I have the honor to submit before this Hon’ble Court that today (30.07.2024) at 17.30 hrs while I (P.Sivaprakassam), Sub-Inspector
of Police, Muthialpet Police Station, Puducherry received a credible information that two persons were standing at Puducherry Municipality
Solai Nagar Park, Solai Nagar North, Muthailpet, Puducherry and selling some banned narcotic drugs to youths, school college students,
juveniles and general public. In this regard, at 17.40 hrs I went to Superintendent of Police (East), Puducherry with an intimation letter. In
response to my letter Superintendent of Police (East) authorize me U/s 41 (2), 42 of NDPS Act 1985 to conduct search, arrest any person who
contravenes the provisions of NDPS Act 1985. The same was informed to the Tahsildar, Taluk Office, Puducherry to be required to his
presence in the spot. Subsequently, at 17.50 hrs Tmt. MVNV Lakshmi Soujanya. IPS, Superintendent of Police (East), Puducherry had
issued an authorization letter permitting to conduct surprise check against the sale of banned narcotic drugs and to arrest any person who
contravenes the provisions of NDPS Act 1985 and the same was obtained from SP (East), Puducherry to conduct raid and to seize the
contraband if any. At 18.05 hrs, I reached the spot along with SGHC 3637, PC 3981 and Thiru. A. Predeevi, Tahsildar, Taluk Office,
Puducherry also arrived simultaneously. Where I found two male person was standing at the above said place in a suspicious manner. On
seeing the police, that male persons had tried to escape from the place, they were apprehended with the help of Police Personnel. Due to
suspicious, I enquired their name and address in the presence of two available witnesses namely 1) Thirumal (22) S/o Ezhumali, No.58-B,
Kuber Padasalai Street, Chinnaiyapuram, Muthialpet, Puducherry, 2) Surendar (20) S/o Subash, No.02, Patchaiamman Koil Street,
Vaithikuppam. Puducherry. First they were replied prevaricate replies, after repeated questioning they disclosed their name and address as
1) Joel @ Joel Montgomery (19) S/o Emilion Sagayam Montgomery, No.29, Sonampalayam Road, Uppalam, Puducherry, 2) Avinash @
Ramalingam (19) S/o Velmurugan, No.06, Iyyanar Koil Street, Vaithikuppam, Muthialpet, Puducherry. During interrogation, they admitted
that they are in possession of some dried Ganja leaves packets in a Pant pocket and selling the same to the General Public, School students,
minors college students for earning more money. I arrested them between 18.20 hrs to 18.30 hrs in the presence of above witnesses. In order
to conduct search upon them, I have given option to the suspects that they are having the right to be searched and examined by a Gazetted
Officer or Magistrate U/s 50 of NDPS Act 1985. They opted to search by any Gazetted officer. They expressed their consent for search them
in the presence of Tahsildar, Taluk Office, Puducherry and witnesses. I conducted search on accused person Joel and found 17 packets of
dried Ganja leaves on his pant pocket One Blue Colour Apple Iphone IMEI-1 :- 353045114625401, IMEI-2 :- 353045116700608 contain one
Jio Sim card vide no: 89918690400732753219. Then I weighed 17 pockets of Ganja leaves each pocket contains 5 grams found from accused
person with the help of weighing machine which weighs 85 grams, (Out of 17 pockets 2 pockets (10gm) was taken for sample (which was
marked as ‘S-1’) remaining 15 packets (75 grams) of ganja leaves (which was marked as ‘A-1’) were packed in green cover separately, the
same was seized at 19.00 hrs in the presence of Tahsildar, Puducherry and witnesses under the cover of search and seizure form, the same
was attested by me, the witnesses, Tahsildar, Puducherry and the accused person. The left thumb impression of the accused person also
obtained on the sealed cover. Then I conducted search on accused person Avinash and found 13 packets of dried Ganja leaves on his pant
pocket One Sky Blue Colour Samsung Mobile Phone IMEI-1:- 357688950786732/01, IMEI-2 :- 358975840786736/01 contain one Airtel Sim
card vide no: CHN 0821EC 8991400912 966599799U. Then I weighed 13 pockets of Ganja leaves each pocket contains 5 grams found from
accused person with the help of weighing machine which weighs 65 grams, (Out of 13 pockets 2 pockets (10gm) was taken for sample (which
was marked as ‘S-2’) remaining 11 packets (55 grams) of ganja leaves (which was marked as ‘A-2’) were packed in green cover separately,
the same was seized at 19.40 hrs in the presence of Tahsildar, Puducherry and witnesses under the cover of search and seizure form, the same
was attested by me, the witnesses, Tahsildar, Puducherry and the accused person. The left thumb impression of the accused person also
obtained on the sealed cover. At 20.10 hrs the accused persons and seized materials were brought to Muthialpet PS and registered a case in
Cr.No: 93/2024 U/s 8 (c) of NDPS Act 1985 r/w 20 (b) (ii) A of NDPS Act 1985 and 77 of Juvenile Justice (Care and Protection of Children)
act 2015 was registered against the accused persons and taken up for investigation.

The Original FIR submitted before the Hon’ble JM-II, Puducherry. Copies are submitted to SP (East), CRB, case file and counter foil.
