The tenets of the religion of sharing and caring each other, tolerance, non- violence, peace,
meditation, etc attracted people of different faiths to adopt Soulful as their religion. The religion
grew fast because of the philanthropic and charitable activities adopted under the guidance of its
Chief Master Sujan Soul. The religion flourished under the Constitution of India, effectively exercising
the provisions of freedom of religion. It has opened a chain of eating places, schools, colleges and
hospitals for the poor in all major cities of India. Backed by devotees donating generously, soulful
became a saviour for many. The devotees became very passionate about their religion. All the
services are highly qualitative, professional and free. Soulful has established a ' Formation Centre' in
tribal area ofthe backward district of Marudhar in State Dravid Pradesh. Marudhar has not
progressed compared to other districts in the state in providing facilities and amenities to people. It
is ridden with poor tribal people. Formation Centre was a saviour for those poor tribal people
providing free health and education facilities. Food also was served on all days to those who visited
the Prayer Hall. The lives of lakhs of tribal families were ameliorated of the problems they had
suffered over generations Over a period of time, the Formation Centre, located in the midst of lush
green vegetation became a tourist attraction. Shops, hotels and other business establishments
popped up around the Centre 'One with the Nature, an NGO working for protection of environment
conducted a study of the changes that were taking place in that area and published a report which
revealed that because of increased activity in the area, there is reduction of species and number of
migratory birds visiting the place, certain of the species of animals like striped languor, wild donkeys
and boars have disappeared from the area and there is a fall in naturally growing medicinal plants.
The report acquired much importance within few days as all the organization’s for protection of
forests, environment and ecology appealed to the State Government to declare the area covering 50
square kilometers around Formation Centre as National Park. The Cabinet of Dravid Pradesh took a
decision to Declare the National Park . This development shocked the Chief Master who had devoted
his life to the betterment of the tribal people of that area. If the area is declared as National Park, all
the activities in the area have tO come to a halt and the Formation Centre wìll be required to move
out of that area. His appeal to the Government of Dravid Pradesh not to proceed with the
notification was rejected. As a mark of protest he has started Jast unto death. As a matter of
solidarity with their Chief Master several prominent local leaders of that area also went on hunger
strike at the end of I8 days of hunger strike the health of Chief Master deteriorated. He rejected all
the advice and suggestion to be hospitalized. Unable to see the plight of Chief Master a follower
took the extreme step of self-immolating as a mark of protest against the decision ofthe
Government by setting himself on fire. This created an emotionally charged environment. Devotees
from different parts started moving towards the place of protest, They formed and informal
organization and asked people to join the ‘Supreme Sacrifice Squad' (SSS) which will take the
ultimate step of self-immolation on a definite day. The number of persons on the SSS reached 25.
Their photos with names and identities were put on banners and hoardings. Through intelligence
reports the State Government learnt that self-immolation will go on as announced and that will
snowball into a huge backlash against the state. The best of the efforts on the part of the emissaries
of State to negotiate a halt to the protest failed. To save the situation, the police arrested the Chief
Master and 25 members of the. SSS and charged them under Sec.226 of Bharatiya Nyaya Sanhita,
2023 for attempting to commit suicide to compel or restrain exercise of lawful power. Perceiving
that the right to protest which is most fundamental in democracy, the SSS approached the Supreme
Court challenging the constitutional validity of Sec.226 of Bharatiya Nyaya Sanhita, 2023. It is
contended that the provisions is in violation of Arts. 14. 19(1)(a) ans 21 of the Constitution. The
Union of India on its part contends that the petitioners have no locus standi and the provision is
constitutionally valid".

• Whether Section 226 of the Bharatiya Nyaya Sanhita, 2023 is Constitutionally valid ?
