SUBJECT: Spot Report re Stabbing Incident that resulted to the Death of Juan Dela Cruz

DATE: December 3, 2024

FACTS OF THE CASE:


A complaint Miya Dela Cruz, Filipino, a 28-year-old, married, wife of a victim and a
resident of sitio Waling-Waling Opao Mandaue reported to this office and requested to
put into a record that the stabing happened near the UCLM gate 10 of
Opao Mandaue City, Cebu around 10:35 in the morning of December 1, 2024.
According to the report of the witness (wife of the victim) of the said incident, that the suspect
had an argument with his husband while drinking alcohol(RedHorse). I saw the suspect had
grab something which is a knife and stab my husband multiple times.
Upon further investigation, it was identified that the suspect is Pedro pindoko,
Filipino, 30 years old, Single, Construction worker, and a resident of sitio Waling-Waling
Opao Mandaue City, Cebu, the case is still being investigated, the suspect has been arrested.
A progress report will follow.

AFFIDAVIT OF ARREST

We, the UNDERSIGNED Police Officers, both members of the Philippine National Police,
presently assigned at the Mandaue City Police Office Station 5 do hereby depose and state
THAT:

01. We are among the members of the Philippine National Police (PNP) who conducted
entrapment operations at Opao Mandaue city located along Sitio waling-waling opao Mandaue
City, Cebu

02. Said operation stemmed from the complaint of the wife of the victim for
violation of murder under article 248 of the RPC which was referred to our office by the
complainant ( Miya Dela Cruz) against Pedro Pindoko, 30 years old, Single, Filipino and residing
at the sitio waling-waling Opao Mandaue City, Cebu;

03. On the complaint dated December 2, 2024, Miya Dela Cruz wife of the victim
heard that his husband and the suspect had arguing something and it was under influence of
alchol that lead to the suspect(Pedro Pindoko) to stab Juan Dela Cruz (victim) multiple times
that result of the death of Juan Dela Cruz.

04. Upon receipt of their said complaint, our office planned out an entrapment
operation against the suspect. At about 10:45 AM of December 2, 2024, the undersigned
together with the complainant proceeded at the pre-arranged;

05. Upon arrival thereat, complainants waited for the suspect to arrive while we the
undersigned seated near the table of the complainants. At about 10:45 AM, suspect arrived and
approached the complainants and after few conversation, complainants handed over the police
to immediately effect arrest;

06. Seized and recovered in the possession and control of the arrested person were
the following, to wit:

a.) Knife with stain Blood;

b.) Bottle of Alchohol ( Redhorse) and

b.) Other evidence confiscated;


07. Suspect together with the seized and recovered evidence was brought to the
Philippines National Police (PNP) Custudian for booking and proper disposition. Likewise, the
arrested person was apprised of their rights as provided for under the Constitution of the
Philippines.

08. The report of the PNP Crime Laboratory Group Physical Identification Report No.
1234 dated December 3,2024, revealed that suspect Pedro Pindoko was positive and matches
the evidence.

We executed this joint affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal Cases against Pedro Pindoko for violations of murder under Article
248 of the RPC.

stabbing the victim, the victim and the suspect was drinking alcohol while drinking they had
arguing something that lead to stab Juan Dela Cruz.

family matter. We are requesting your office’s thorough examination of the case to determine

1.Reference: Memo from this office (Spot Report) dated December 4, 2024 subject as above.

2. Above reference pertains to the stabbing incident that transpired to December 2, 2024 at
about 10:35 o’clock in the morning sitio waling-waling, near uclm gate 10 opao Mandaue City,
Cbeu. Where in victim Juan Dela Cruz 28 years old, married, construction worker and a resident
of sitio waling-waling Opao Mandaue City, Cebu. The victim was declared dead on the spot at
the crime scene. While the suspect was arrested after the incident and he is now under the
custody of this office for proper disposition.

3. Investigation conducted by this office disclosed that the motive of the incident was the both
parties had an issue of family matter and it was triggered when they were drunk. The office
invited the witness to shed light in this particular incident.

4. A case of Murder is being prepared by this office for filling in court against the suspect. Any
development of this case will br submitted to the office as soon as obtained.

1. Reference:
a. Memo dated December 2, 2024: Initial report on the incident detailing the
circumstances surrounding the murder.

b. Memo dated December 4, 2024: Update on the progress of the investigation,


including any leads or developments in identifying and apprehending the
suspect.

2. The incident happened on December 2, 2024, around 10:35 AM. Monday, at the
residence of sitio waling-waling Opao Mandaue City, Cebu.

3. Pedro Pindoko ( suspect) and Juan Dela Cruz (victim) were influence in liquor and they
also had personal problem in their history and it was triggered when they were
arguing while influence by the liquor and the Pedro Pindoko grab the knife to stab
multiple times to Juan Dela Cruz.

4. At around 10:35 AM on December 2, 2024 Pendro Pindoko forcefully stab Juan Dela
Cruz, the incident was happen outside their house they were neighbour near at UCLM
gate 10.

5. Upon receiving reports of trouble, the police promptly responded to the incident
location Opao Mandaue Cebu City, Cebu. They carefully investigated the argument
between Juan Dela Cruz and Pedro Pindoko., gathering evidence including knife with
blood stain, and other relevant items from the scene for further analysis. Additionally,
they interviewed witnesses, such as family and neighbors, to gain a clear
understanding of the events. Immediate medical assistance was provided to Armateo,
but unfortunately, he was pronounced dead on the spot. Pedro Pindoko cooperated
with the police, providing his account of the incident. The police chief announced
plans to file a murder case against Pedro Pindoko pending test results. The
investigation remains ongoing as authorities await further test results and seek to
understand the circumstances surrounding the tragic outcome.
6. Conclusion: These events outline the build-up to the tragic stabbing, emphasizing the
escalating tension between Juan and Pedro. As the investigation continues,
authorities await further tests and legal procedures.

7. The investigation into what happened between Juan Dela Cruz and Pedro Pindoko.
uncovered some important points. The situation quickly got out of hand, mainly
because Juan and Pedro was acting aggressively and making triggered to Pedro. Juan
and Pedro was apparently drunk, which probably made things worse. Pedro had knife
in his back and suddenly grab it and stab toward Juan. Miya Dela Cruz says Pedro
suddenly stab his wife while they were arguing something. Pedro personal issues,
especially problems with his family, likely added to the tension. While in the
investigation they recovered some broken glass with blood stain at the scene.
