“REORGANIZING THE BARANGAY COUNCIL FOR THE PROTECTION OF
CHILDREN (BCPC) OF BARANGAY LAWIGAN, TUBAY, AGUSAN DEL
NORTE”
WHEREAS, REPUBLIC Act No. 7610 (Special Protection of Children Against
Child Abuse, Exploitation and Discrimination Act) provides for stronger
deterrence and special protection against child abuse, exploitation and
discrimination, and its corresponding penalties;
WHEREAS, Article 359 and 360 of the Civil Code of the Philippines
provides that “the government shall establish Councils for the
protection of children”;
WHEREAS, Article 87 of Presidential Decree 603 (Children and Youth
Welfare Code) states that, “ Every Barangay Council shall encourage the
organization of a Local Council for the Protection of Children (LCPC)
and shall coordinate with the Council for the Welfare of Children (CWC)
in drawing and implementing plans for the promotion of child and youth
welfare”;
WHEREAS, RA 8980 otherwise known as Early Childhood Care and Development
(ECCD) Act promulgates a comprehensive policy and national system for
children 0-6 years old. Section 8 (d) of said law requires the
organization of National ECCD Coordinating Council (ECCDCC) and
coordinating committees at all levels except in the barangay where the
BCPC already exists;
WHEREAS, DILG Memorandum Circular No. 2002-121, dated August 3, 2002, a
“Revised Guidelines on the Organization and Strengthening of the Local
Council for the Protection of Children (LCPC) incorporating thereat Early
Childhood Care and Development (ECCD) Coordinating Committees of the
Provincial, City, Municipal and Barangay levels”;
WHEREAS, the LCPC and the ECCDCC have the same objectives, both shall
function as one to avoid confusion and duplication of similar
councils/committees in the LGUs. The LCPC shall be the umbrella
organization for all programs on children and the ECCD Coordinating
Committee shall be one of the committees under it.
NOW THEREFORE, I ENRICO P. PAPA, Punong Barangay, of Barangay Lawigan,
Tubay, Agusan del Norte, by virtue of the powers vested in me by the law
do hereby organize the Barangay Council for the Protection of Children
(BCPC) as follows:
SECTION 1. ORGANIZING THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN
(BCPC). There is hereby organized and constituted body known and called
as the Barangay Council for the Protection of Children (BCPC) in Barangay
Lawigan, Tubay, Agusan del Norte.
SECTION 2. FUNCTIONS. The BCPC shall have the following functions:
1. Foster education of every child;
2. Take steps to prevent juvenile delinquency and assist parents of
children with behavioral problems so that they can get expert
advice;
3.Adopt measures for the health of children;
4. Conduct capability building projects to increase knowledge and
skills in handling children’s programs;
5. Encourage the proper performance of the duties and
responsibilities of parents, and provide learning opportunities on
the adequate rearing of children and positive parent-child
relationship;
6. Promote wholesome entertainment in the community, especially in
movie houses;
7. Prepare Annual Work and Financial Plan (AWFP) for children and
recommend appropriations to the Sanggunian;
8. Provide coordinate linkages with other agencies and institutions
in planning, monitoring and evaluation of plans for children;
9. Establish and maintain database on children in the barangay;
10. Advocates for the establishment and maintenance of playgrounds,
day care centers and other facilities necessary for child and youth
development;
11. Advocate for the passage of barangay resolutions/ordinances
responsive to child-related issues and concerns and ensure the
inclusion of children’s program in the executive agenda;
12. Protect the assist children in need of special protection
(e.g., abandoned, maltreated & dependents) and refer cases filed
against child abusers to proper agencies/institutions;
13. Monitor situational reports on children and prepare quarterly
updates including the implementation of children’s program and make
recommendations to the City Council for the Protection of Children
(CCPC) for consideration and nationwide applications; and
14. Perform such other child related laws especially in matters of
child and parent education, health, entertainment, etc.
SECTION 3. COMPOSITION. The membership of the Barangay Council for
the Protection of Children is hereby constituted as follows:

SECTION 4. SECRETARIAT. The secretariat shall be designated
by the Chairperson of the Council from any of the LGU’s
operating units, which shall provide the administrative and
technical support services to their respective LCPC member
agencies. The Secretariat shall be responsible for providing
technical support, documentation of proceedings, preparation
of reports, and such other assistance as may be required and
its discharge of its functions.
SECTION 5. BUDGETARY SUPPORT. Appropriate budgetary funds
shall be allocated for the operations of the Council
chargeable against the General Fund-Lump Sum appropriation
while the implementation of programs, projects, and
activities (PPAs) inclusive of PPAs stated in DILG MC No.
2012-120 which enjoins all Local Chief Executives to
appropriate one percent (1%) of Internal Revenue Allotment
on Children PPAs as planned by the BCPC.
SECTION 6. REPEALING CLAUSE. All Executive Orders or
issuances inconsistent with the provisions of this Executive
Order are hereby repealed or modified accordingly.
SECTION 7. EFFECTIVITY. This Executive Order shall take effect
immediately.
