Construction Contract For Residential House
In the municipality of Juan Aldama Zacatecas on the 17th day of the month of March of the year
2019, the present CONTRACT FOR THE CONSTRUCTION OF A HOUSE is celebrated between Mr. C.
Manuel Victor Martinez Ramirez, hereinafter referred to as the OWNER OR CONTRACTOR, a
Mexican of legal age, married, with address at Francisco I Madero Street #98 in the municipality of
Juan Aldama Zacatecas; and Mr. JOSE LORENZO GONZALES SALAS, with address at Calle Colotlán
#109 in the municipality of Miguel Auza Zacatecas, Mexican, married, of legal age, who hereinafter
will be referred to as the CONTRACTOR OR BUILDER, and who by mutual agreement are subject to
this Contract in accordance with the following:
DEMONSTRATIONS
I.- The C. Manuel Victor Martinez Ramirez states that he is the owner of an urban property
located on U Street. del Valle de México #121 within the Villas Universidad subdivision in the city
of Zacatecas, which has the following dimensions: 8 meters wide by 15 meters long with a surface
area of 120 square meters; which already has a valid official number and current electricity and
water contracts.
II.- The C. José Lorenzo Gonzales Salas states that he has been dedicated to construction for more
than 20 years and is a construction contractor, having experience in the construction sector.
CLAUSES
I.- The owner Manuel Víctor Martínez Ramírez commissions the builder named José Lorenzo
Gonzales Salas, who accepts, the direction, administration and execution of the works that
demand the total and complete completion of a family home on the urban lot of his property
located on Calle U. of the Valley of Mexico #121 within the Villas Universidad subdivision in the
city of Zacatecas that has the following measurements: 8 meters wide by 15 meters long with an
area of 120 square meters.
II.- The owner commissions the builder to build the residential-type family home based on the
architectural design and based on the construction permits that will be delivered to him at the
time of giving him the first advance payment for the work.
III.- The architectural design is prepared by the Architect named Raudel Muñoz Sandoval.
IV.- The calculation report is prepared by Eng. Luis Eduardo Ramos León, which will also be
delivered to the builder so that he can give the necessary building orders as well as the correct
structural composition.
V.- The plans and technical specifications of the Facilities and Specialties, details and clarifications,
background information that have been approved by the Owner and that the parties declare to
know and accept.
VI.- The CONTRACTOR declares that it has been adequately informed regarding the nature, type
and magnitude of the work and agreed tasks, operating conditions and other peculiarities of the
place where they will be provided, since it has visited the property and reviewed its characteristics
in the detail it has deemed pertinent. Furthermore, the CONTRACTOR declares that he has
carefully reviewed all the information that the OWNER has provided for the execution of the work
and commissioned works, especially the plans, projects, land, understanding that he fully accepts
its content as adequate for the contracted work, within the agreed time frame and price.
VII.- THE CONTRACTOR declares that it has all the qualified personnel for the correct execution of
the work, and the contractor declares that it will register the workers for social security.
VIII.- The owner is not responsible for any issue related to workers, such as labor claims, payment
of fees to them or registration with social security.
IX.- THE PRICE, the Constructor agrees to execute all the works contracted for the total gross price,
including the Value Added Tax (VAT) of a sum of $980,000.00 (Nine hundred eighty thousand
pesos 00/100 MN) The agreed price will be fixed and irrevocable, and will not be readjusted. The
contract price corresponds to the completed works and everything related to everything necessary
for the correct, timely and complete construction and delivery of the same, and, in general, all
expenses incurred by the fulfillment of this contract, whether direct, indirect or due to it.
X.- PAYMENT METHOD The agreed price, amounting to the sum, equivalent in pesos, national
currency, of $980,000.00 (Nine hundred eighty thousand pesos 00/100 MN) a) With an advance
payment of $400, 000.0 0 (Four hundred thousand pesos 00/100 MN), this payment covers the
payment that will be allocated to materials and the contractor agrees to take $300, 000.00 (Three
hundred thousand pesos 00/100 MN) to the materials company that will be the one to supply the
construction materials necessary for the complete construction of the work.
XI.- The owner agrees to pay the amount of $10,000.00 (ten thousand pesos 00/100 MN) week by
week. This will cover the payment week by week of the workers that the work will have, this
money will be received by the C. Alberto Moreno, who will be the trusted person who will be at
the site when the contractor is not there.
XII.- When it is considered that the work is halfway done, the owner agrees to deliver to the
contractor the amount of $100,000.00 (one hundred thousand pesos 00/100 MN). This is in order
to pay the relevant expenses for slabs and to make the corresponding payments for hydraulic
concrete.
XIII.- When the construction is considered to be in gray state, the amount of $200,000.00 (two
hundred thousand pesos 00/mn) will be given to the builder, this in order to make the pertinent
expenses of finishes and windows.
XIV.- At the time of completion of the work and by mutual agreement of both parties, when
hydrosanitary, gas, electricity and finishing tests have already been carried out, the remaining
amount of the agreed amount will be delivered.
XX.- The total execution period for all the work is 7 months from the time the foundation
excavation is carried out.
The works must be fully executed and duly delivered and received.
Note: Any setback will be resolved by those involved here. If no full agreement is reached, this will
serve as evidence for a legal resolution.
