JUDICIAL COMPLAINT-AFFIDAVIT

ATTY. ANDREI A. ANDRESAN, holding office at Airport

Road, Brgy. Awasian, Tandag City, Surigao del Sur, offers the
testimony of complainant JESSIE M. ACEVEDO, which was
personally and consciously given at the undersigned’s office,
under oath, which hold him liable for false Testimonies,
involving facts which are personally known to him and based
on authentic records, as follows:

Direct Testimony:

1. Question : Do you swear to tell the truth, the whole truth

and nothing but the truth?

Answer: Yes, I swear.

2. Question : Please state your name and other

circumstances.

Answer: I am JESSIE M. ACEVEDO, of legal age, single,

and a resident of Banahao, Lianga, Surigao del Sur.

3. Question : Do you know that you can be charged of

perjury for any false statement that you will make in
this investigation?

Answer: Yes, I know.

4. Question : Now, are you willing to proceed with this
investigation?

Answer: Yes.

5. Question : Why are you here in my Office?

Answer : I would like to file complaint for “SLIGHT PHYSICAL

INJURY” against PSSg Anjun Alba Bandoy and PMSg
Joey Alingog Demakiling, Et. Al. (Tungod kay gusto
nako mupasaka ug kaso nga “SLIGHT
PHYSICAL INJURY” kontra ngadto kanila ni
PSSg Anjun Alba Bandoy and PMSg Joey
Alingog Demakiling, Et. Al.)

6. Question : Why are you filling them a case?

(Nganong pasakahan man nimo ni sila og
kaso?)

Answer: Because they physically boxed us without reason

together with my companion Jay-Ar Tejero Malinao. (Tungod
kay ilaha me gi pasakitan og gi sumbag sa walay
saktong rason kauban si Jessie Mabong Acevedo.)

7. Question : How does it happen?

(Na unsa pagkahitabo?)

Answer: On June 27, 2020 at 10:30 pm, Saturday our boss

Jupiter order us to deliver the pieces of wood into
one of he’s buyer, when we reach at the DENR
Lianga Office, a personnel from the DENR
approaches us and says “DID YOU ALREADY HAD A
PERMISSION ON THAT”, and we told him that yes!
sir, we already had permission on this from Sir.
Patrick regarding to this deliver of wood. (Kadtong
June 27, 2020 sa oras nga 10:30 sa gabie,
Sabado, ang among boss nga si Jupiter nag
sugo sa amoa nga e-deliver namo kaning
kahoy ngadto sa iyaha buyer, og kadtong
 pagabot namo didto sa DENR Lianga Office,
usa ka personnel sa DENR ang ni duol namo og
nag ingun nga “NANANGHID NA BA MO”, og ni
tubag mi nga oo, sir nananghid name didto
kang sir, Patrick bahin ani sa amoa gi deliver
nga kahoy.)

9. Question : What happen next?

(Unsai nahitabo sunod?)

Answer : After we get passed into the DENR personnel, we

continue to deliver the wood to the buyer, after we
crossed the 2 corners of intersection, we noticed
there is someone calling us, when we saw that he is
only wearing civilian attire, we thought it was
nothing and continue to our route. (Pagkatapus
namo makalapos didto sa DENR, ni padayon
me og paghatod sa maong kahoy ngadto sa
nagpalit, og pag labay namo didto sa duha ka
kanto, napansin namo nga naay nag tawag
namo og pagtan-aw namo naka sibilyan
raman, nagtoo me nga basin nag wala lang so
padayon lang mi sa among rota pag hatod sa
kahoy.)

When we arrived to the buyer, we immediately

unload the wood hand it over to the buyer. Later,
the Police Mobile Patrol of Lianga Police Station
arrived in our area which drove by Sir. Martin
together with PSSg Anjun A. Bandoy, then later
approaches us in front of me, and he (PSSg Bandoy)
says “WHY DID’NT YOU STOP, EVEN IF WE ALREADY
CHASING YOU”, then I answered that sir you have
our big respect from all of you sir, but sir we didn’t
know that your chasing us and if we knew that your
following us we will pull over immediately for our
great respect from all of you;

Lianga Police Station sa among lugar sa
gideliveran nga gi drivan ni Sir. Martin uban
sila ni PSSg Anjun A. bandoy, og taod taod ni
naog si PSSg Bandoy padulong namo og
kaatubang niya ako, og nag ingun siya (PSSg
Bandoy) nga “NGANU WALA MAN MO
MOHUNONG, NGA GI GUKOD MO NAMO”, og ni
tubag ko nga sir, naa sa inyu tanan ang among
pagrespeto nga dako, pero sir wala jud me
 kabalo nga nag gukod na diay mo sa amo, if
nakabalo me sir mo pakilid jud dayun me aron
maka hunong me, kay dako jud me respeto sa
inyo.)

Then, he (PSSg Bandoy) suddenly punched me in my

stomach and then I rushed quickly to my motorcycle
for my fear to receive another punch from him, and
he called next Jay-ar when he about to approached
PSSg Bandoy, Jay-ar already knew what should he
will do, Jay-ar already hold his breath for the
punched that hit in his stomach, then he (PSSg
Bandoy) brought us to the Lianga Police Station.

dagan padulong didto sa ako motor tungod sa
ako kahadlok og paglikay kay basin tiwasan pa
ako niya, og sunod gitawag niya si Jay-ar,
aksyon pag duol ni Jay-ar kay PSSg Bandoy
kabalo na siya nga sumbagon jud ko siya ni
PSSg Bandoy, so nag andam na daan Jay-ar og
ni ginhawa na og dako hangtod sa pag sumbag
ka niya ni PSSg Bandoy, pagkatapos gipasakay
dayun kami ni PSSg Bandoy og gidala sa
Lianga Police Station).

10. Question: What else?

Answer : When we arrived at Lianga Police Station, we

entered into the Police Station kitchen and we notice
that many of the Police Officer drinking in the
kitchen some of them not wearing in uniform, and
some of them were drunk, then, they let us sit and
watched TV in the Police Station waiting area or
(Sala), then, after PSSg Bandoy says “CAFGU COME
HERE”, he called Jay-ar to enter into one of the room
inside the Police Station and turn off the lights of the
room, and I heard the voice of Jay-ar that look like
he’s in pain, later I knew that he was boxed inside
the room by PSSg Bandoy with his companion police
officer that I didn’t know personally. Then next they
called me and also they punched me in my stomach
and I has been unconscious for a minute, when I
tried to stand up then PMSg Demakiling smashed
me the plastic bottled with water within. (Pagabot
namo ngadto sa Lianga Police Station, didto
me ni agi pagsulod sa kusina sa Station, og na
bantayan namo nga daghan mga Police nga
 nag inom didto sa kitchen, ang uban naka
civilian lang og ang uban pud hubog, then
gipalingkud mi didto sa may sala sa Police
Station sa waiting area og gi patan-aw me og
TV, taod taod gi tawag nila si Jay-ar sa pasulod
sa us aka kwarto sa station og gipalong ang
suga, og taod taod nakita nabati namo nga
nag antos si Jay-ar sa kasakit sa iyang lawas,
og taod taod nahibal-an namo nga gi sumbag
diay siya nila ni PSSg Bandoy og iyang mga
kauban nga mga police, Og sunod ako ilang
gitawag og gi sumbag pud ko sa tiyan og kalit
ko nahimatay og pila ka minuto ni nagkamalay
nako og ni barog ko og kalit pud dayun ko gi
bunalan ni PMSg Demakiling og sudlanan sa
tubig nga naay sulod gamay)

11. Question : What else?

Answer : Then, After that, I and Jay-ar sat together in the

sala, then PSSg Bandoy take his caliber 45 pistol and
said he was going to salvage us, a few minute later
Sir. Sally told them to stop it already. Then later our
boss Jupiter arrived to the Police Station and started
to negotiated from the Police Officer and they ask
for money in the amount of P 1,500.00 for SOP they
said, to get us out from the Police Station, then PSSg
Bandoy ask me to go to room with him and he asked
money from me in the amount of P 700.00 and PSSg
Bandoy apologized for what he did to us and says in
vernacular (“AYAW LANG MO PAGDUMOT”).

Jupiter og nakipag storya sa ilaha og nangayu
dayun sila og kwarta sa kantidad sa P
1,500.00 kun kuno SOP, aron maka gawas me,
og dayun gi tawag me ni PSSg Bandoy aron
storyahon didto sa kwarto kauban siya og
nangayu pa siya sa ako og kwarta sa kantidad
nga P 700.00 kay mao raman tong dala ni
Jessie og nangayu pud dayun sa amo og
pasaylo kay napasakitan niya kami og nag
ingun nga “AYAW LANG MO PAGDUMOT”)
