UNETHICAL PRACTICES ON THE PART OF THE EMPLOYERS

SEXUAL HARRASMENT – the sexual favor is made as a condition in hiring or employment, use
as an exchange for promotion or other privileges.

BRIBING GOVERNMENT OFFICIALS - in consideration for any offer, promise, gift, or present is
being presented.

PAYING EMPLOYEES BELOW MINIMUM WAGE – employers deny their fair share in the
business.

TAX EVASION – is an act of avoiding payment of taxes due to the government through the use
of illegal/fraudalent means.

RESISTING AND INTERFERING WITH TRADE UNIONS – employers express outright resistance
to trade unionism by denying their worker’s right to association and keeping them from joining
trade unions.

CUTTHROAT COMPETITION – competing with the other businessmen through disparagements,


infringements, and deceptions.

EMPLOYING CHILDREN – employers play less wages to children, but they use these children to
perform work that adult workers usually do.

DOUBLE STANDARD – a practice of discrimination at the workplace, refers to the unfair


treatment of a person or group on the basis of prejudice.

FAVORITISM – some way to Filipino concept of tokenism. Favoring employee is a token/reward


for an employee’s personal loyalty to the employer or doing things that please the employer.

ENTERTAINING GOSSIP/MALICIOUS TALKS/BACKSTABBING – some employers find interest in


snoping at the personal lives of their employees rather than thing about their general welfare.

INSULTING EMPLOYEES IN PUBLIC – scolding employees in public and to censure them using
profane language.

UNETHICAL PRACTICES ON THE PART OF THE EMPLOYEES

LAGAY, LUSOT, LAKAD – Lagay is to ‘bribe; referring to the act of giving and/or it could refer to
anything given to someone to induce him to act dishonestly or spur him to work well and fast.
Lusot is to act literally means invading something, perhaps blame for an unaccomplished task,
by escaping through the whole or opening. Lakad, the decadent employee works in
convenience with other people who are not formally connected with the office, and are well
trained and as well versed in searching for, and inducing clients with problem, they are called
“fixers”.

PALAKASAN - practice of giving referential treatment to a particular client to the unfair
disadvantages of others.

DISCOURTESY – employees who are arrogant, unfriendly, unapproachable, impolite, and can
make feel clients uncomfortable.

IMPROPER USE OF OFFICE MATERIALS – using office materials for personal purposes and
benefits at the expense of the company or government funds. Office equipments, these are
provided to them to make the performance of their official duties more efficient, and not for
any personal purposes.

PLIFERAGE – stealing small items owned by someone else, in this case the employer or the
company. Taking something that is not yours, no matter how small, is stealing. It is theft and
theft is a crime.

GOSSIPING AND BOOTLICKING – employees indulge in idle talk out of pleasure they derive in
minding the affairs of others, some do it to gain favor from their employers who entertain, if
not, encourage gossiping, it is called “bootlikers or applepolishers”.

THE EMPLOYEES SHOULD KEEP IN MIND TWO (2) THINGS:


The reason why they are employed, or why their institutions or firm exists, is because of these
“faceless” clients or customers.

Customer or clients, being human, greatly valued kindness, respect, and recognition.

MORAL RESPONSIBILITY
- is the status of morally deserving praise, blame, reward, or punishment for an act or omission
performed or neglected in accordance with one's moral obligations.

MORAL - means to be mindful about the choices in life that have good or evil consequences.

RESPONSIBILITY - to deal with something or of having control over someone.

Moral responsibility
for a person to be held morally responsible for his act, it is important that his act be deliberate
or voluntary.

Two prerequisites: Knowledge & Freedom

A moral act that is not performed with adequate knowledge and freedom exonerates a
person from moral responsibility. However, one is not always exempted from moral
responsibility for result he/she does not directly intend.

EXAMPLES:

-You borrowed a phone and lost it
-In research group work, you did not do your part on the research paper.

PETER FRENCH’S PRINCIPLE OF RESPONSIVENESS ADJUSTMENT

- states that we must adopt our behavior in order not to commit the same mistake again.
Meanwhile, there are acts with double-effects, one good and one evil, wherein the pursuit of
the intended(good) result to an unintended (evil) outcome. A case-in-point is that of a doctor
who is forced to abort a fetus (evil) to save the mother’s life (good).
There are four conditions which the act of question must satisfy.

The action which produces double-effect must be good itself or at least morally indifferent.

The good effect must not come from evil in order to achieve something good is not justified.

The motive of the doer must be towards the attainment of the good-evil is permitted only as an
incidental result.

The good effect must outweigh the evil result its importance.

LEGAL LIABILITY OF WORKERS

In this chapter, we discussed the importance of knowing the extent of criminal liability.

Constitutions define how governments are to be organized, and the power and responsibilities
of those governments. Constitutions can also serve to protect individual liberties.

Statutes are created by the federal, state and local legislatures, which are comprised of elected
officials who have the power to create laws.

Common law refers to law that has not actually been codified or passed by a legislature

Public law affects society as a whole.


private law affects individuals, families, businesses and small groups.

Felony is a crime against person and property of a serious nature, while misdemeanor is an
offense of a less serious nature.

Felonies are acts punishable by law and they may committed not only by means of deceit, but
also by means of fault. There are three classes of felonies: consummated, frustrated and
attempted.

Justifying circumstances
(Ang pagbibigay-katwiran sa mga pangyayari )
are instances where a person has no criminal and civil liability. For a justifying circumstance to
be accepted, it must be pleaded and proven in court. Philippine courts are passive bodies and
only act on the information is given them.

State of necessity
Fulfillment of lawful duty/exercise of right/office

Exempting Circumstances

These are defenses where the accused committed a crime but is not criminally liable.
The basis is the lack of any of the elements which makes the act/omission voluntary, i.e.
freedom, intelligence, intent or due care.
“There is a crime, and there is civil liability but no criminal”.

Mitigating circumstances
(Nagpapagaan ng mga pangyayari)

Are factors in the commission of a crime that lessen or reduce its moral and legal
consequences. These factors are weighed during sentencing against aggravating factors that
may increase the penalty for a crime.
A mitigating factor, also known as extenuating circumstances, is any information
or evidence presented to the court regarding the defendant or the circumstances of the crime
that might result in reduced charges or a lesser sentence.
Unlike a legal defense, it cannot lead to the acquittal of the defendant. The opposite of a
mitigating factor is an aggravating factor.

Aggravating circumstances
( Nagdulot ng mga nangyari)
refers to factors that increases the severity or culpability of a criminal act.
Some generally recognized aggravating circumstances include heinousness of the crime, lack of
remorse, and prior conviction of another crime.

Alternative circumstances
(Mga Alternatibong mga pangyayari )
are those which must be taken into consideration as aggravating or mitigating according to the
nature and effects of the crime and the other conditions attending its commission. They are the
relationship, intoxication and the degree of instruction and education of the offender.

UNLAWFUL PRACTICES IN THE WORKPLACE


• Criminal Negligence Injury
Can be viewed as putting an individual's life or body in harm by disobeying a law that is in place
to protect people.
Criminally negligent people don't care about the consequences of their actions.

• Sexual Harassment
Unwelcomed sexual behavior that's offensive, humiliating or intimidating. It can be written,
verbal or physical and can happen in person or online.

•Acts of Lasciviousness
Committed when the offender commits lewdness to another person. It can be done by using
force and intimidation.

Consists of acts which are offensive to decency and good customs. They are committed publicly

What constitutes copyright
infringement in
the Philippines?

Under Philippine law, copyright infringement occurs when there is a violation of any of the
exclusive economic or moral rights granted to the copyright owner. It may also consist in aiding
or abetting such infringement. The IP Code also provides for the liability of a person who at the
time when copyright subsists in a work has in his possession an article which he knows, or
ought to know, to be an infringing copy of the work for the following purposes: (a) selling or
letting for hire, or by way of trade offering or exposing for sale or hire, the article; (b)
distributing the article for the purpose of trade, or for any other purpose to an extent that will
prejudice the rights of the copyright owner in the work; or (c) trade exhibit of the article in
public.

What are the remedies available to an owner of a copyright against an infringer?


The copyright owner can file a criminal, civil or administrative action for copyright infringement.

A criminal case for copyright infringement must be filed in the court situated in the place
where the violation occurred. The administrative suit is filed at the Bureau of Legal Affairs at
the Intellectual Property Office of the Philippines

What are the penalties provided by Philippine law for copyright infringement?

Under Philippine law, copyright infringement is punishable by the following:

Imprisonment of between 1 to 3 years and a fine of between 50,000 to 150,000 pesos for the
first offense.

Imprisonment of 3 years and 1 day to six years plus a fine of between 150,000 to 500,000 pesos
for the second offense.

Imprisonment of 6 years and 1 day to 9 years plus a fine ranging from 500,000 to 1,500,000
pesos for the third and subsequent offenses.

Liabilities of Infringement

Any person found infringing rights protected under RA 10372 shall be liable:
•To pay the copyright owner actual damages, legal costs, and other expenses, that may have
been incurred due to infringement as well as profits earned by the infringement.
The court may consider the following factors in awarding statutory damages:

•The flagrancy of the infringement;
•Whether the defendant acted in bad faith;
