PARTITION DEED
THIS PARTITION DEED is made and executed at Bengaluru on this 10th day of
October 1990.
BY AND BETWEEN:
1. Padmavathi W/o Late Srinivas, aged about 65 years, residing at 4/45, Bhavani
Layout, B.H. Post, Bengaluru - 560029.
2. Sukumari D/o Padmavathi, aged 28 years, residing at 4/45, Bhavani Layout, B.H.
Post, Bengaluru - 560029.
3. Uma D/o Padmavathi, aged 25 years, residing at 4/45, Bhavani Layout, B.H. Post,
Bengaluru - 560029.
4. Usha D/o Padmavathi, aged 22 years, residing at 4/45, Bhavani Layout, B.H. Post,
Bengaluru - 560029.
(Hereinafter collectively referred to as the "Parties")
WHEREAS, the Parties hereto are the members and coparceners of a Hindu
Undivided Family and are entitled to equal shares in the properties belonging to the
said family;
WHEREAS, the Parties hereto are the joint owners of certain immovable property
situated in Sy No. 2116, Bommanahalli Village, which is described in detail in the
Schedules appended hereto and forming part of this Deed.
WHEREAS, the said property was acquired by the parties through a partition deed
registered as No. 2284 of 1990, wherein the said property was allotted to the parties
as per the Schedules.
WHEREAS, it is acknowledged that the parties hereto are the co-owners of the said
property, each entitled to a 1/5th share over the same.
WHEREAS, it is further acknowledged that the property was in joint possession and
enjoyment of the parties since the aforementioned partition.
AND WHEREAS the Parties have decided to partition and divide the immovable
properties belonging to the said family among themselves by metes and bounds;
NOW THIS DEED WITNESSETH AS FOLLOWS:
1. The parties hereby confirm their respective ownership rights over the said
property as set forth in the partition deed.
2. The Parties hereto have agreed to partition and divide the immovable
properties belonging to the said Hindu Undivided Family, as described in the
Schedule hereunder, by metes and bounds.
3. The parties hereto have agreed to engage a qualified surveyor to demarcate
the boundaries of each party's portion as per their entitlements.
4. In pursuance of the said agreement, the Parties hereby partition and divide
the said properties among themselves in the manner set out hereinafter:
(a) Schedule A: The property bearing Survey No. 2116, measuring 10 cents,
situated at Bommanahalli Village, is hereby allotted and assigned to
Padmavathi.
(b) Schedule B: The property bearing Survey No. 2116, measuring 10 cents,
situated at Bommanahalli Village, is hereby allotted and assigned to
Sukumari.
(c) Schedule C: The property bearing Survey No. 2116, measuring 10 cents,
situated at Bommanahalli Village, is hereby allotted and assigned to Uma.
(d) Schedule D: The property bearing Survey No. 2116, measuring 10 cents,
situated at Bommanahalli Village, is hereby allotted and assigned to Usha.
5. The Parties hereby confirm that they have received their respective shares in
the properties as mentioned above, and they shall henceforth hold and enjoy
the same as their absolute and exclusive properties, free from all claims,
demands, and rights of the other Parties.
6. In consideration aforesaid, each of the parties hereto grant and release all
his/her undivided share, right, title and interest in the property allotted to the
other of them as aforesaid so as to constitute each party the sole and absolute
owner of the property allotted to him/her freed and discharged from all
rights, title, interest claims and demands of the other party hereto or
concerning the same but subject to the payment of all taxes, rates, dues and
duties and assessment payable to Government or Municipal Corporation or
any other public body in respect thereof.
7. Each party covenants with the other that he/she has not done any act deed or
thing whereby or by means whereof he/she is prevented from conveying and
releasing the property to the other in the manner aforesaid.
8. Each party also covenants with the other that each party will execute and get
registered, if necessary any deed, assurance or other document which may be
required for fuller and more perfectly and effectually assuring the property,
allotted to the other but at the cost and expenses of the other.
9. The Parties hereby covenant and agree to execute all such further deeds,
documents, and assurances as may be necessary or required for giving full
effect to this Partition Deed.
10. Each party hereto further covenants with the other that the latter will
hereafter hold and stand possessed of the property allotted to him/her
quietly and peacefully and enjoy the rents and profits thereof without any
suit, interruption, claim or demand by the covenanting party, his/her heirs,
executors administrators and assigns or any person claiming under him/her.
11. The Parties agree that each party shall bear their own costs and expenses in
relation to this partition deed.
