the payment plan opted and agreed by me/us.
I/we have clearly understood that this application does not constitute a confirmed Allotment and I/We do not
become entitled to the provisional and/or final allotment of the said commercial unit notwithstanding the fact that
the company may· have issued a receipt in acknowledgement of the money tendered with this application or
subsequently. It is only after I/We and the Company sign and execute the Allotment/Builder Buyer Agreement on
the company's standard format agreeing to abide by the terms and conditions laid down therein that Allotment
Agreement shall become final and binding upon the company. If, however, I/We fail to execute the Allotment
Agreement within 15 (Fifteen) days from the date of being called upon for by the Company to execute/sign the
same, then in such case this application shall be treated as cancelled at the sole discretion of the Company and
the Company shall be free to forfeit the amount paid by me/us till then.
I/we have clearly understood and agreed that since the project has already been granted the Occupation
Certificate by the Greater Noida Industrial Development Authority (GNIDA), the Real Estate (Regulation and
Development Act, 2016), in short RE RA Act, shall have no application over or in relation to the said commercial
unit/Complex/project. The present application and subsequent allotment of the commercial unit in the said
commercial complex shall therefore be outside the purview of the RERAAct and I/We hereby waive all/any of
my/our rights under the RERAAct. I/We hereby agree that, since the commercial complex was completed long
back, the Company shall be entitled to renovate, improve, carry out the changes in the elevation, etc. of the said
Commercial project at its discretion and I/we shall never raise any objection in this regard at any point of time.
I/We hereby confirm that I/we am/are aware that the Lessee of the Commercial Building i.e., "Mall of
Expressway" is M/s SDS lnfratech Private Limited (hereinafter "SOS") and that SOS has sold to M/s Sikka
Projects Private Limited, on sub lease basis, a large commercial area, including the commercial space which is
being purchased by the Buyer/Allottee, by way of an Agreement dated----------. I/We further confirm that my/our
entire dealing has been with Sikka Projects Private Limited without any involvement of M/s SOS lnfratech Private
limited, or its directors, agents, authorized representatives etc. has not been involved in this transaction at all.
I/We have understood and agreed that M/s SOS lnfratech Private Limited shall not be liable and responsible at
all for fulfilling the commitments made by M/s Sikka Projects Private Limited to me/us and I/we undertake to not
to raise any claim of any nature whatsoever against M/s SOS lnfratech Private Limited or its directors,
shareholders, principal officers etc. on any ground whatsoever.
