III) TRACING OF TITLE
From the perusal of the documents listed above, the property cited originally
belongs to Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar Later
on Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar were jointly
sold their property, measuring to an extent of 8.38 Acres in this Common Share of
5.38 Acres of land in S.No-617, 618 by Regd. Sale Deed dated 27.08.1981 Vide
Doc.No- 2420/1981 in the file of Tiruppur Joint I SRO to and in favour of
Mr.Shanmugam (i.e.) Sl.No-1

From the perusal of the documents listed above, the property cited originally
belongs to Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar Later
on Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar were jointly
sold their property, measuring to an extent of 12.38 in this Common Share of 3.00
Acres of land in S.No-617, 618 by Regd. Sale Deed dated 27.08.1981 Vide Doc.No-

2422/1981 in the file of Tiruppur Joint I SRO to and in favour of Mr.Palaniyappan

Thereafter, the above said Mr.Palaniyappan, Mr.Shanmugam [Sl.No-1, 2] were


jointly appointed one power agent to sale his / her / their self acquired property,
measuring to an extent of 2.54 Acres of land in S.No-617/3C & Some Other Properties
[After Sub Division S.No-617, 618] by Regd. General Power of Attorney Deed dated
10.01.2006 Vide Doc.No- 32/2006 in the file of Thottipalayam SRO to and in favour of
Mr.Arunachalam, Mr.Palanisamy (i.e.) Sl.No-3

Thereafter, the above said Mr.Arunachalam, Mr.Palanisamy were jointly sold his /
her / their power possessed property, measuring to an extent of [Site No-105] 2400
Sq.Ft of land in S.No-617/3C and Some other S.Nos & Plots , by Regd. Sale Deed
dated 01.03.2016 Vide Doc.No- 964/2016 in the file of Thottipalayam SRO to and in
favour of Mr.Arunachalam (i.e.) Sl.No-4

Thereafter, the above said Mr.Arunachalam sold his / her / their self acquired
Property, measuring to an extent of 1200 Sq.Ft of land in S.No-617/3C & Some Other
S.Nos by Regd. Sale Deed dated 21.03.2018 Vide Doc.No- 944/2018 in the file of
Thottipalayam SRO to and in favour of Mr.Prabakaran (i.e.) Sl.No-5. [Title Deed].

There such Mr.Prabakaran had derived perfect, Valid, Sound and absolute title over
the said property measuring to total extent of 1200 Sq.Ft of land cited above & the flow
of title is in legitimate order.
III.A) TRACING OF SALE AGREEMENT: -
The Sl.No-6 dated 25.09.2024 is an UnRegd. Sale Agreement Deed between
Mr.Prabakaran of one part – (Vendor/Power holder), Smt.Thilagamani of another part-
(Purchaser / Mortgagor / Borrower / Agreement-holder) reveal that the purchaser had
agreed to purchase property measuring to an extent of 1200 Sq.Ft of land in S.No-
617/3C for a total sum of Rs. 22,85,000 out of Rs. 11,50,000 had been paid as advance
and balance of Rs. 11,35,000 [Rupees only] shall be paid on or before 24.12.2024 The
said Sale–Agreement is in hold. If in compliance of the said Sale-Agreement
Mr.Prabakaran execute the Sale-Deed in favour of Smt.Thilagamani there upon
Smt.Thilagamani shall derive a Perfect, valid, Sound, and absolute title to the above
said property.

III.B) TRACING OF POSSESSION


The Sl.No-7 dated 15.11.2024 is the Patta Extract No- 1854 issued by E-Services
of Tamil Nadu Government. Stated that, the land in the name of Mr.Prabakaran &
Others as Jt.Pattadharar for the above said property for an extent of 1.74.37 Hectares
of land in S.No-617/3C1 [After Sub Division S.No-617/3C]

The Sl.No-8 dated 09.02.2024 is the Property Tax Receipt issued by Executive
Officer/President of Thonguttipalayam Panchayat, issued for sum of Rs.1650 in the
name of Mr.Prabakaran for Door No- 1/64/I.

III.C) TRACING OF ENCUMBRANCE

The Sl.No-9, 10, 11, 12 dated 05.06.2018, 02.04.2018, 15.11.2024, 15.11.2024 are

The loan applicant is required to Registered Deposit The Title Deeds / Simple
Mortgage with the Bank. He is also required to confirm the same through a separate
letter of confirmation evidencing the deposit of title deed towards the security for the
repayment of the loan.

xv) Additional documents and pre cautions to be taken:


1. This opinion is purely based on the Photostat copies of documents furnished to this
office, with a bonafied belief that the same are genuine. In the event any of such
document/s found to be false/fabricated/forged, we do not hold any obligation or
responsibility whatsoever in future. Since, we have not conducted any independent

verification on the documents, the bank is strictly advised to ensure the


authenticity/genuinely of the documents through its own source.
2. We have only examined title to the property and not the value or physical possession
of the loan applicant/his/her vendor. Therefore, it is strictly advised that an officer of
the bank and approved valuer should make personal inspection of the schedule property
to identify, ascertain its existence and to confirm the actual physical possession of the
borrower/his vendors and to evaluate the value of the property before disbursement of
loan.
3. This opinion is subject to the above terms and strict compliance of the observations
only.
ADVOCATES REPORT
In the light of the documents made available for verification, prima facie I am of the
opinion that Mr.Prabakaran after compliance of Sale Agreement without any legal
impediments. On execution of regular registered sale deed, they will derive a valid title in
respect of schedule property referred to Part-II.
I further certify that, if the applicant defaults the loan, then the property can be taken
under SARFAESI Act and Proceedings.

The Bank is advised to obtain/comply the additional and pre cautions to be taken
following documents before/after disbursement of the loan
