Concept
Occupational safety and health (OSH) is generally defined
as the science of the anticipation, recognition, evaluation
and control of hazards arising in or from the workplace that
could impair the health and well-being of workers, taking
into account the possible impact on the surrounding
communities and the general environment.
Occupational safety and health is identified as the discipline
dealing with the prevention of work-related injuries and
diseases as well as the protection and promotion of the
health of workers. It aims at the improvement of working
conditions and environment.
Enacted on 25th February 1994, the Occupational Safety
and Health Act 1994, or Act 514, is the primary legislation
in Malaysia that regulates workplace safety and health. It
outlines the duties and responsibilities of employers,
employees, manufacturers, and suppliers to ensure a safe
and healthy workplace.

that stated people have a right to feel and be safe at work. It sets forth
minimum standards for various industries and work environments.
Therefore, safety and health training must be carried out in every
company to create the awareness about the importance of safety and
health in a workplace. Employers who disobey or violate against the
laws may face the penalties that will affect their reputations.
Duty of care
OSHA imposes a statutory duty upon all employers to ensure, so
far as practicable, the safety, health and welfare at work of all the
employees.

Put simply, having a duty of care means being responsible for

your people's health, safety and well-being. This usually means
protecting the welfare of your team members while they're at
their regular workplaces, or while they're on official business off-
site and even abroad.

Statutory requirements - These are specific obligations imposed

by statutes, which are formal written laws enacted by legislative
bodies. For instance, the Health and Safety at Work Act 1994 is
a statutory requirement that mandates employers to ensure the
health and safety of their employees.
