a pivotal role in cultivating advocacy skills, legal research, and courtroom decorum, preparing students to excel in

in drafting memorials, conducting legal research, and presenting arguments before esteemed judges, including
experienced faculty members and practicing advocates. These competitions serve as the foundation for honing legal
reasoning, oratory, and analytical abilities, essential for aspiring lawyers.
The Intra Client Counselling Competitions focus on developing students' interpersonal and problem-solving skills.

solutions. These events are judged by practicing advocates and legal experts, ensuring a realistic and enriching
experience.

Prem Ratan
V
State of Aurangabad
The Union of Sindhiya is a Democratic Republic and one of the largest populations in the
world. It is a rapidly developing country; however, it has a high crime rate and any open
discussion on sexual relationships is still a taboo. The legislation has introduced new Criminal
laws w.e.f. 01 July 2024 in the country to counter the crime rate and for speedy justice. The
new criminal laws have some special provisions with respect to the sexual offences against
women which are profoundly welcomed by the citizens of Sindhiya. Whereas, some criticism
was made on the point of sheer misuse of those provisions.
Prem Ratan is a young enthusiastic man living with his joint family and working as a Bank
Manager in a reputed nationalised bank in State of Aurangabad. Since college times Prem Ratan
was in love with Kalki who is a very ambitious girl currently working as a Company Secretary
with a multi-national company. Prem Ratan and Kalki were dating each other since last 08
years. Although, the family structure of Prem Ratan is completely different to that of family
structure of Kalki in terms of customs and lifestyle, i.e. Prem Ratan belongs to orthodox joint
family whereas Kalki belongs to modern nuclear family, both were seriously looking forward
for their pleasant future as a married couple and thereby they engaged in sexual relations
multiple times with each other.
On the night of 31 Dec 2023, a friend of Prem Ratan has organised New Year Party wherein
Prem Ratan and Kalki were invited. During the party, Kalki has given her cell phone to Prem
Ratan while she went to washroom. At that instance, a friend of Kalki named Suhana messaged
her wishing happy new year. Prem Ratan has opened that message to reply the wishes and to
14
his surprise found some serious messages exchanged between Kalki and Suhana evidencing
their intimate relationship. Though, Prem Ratan got the knowledge about the sexuality of Kalki,
he kept mum and didn’t even discuss with Kalki.
Later on, in the month of June 2024, Prem Ratan and Kalki have informed their parents about
their relationship and expressed their willingness to marry each other. Kalki’s parents have
blissfully accepted their relationship but to the other hand Prem Ratan’s parents denied to
accept their relationship and intimidated Prem Ratan to break the relationship with Kalki.
On 05 July 2024, a gathering of relatives was arranged by parents of Prem Ratan and Kalki on
their repetitive requests. The meeting was held upto long time and thereby concluded on the
word of Prem Ratan’s father that “we will think and let you know soon.” The spark of hope
was seen after the gathering and hence Prem Ratan and Kalki have decided to celebrate the
same. On the very next day, they met each other for dinner where Kalki expressed her anxiety
with respect to the Prem Ratan’s parent’s decision to which Prem Ratan tranquillised her stating
that “believe me, my parents will be convinced definitely, and we shall be married soon” and
ended up having copulation between them.
The Prem Ratan’s father on 12 July 2024 called the father of Kalki and informed that, they are
not willing to accept the marriage proposal of Kalki and Prem Ratan, and also asked her father
to restrain his daughter from meeting with Prem Ratan. This news shaken Kalki and hurt her
feelings. Kalki tried to call Prem Ratan and also tried to meet him but to her surprize, Prem
Ratan was unwilling to meet her and avoided her calls as well as messages.
Kalki got in touch with some common friends to know the whereabouts of Prem Ratan which
gone in vein and thereby Kalki felt that she has been betrayed by Prem Ratan in their
relationship. Consequently, Kalki approached to the Waluj Police Station to file written
complaint against Prem Ratan describing the incidence of 06 July 2024 along with the similar
past incidences from 2016 to 2024 and stated that Prem Ratan has betrayed her in the name of
false promise of marriage.
The Waluj Police Station has registered the FIR bearing No: 123/2024 dated 24 July 2024
against Prem Ratan under sections 64, 69, 76 and 77 of Sindhiya Nyay Sanhita, 2023 as well
as sections 354C, 354D and 376 of Sindhiyan Penal Code, 1860.
15
After registration of FIR, Prem Ratan approached to the appropriate authority and is released
on bail. Now, Prem Ratan has approached before the Hon’ble High Court of Aurangabad under
Article 226 of the Constitution of Sindhiya raising following issues.
1. Whether First Information Report bearing No: 123/2024 dated 24 July 2024 can be
quashed against Prem Ratan?
2. Whether Section 69 of Sindhiya Nyay Sanhita, 2023 is constitutionally valid in terms
of rights guaranteed by Part III of the Constitution of Sindhiya?
3. Whether Provisions of Sindhiyan Penal Code, 1860 and of Sindhiya Nyay Sanhita,
2023 can be levelled against the person in a series of offence?
(The laws of Sindhiya are pari materia to the laws of Union of India)
*The moot problem is purely hypothetical and meant for education purpose.

4. Numerous citizens and members of the civic society believe the continuous election
process in the country is one of the reasons for its slow development as a considerable
portion of the budget is spent on the election expenses and the efficient working of the
government is hurdled by the Model Code of Conduct.
5. In 2014, saw a rise in its right wing political ideology consequently, the Chrontican
People’s party (CPP) came to power in center and also won the subsequent General
election of 2019 with a strong majority and later in 2024, and a strong leadership, the
union government of Chorntica supporting the above mentioned contentions has
proposed the ONE NATION ONE ELECTION POLICY (here after called ONOE)
which imply Voters of the Chorntica will vote for the members of the Lok Sabha and
State Assembly on the same day and at the same time.
6. Considering the need of the ONOE the central government constituted a High-Level
Committee headed by the former president of Chorntica. The committee submitted its
recommendation to the president which stated that simultaneous elections would lead
to a fundamental transformation in the electoral process and overall governance
7. The Committee further recommended for 18 amendments to be made in the constitution
of Chorntica and other statutes, making of the single electoral Rolls and other steps.
8. Accepting the recommendations made to it by the High-Level Committee the Central
Government has proposed two bills “ THE CONSTITUTION ONE HUNDERED AND
TWENTY NINTH AMENDMENT BILL and THE ELECTIONS SYNCHRONIZATION
BILL 2024” on 08 October 2024 as the objective to achieve ONOE policy.
9. The bill tends to amend Art. 83, Art. 172, Art. 356, Art. 1, Art. 246 of the constitution
of Chorntica and Sec.13D, Sec.15, Sec.21 of the Representation of the People Act
1950. Both the bills were passed by both the houses of parliament and received the
assent of the President on 15 October 2024 and the same is been notified in the official
gazette.
10. Disappointed by the ONOE policy decision of the central government various
Organizations including the opposition parties, People for Constitutional Ethos an
NGO and members from the civil society organized peaceful protest and memorandum
of public resistance was sent to president.
11. Batch of writ petitions was filled by People for Constitutional Ethos (PCE) an NGO,
Mr. Alex social activist and a Member of Parliament, and Mrs. Samaya a renowned
lawyer and vocalist of democratic rights. Citing inter alia violation of principle of
federalism, parliamentary sovereignty and Basic structure including free and fair
18
election, participatory democracy, rule of law, etc before the Honorable Supreme Court
of Chorntica.
12. In pendent lite of the above writ petition. The state of Shinchal Pradesh a state in
Chorntica [where the National Chorntican Party (NCP)] is in power and who is also
the single largest opposition party in Lok Sabha] had filed the petition before the
Honorable Supreme Court of Chorntica under Art.131 of the constitution citing
violation of distribution of powers by the Central Government.
13. The Honorable Supreme Court had clubbed the matters considering them to be arising
out of same cause and has listed the matters for the first hearing before itself and will
entertain the following issues:
1. Whether the present petitions are maintainable?
2. Whether the Acts passed by the Parliament for ONOE are constitutionally valid?
3. Whether the ONOE infringes on the independence of the state legislature by
enforcing uniformity in elections cycles?
4. Whether the ONOE restricts rights of citizen to have accountable government,
minimizing the frequency of elections?
*The laws of Union of Chorntica are in pari material to the laws of Union of India.
*The moot problem is purely hypothetical and meant for education purpose.
