AGREEMENT FOR LEAVE AND LICENSE
THIS AGREEMENT made this XXXXXXXXXXX
BETWEEN
Mrs. XXXXXXXXXXX, W/o. Malay Kumar Biswas, Aadhar
No. XXXXXXXXXXXXXXby faith & religion XXXXXX, by
occupation – House Wife, by nationality – Indian, resident
of XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
hereinafter called and referred as the “LICENSOR”
(which expression shall unless excluded by or repugnant
to the context be deemed to mean and included his/her
heirs, executors, administrators, representatives and
assigns) of the FIRST PART.

XXXXXXXXXXX, s/o. XXXXXXXXXXXX, Aadhar No.
XXXXXXXXXXXX, by faith Hindu, by nationality Indian, by
occupation Business, resident of XXXXXXXXXXXXXXXXXXXX
hereinafter called the “LICENSEE” (which terms or
expression shall unless excluded by or repugnant to the
context be deemed to mean and include his/her heirs,
executors, administrators, representatives and assigns) of
the OTHER PART;
WHEREAS the FIRST PART is the co-owner of the SHOP , on
the Ground floor measuring about 240 Sq. ft. Carpet area,
at premises XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX.
AND WHEREAS The ”LICENSOR” being approached by the
Licensee and express his willingness to provide a SHOP to
the Licensee for purely xxxxxxxxxxxxx from
xxxxxxxxxxxxxxxxx exclusive for a period of 11 (eleven)
months, at the aforesaid shop lying vacant.
AND WHEREAS the Licensee hereto being in need of a SHOP
for SHOP purpose and on his request, the licensor has
agreed to grant “LEAVE AND LICENSE” in the said SHOP
effective from xxxxxxxxxxxxx under the following terms
and conditions to avoid future dispute and differences by
and between the parties:-
1. That the monthly license fee for the said SHOP is Rs.
xxxxxxxxxxxxxxxxxxx only, the licensee will pay
within 7th. Day of each & every English Calendar month
in advance.
2. That in addition to the first month license fee, the
Licensee shall pay further a sum of Rs.
Xxxxxxxxxxxxxxxxx only as Security Deposit in
advance, which will be returned by the First Party to
the Second Party at the time of Surrender of the Shop

in vacant or good condition before or expiry of the said
licensed period. This will not carry any interest. In case
of any damage, the Licensee is liable to pay the
demurrage charge which will be deducted from the
Security Deposit.
3. The Licensee shall pay the Electric Charges as per
meter reading installed in the said shop room and the
Licensee shall return the paid electric bill after
payment of due amount to the Licensor.
4. That if either the Licensee or Licensor want to vacate
the Licensed portion before the stipulated period, in
that case they will inform the other part at least 1
month before the vacation of the Licensed portion.
However in case of delay of payment of the Licensed
fee, the Licensee may be asked to vacate the said
premises at any date before the date of expiry without
any notice period.
5. That the Licensee shall liable to pay maintenance
charges per month as settled by the Building
Authority.
6. That at any point of time the shop will not be used for
any business related to Call Centre.
7. That the Licensee shall liable to maintain all necessary
license from appropriate authority for running the
business mentioned herein before.
8. That the Licensee shall be responsible for maintaining
the SHOP in good condition as in all respect as
possible except the natural wear and tear.

9. That the Licensee will always allow the Licensor or his
authorized agent to inspect the Licensed premises at
any time in presence of Licensee.
10. That the Licensee shall carry out all day to day
repair and maintenance of the Licensed premises and
shall be responsible for all repairs of the SHOP to keep
and handover in good condition in all respect.
11. That the Licensee shall not assign or transfer any
part or portion thereof.
12. That the Licensee shall not indulge in illegal or
immoral activities nor will be keeping any inflammable
articles in the said SHOP. The Licensed shall be solely
responsible for the safety of the shop and the
premises.
13. That after expiry of this agreement, the period of
License will be extended on discussion between
Licensor and Licensee and on confirmation a new
agreement will be executed and License fee will be
enhanced by 5%.
14. That the Licensee shall not make any additions
and alterations of the Licensed premises without any
written permission from the Licensor.
15. That the Licensee shall be liable to vacate the
said shop after expiry of this agreement in favour of
the Licensor.
16. That the Licensee shall not harbor any political
offender or antisocial elements to the said SHOP or
anywhere of the building.

17. That the Licensee shall maintain good relation
with the neighbouring shop owners.
18. The Licensee shall use the common bath room
with other shop owners of the premises.
19. On breach of any of the terms of this agreement
the Licensor shall be entitled to terminate this license
on giving seven days notice and on expiry of the said
notice period the licensor may exercise her absolute
right of re-entering in to the said premises by
dispossessing of the licenses therefrom.
