Drafting Committee of the Constitution of India

The constitution of India is the supreme law of India. The document lays down the
framework determining the fundamental political code, structure, procedure,
powers and duties of the government’s institutions. It also states the fundamental
rights, principals and the duties of the citizens.
In fact, it is the longest constitution in the world.

The constitution of India imparts constitutional supremacy, since it was created by


a constituent assembly and was adopted by the people of India with a declaration
in its preamble. The parliament cannot overwrite the constitution.

The constitution of India was adopted on November 26, 1949, and came into effect
from January 26, 1950. It replaced the Government of India Act, 1935 as the
country's fundamental governing document, and the Dominion of India became the
Republic of India.

It declares India a sovereign, socialist, secular and democratic republic, assuring


that all citizens will get justice, quality, liberty and endeavors to promote fraternity.
The original copy of the constitution is preserved in a helium filled case at the
Parliament House in New Delhi.

On 29th August 1947, the Constituent Assembly through a resolution appointed a


Drafting Committee to

'...scrutinise the draft of the text of the Constitution of India prepared by


Constitutional Adviser, giving effect to the decisions already taken in the Assembly
and including all matters which are ancillary thereto or which have to be provided
in such a Constitution, and to submit to the Assembly for consideration the text of
the draft constitution as revised by the committee...'
At its first meeting on 30th August 1947, the Drafting Committee elected B.R
Ambedkar as its Chairman.

Drafting Committee Consists of Seven Members

They were:

1. Dr B R Ambedkar (Chairman)
2. N Gopalaswamy Ayyangar
3. Alladi Krishnaswamy Ayyar
4. Dr K M Munshi
5. Syed Mohammad Saadullah
6. B Madhava Rau (He replaced B L Mitter who resigned due to ill-health)
7. T T Krishnamachari (He replaced D P Khaitan who died in 1948)

Drafting Committee Of The Constitution Assembly – Function

The assembly's work had five stages:

 Reports on issues were presented by committees.


 Based on the findings and his research into the constitutions of other
countries, B.N. Rau drafted an early draught.
 The drafting committee, led by B. R. Ambedkar, prepared a thorough
draught constitution that was made available for comment.
 The draft constitution was discussed, and amendments proposed and
enacted.

Drafting Committee of The Constitution Assembly – Methodology


 The Constitution Assembly's Drafting Committee worked in a systematic,
open, and consensual manner.
 The task of drafting a Constitution for India took the Constituent Assembly
two years, eleven months, and seventeen days to complete and spanned
eleven sessions.

Conclusion

 On November 26, 1949, the constitution was completed, and several clauses
dealing to citizenship, elections, a provisional parliament, and interim and
transitional laws went into effect immediately.
 The rest of the constitution took effect on January 26, 1950.
