MOTION REQUESTING LEAVE FOR PUBLICATION OF


DECISION OF THE ABOVE-ENTITLED CASE

COMES NOW Petitioner through Counsel to this Honorable


Court most respectfully states:

1. The Honorable Court promulgated its DECISION in the


above-entitled case on March 18, 2022, the dispositive portion of
which reads as follows:

“WHEREFORE, judgment is hereby rendered declaring the


marriage between the petitioner and respondent on May 15,
1998, at the Municipal Trial Court in Cities, Branch 7, as
NULL and VOID AB INITIO on account of respondent’s
psychological incapacity pursuant to Article 36 of the Family
Code of the Philippines.”

2. The above-mentioned Decision has been served to


respondent at his given address via registered mail, however, the
said copy of the Decision was returned to this Honorable Court.
3. Thus, the aforesaid Decision could not be served upon
the
Respondent despite efforts exerted to find his whereabouts and
the same prove to no avail.
4. As thus situated, it is deemed necessary that such
decision be served upon the Respondent by Publication under
Section 16 of Rule 14 of the 1997 Revised Rules of Civil
Procedure, so that by such service of the Decision hereof, the
same shall become final and executory.

5. This motion is intended for the speedy disposition of this


case.

WHEREFORE premises considered, this Honorable Court is


Most respectfully prayed that Leave be granted for the Publication
of the dispositive portion of the Decision issued in connection with
the above-entitled case in a Newspaper of general circulation, for
the reasons above-stated.
