a) NOTE the comments and observations of OCA in
relation to the 2022 Interim Amendments to the 2010 Rules of
Procedure for Municipal Election Contests; and
(b) AMEND the following provisions of the 2022
Interim Amendments to the 2010 Rules of Procedure for Municipal
Election Contests, to read as follows:
RULE 1
SCOPE
Section 1. Application of the 2022 Interim
Amendments. - The 2022 Interim Amendments to the
2010 Rules of Procedure for Municipal Election
Contests shall apply to all municipal election contests in
connection with the May 9, 2022 National and Local
Elections and to all subsequent elections, unless the
Court approves or promulgates new Rules or further
amends the herein Interim Amendments.
RULE 10
REVISION OF BALLOTS
Section 8. Conduct of Revision. - The revision of
the votes on the ballots shall be done manually and
visually and through the use of appropriate VCMs.'
according to the procedure below:
(h) In looking at the shades or marks used to register
votes, the revision committee shall bear in mind that the
will of the voters reflected as votes in the ballots shall as
much as possible be given effect, setting technicalities
aside. Furthermore, the votes are presumed to have been
made by the voter and shall be so considered unless
reasons exist to justify their rejection. However, marks
or shades that are less than fifteen percent (15%) of the
oval, based primarily on the reading of the Precinct
Optical Scan or VCM, taking into account its
technical limitations as may be applicable, and on
visual examination, shall not be considered as valid
votes, unless circumstances show otherwise.
