From the perusal of the documents listed above, the property cited originally
belongs to Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar Later
on Mr.Annamalai Nadar, Mr.Kuppusamy Nadar, Mr.Arumuga Mudaliar were jointly
sold their property, measuring to an extent of 12.38 in this Common Share of 3.00
Acres of land in S.No-617, 618 by Regd. Sale Deed dated 27.08.1981 Vide Doc.No-
4
Thereafter, the above said Mr.Arunachalam, Mr.Palanisamy were jointly sold his /
her / their power possessed property, measuring to an extent of [Site No-105] 2400
Sq.Ft of land in S.No-617/3C and Some other S.Nos & Plots , by Regd. Sale Deed
dated 01.03.2016 Vide Doc.No- 964/2016 in the file of Thottipalayam SRO to and in
favour of Mr.Arunachalam (i.e.) Sl.No-4
Thereafter, the above said Mr.Arunachalam sold his / her / their self acquired
Property, measuring to an extent of 1200 Sq.Ft of land in S.No-617/3C & Some Other
S.Nos by Regd. Sale Deed dated 21.03.2018 Vide Doc.No- 944/2018 in the file of
Thottipalayam SRO to and in favour of Mr.Prabakaran (i.e.) Sl.No-5. [Title Deed].
There such Mr.Prabakaran had derived perfect, Valid, Sound and absolute title over
the said property measuring to total extent of 1200 Sq.Ft of land cited above & the flow
of title is in legitimate order.
III.A) TRACING OF SALE AGREEMENT: -
The Sl.No-6 dated 25.09.2024 is an UnRegd. Sale Agreement Deed between
Mr.Prabakaran of one part – (Vendor/Power holder), Smt.Thilagamani of another part-
(Purchaser / Mortgagor / Borrower / Agreement-holder) reveal that the purchaser had
agreed to purchase property measuring to an extent of 1200 Sq.Ft of land in S.No-
617/3C for a total sum of Rs. 22,85,000 out of Rs. 11,50,000 had been paid as advance
and balance of Rs. 11,35,000 [Rupees only] shall be paid on or before 24.12.2024 The
said Sale–Agreement is in hold. If in compliance of the said Sale-Agreement
Mr.Prabakaran execute the Sale-Deed in favour of Smt.Thilagamani there upon
Smt.Thilagamani shall derive a Perfect, valid, Sound, and absolute title to the above
said property.
The Sl.No-8 dated 09.02.2024 is the Property Tax Receipt issued by Executive
Officer/President of Thonguttipalayam Panchayat, issued for sum of Rs.1650 in the
name of Mr.Prabakaran for Door No- 1/64/I.
The Sl.No-9, 10, 11, 12 dated 05.06.2018, 02.04.2018, 15.11.2024, 15.11.2024 are
the encumbrance 4 certificates issued by Tiruppur, Thottipalayam SRO for the said
property cited above pertaining to a total period of 38 years.
The Sl.No-9 EC is with Nil Entries
The Sl.No-10 EC is with 4 Entries
In finally, it is seen that Mr.Prabakaran is / are the recipient of the said property cited
above and that there are no other subsisting encumbrances, which paves way for an
encumbrance free, absolute and marketable title to Mr.Prabakaran over the same.
