% 11.09.2024
[Physical Hearing/Hybrid Hearing (as per request)]
CM Appl.52880/2024
1. Allowed, subject to the petitioner filing legible copies of the
annexures, at least three (3) days before the next date of hearing.
W.P.(C) 12702/2024 & CM Appl.52881/2024 [Application filed on behalf
of the petitioner seeking interim relief]
2. A broad perusal of the writ action would show that the petitioner has
been allotted chamber no. 202 (Full) in S-Block i.e., Delhi High Court.
2.1 It is also the stand of the petitioner that his associate, one Mr Vineet
Raizada has also been allotted chamber no. 115 (Full) in S-Block.
3. It appears that the petitioner, for a very long time, i.e., since 1990,
was in occupation of chamber no. 261 in the Old Block, which stood allotted
to Mr Kamal Nanda, Advocate. The petitioner claims to be an associate of
Mr Kamal Nanda.

3.1 We are told that Mr Kamal Nanda expired in 2010.
4. Mr Amarjit Singh Chandhiok, learned senior counsel, who appears on
behalf of the petitioner, says that because of the medical condition of the
petitioner, he wishes to move back to the Old Block.
4.1 In support of his submission concerning the medical condition of the
petitioner, our attention has been drawn to Annexure P-2 (Colly) and
Annexure P-3.
4.2 According to Mr Chandhiok, since chamber nos. 202 and 206 in the
Old Block are occupied by persons who are willing to give up their
allotment, this space could be easily made available to the petitioner.
4.3 Furthermore, Mr Chandhiok informs us that chamber no. 261 in the
Old Block has been jointly allotted to Mr Sumer Seth and Mr Saurabh Seth,
Advocates. We are told that they have not occupied the said chamber.
5. We are also informed by Mr Chandhiok that Messrs Sumer Seth and
Saurabh Seth are in occupation of separate chambers in Block-II and III.
6. Given the medical condition of the petitioner, we are inclined to issue
notice to the respondent.
6.1 Ms Kanika Agnihotri accepts notice on behalf of the respondent.
7. Ms Agnihotri says that she will return with instructions.
8. Meanwhile, since Mr Chandhiok has stated at the Bar that he would
place on record affidavit(s) of Messrs Sumer Seth and Saurabh Seth stating
that they do not intend to occupy chamber no. 261 in the Old Block, steps in
that behalf will be taken within the next ten (10) days.
8.1 A copy of the affidavit will be furnished to Ms Agnihotri.

9. We may also record that Mr Chandhiok has stated, on instructions,
that the appellant is willing to give the vacant possession of chamber no. 202
in the S-Block. We are told that correspondence in that behalf has been
exchanged with the respondent.
9.1 Let an affidavit be filed by the petitioner in that behalf as well.
10. Likewise, Mr Chandhiok informs us that Mr Vineet Raizada, who has
been allotted chamber no. 115 in the S-Block, is willing to give vacant
possession of the said chamber.
10.1 Mr Chandhiok says that he will request Mr Raizada to file an affidavit
stating that he is willing to surrender chamber no. 115 in the S-block.
11. List the matter on 03.10.2024.
