He is the owner and holder of all rights in respect of stand Number 444
Elmswood Park, MARONDERA having been granted such rights by the
Department of Public works, Ministry of Local Government, Public Works and
National Housing through an offer letter dated 09 May 2008.
Following the aforesaid allocation, Defendant duly developed the property and
constructed a residential property thereon.
The aforesaid construction of a residential property was under the supervision
and approval of the Municipality of Marondera showing that the Municipality
had been satisfied that the Defendant is the owner of the said property.

on the grounds that these are privileged documents.
3. There are no documents in my possession relating to the matter in question in this
suit which I had but do not now have in my possession or power.
4. According to the best of my knowledge, information and belief I have not now
and never had in my possession, custody or power, or in the possession, custody
or power of any other person or persons on my behalf any deed, account, book of
account, voucher, receipt, letter, memorandum, paper or writing, or any copy or
extract from any such document, or any other document whatsoever, relating to
the matter in question in this suit or any of them relative to such matter other than
and except the documents set forth in the first and second part of Schedule hereto.
