JOINT AFFIDAVIT OF ARREST

We, PSMS Chrisvie Embernate, PSMS Regine Nava and PSMS Kyla Marie
Pangilinan, of both legal ages, members of Binmaley Municipal Police Station, Binmaley ,
Pangasinan, after having been duly sworn to in accordance with the law do hereby depose and
states;

That at about 11:11 PM of November 29, 2024, while we doing our duties and
responsibilities in Sector 1, I (PSMS Embernate) received a cellular phone coming from our
station that there was an alleged Shooting Incident transpired in Brgy San Isidro Norte,
Binmaley, Pangasinan wherein the description of two (2) unidentified suspects was wearing
black jacket and white short (driver) while the back ride (gunman) was wearing gray sweet shirts
and gray pants boarded on Yamaha Mio I with no attached plate number;

That after I (PSMS Embernate ), received a call from our station, we immediately inform
our team leader that there was a shooting incident thereat;

After which, we immediately conducted debriefing led by our team leader and we (PSMS
Embernate and PSMS Nava) were tasked to act as an arresting officer against the two (2)
suspects;

That at about 6:00 PM of same date, we informed our Desk Officer that we are
conducting checkpoint operation lead by our team leader at Brgy San Isidro Norte, Binmaey
Pangasinan and we were dispatched and proceeded thereat;

That at about 6:20 PM of same date, we immediately established a checkpoint operation


at the said place in bright area. After several hours we are securing/guarding the area, that at
about 8:30 PM of same date, our team leader received a call coming from follow-up team that
the suspects were heading towards our checkpoint area and we immediately to prepare for
possible arrest of the suspects;

That after several minutes, we seen/saw the incoming aforementioned motorcycle


followed by the follow-up team and upon sensing our presence the said driver tried to evade
and maneuver;

At that juncture, our team leader used a megaphone and told them to give up safely;

That upon acknowledging our presence, the two (2) suspects turn off their motorcycle
and slowly lie face down on the pavement;

That, we (PSMS Embernate and PSMS Nava) prompted the suspect together our back
up team and immediately seize the suspects. Afterwards, I (PSMS Nava ) apprised their nature
of their arrest and informed their constitutional rights in a dialect understood by them and further
informed them that we are recording videos on the said operation utilizing two (2) Alternative
Recording Devices (ARD’s) under A.M No. 21-06-08-SC.

That after the arrest, we conducted body search and I (PSMS Embernate ) recovered
from the back ride from his possession, control and custody the one (1) Black ARMSCOR Cal.
45 with magazine inserted with three (3) live ammunitions;

That, I (PSMS Nava) able to recover and confiscate the above stated motorcycle;

After conducting of inventory and markings of evidence at the said place, we


immediately proceeded at our station for proper documentation and disposition;
That we, (PSMS Matana and PSMS Mangaliag) properly turn over all the Form of
inventory and Object Seized Items to our investigator on case with the following items: one (1)
ARMSCOR Cal. 45 marked as ARM-1; one (1) magazine marked as ARM-2; three (3) pieces of
cal. 45 live ammunition marked as ARM-3 to ARM-5 respectively and one (1) Yamaha Mio I with
no attached plate number marked as BVM-1;

That the suspects were later identified as Leo Pachica y Panes (H) and Erwin Lizardo y
Marcial (Gunman), of both legal ages, jobless and resident of Brgy San Isidro Norte, Binmaley,
Pangasinan;

That, we are executing this Affidavit to attest to the truthfulness of the foregoing
statement of the execution of Arrest against Leo Pachica y Panes Erwin Lizardo y Marcial for
the crime of Murder.

FURTHER AFFIANT SAYETH NAUGHT:

IN WITNESS THEREOF, I hereunto affixed my signature this ____ day of December


2024, at Binmaley Police Station, Binmaley, Pangasinan.
