Paper-II: Alternate Dispute Resolution 100 Marks

Vision

The Alternative Dispute Resolution course consists of a theoretical and a practical


component. There is a skills-orientated emphasis, designed not only to expose students to the
practical skills required during negotiations, mediations, conciliation and arbitration
proceeding but also to provide a theoretical context for such skills and the analytical skills
to adapt to various circumstances. Particular emphasis is placed on problem solving skills.
This course has been designed to enhance capacity building of students to meet the
challenges of globalization in field of civil and commercial matters.

LEARNING OUTCOMES AND OBJECTIVES

At the end of the course, complication students should have the ability to conduct
negotiations and simple mediations, and should have developed effective techniques for
autonomous learning and problem-solving, which can be applied in both their professional
and practical lives. Therefore, the course is designed to achieve the following specific
learning outcomes:

(a) The ability to analyses a conflict situation and to select the appropriate dispute resolution
strategy.
(b) An ability to resolve dispute expeditiously & effectively.
(c) An ability to conduct or participate appropriately in ADR techniques & process.
(d) The ability to apply problem-solving techniques, including: identification of core issues
from a set of facts; thinking laterally and innovatively in order to find effective solutions
to those issues.
(e) An ability to situate dispute resolution processes in their wider social, economic, political
and theoretical contexts.
