LAST WILL AND TESTAMENT OF

MR. SAILA BEHARI CHAKRAVORTY AND MRS. SANTWANA CHAKRAVORTY

THIS IS THE LAST WILL AND TESTAMENT OF US (1) MR. SAILA BEHARI
CHAKRAVORTY, (PAN: ACKPC6227H), (AADHAAR NO: 3633-1248-7542), aged
about 86 years, by nationality Indian, by faith Hindu, by occupation: Retired, son of
Late Mohini Mohan Chakraborty, and (2) MRS. SANTWANA CHAKRAVORTY,
(PAN: AGBPC2054M), (AADHAAR NO: 3797-1362-1901), (Mobile: 9433466420),
aged about 73 years, by nationality Indian, by faith Hindu, by occupation: Home
Maker, wife of Mr. Saila Behari Chakravorty, both residing at Flat No. F-3, Cluster
VIII, Sector 3, Purbachal Housing Complex, Post Office: Purbachal, Police Station:
Bidhannagar South, Kolkata-700097 (hereinafter jointly referred as “Testators”).

1. We are executing this Will being of sound and disposing state of mind and out
of our free will and we do hereby cancel and revoke all wills, codicils and
other testamentary dispositions if made by us at any time hereto before and
declare this to be our Last Will and Testament in respect of our estate, which
includes both our movable belongings and immovable properties hereinafter
described.

2. We have been married to each other since ______________, and out of our
wedlock we have been blessed with two daughters, our elder daughter, Mrs.
Mrs. Bidisha Ray, wife Mr. Soumya Ray along with our younger daughter, Mrs.
Baisali Mukherjee, wife of Mr. Anirban Mukherjee.

3. One Mrs. Basanti Dutta alias Basanti Dutt, wife of Late Anil Kumar Dutta by
way of a Deed of Transfer/Assignment dated 21 st September 2017 registered
in the Office of the Additional Registrar of Assurances-IV Kolkata and
recorded in Book-I, Volume No. 1904-2017, at Pages 372893 to 372915,
being Deed No. 190409897 for the year 2017, transferred and assigned in
favour of (1) Mr. Saila Behari Chakravorty and (2) Mrs. Santwana Chakravorty
(the Testators herein) ALL THAT one Residential Apartment No. 03 [also

known as Flat No. F/3] of BBH-1 Type, on the First Floor, measuring a
covered area or built-up area of 1,064 (one thousand and sixty-four) square
feet, more or less, consisting of three bed rooms, one living room, one dining
space, one kitchen, one verandah, two toilets, [without lift facility, having
mosiac flooring] comprised in Block No. F, forming part of the housing
complex named “Purbachal Housing Estate, Cluster-VIII”, built and
constructed upon land measuring 2.95 (two point nine five) Acres, more or
less, [out of total land measuring 37.30 Acres, more or less,] situated and
lying at Block-GA, Sector-III, Salt Lake City, Kolkata-700097, Police Station:
Bidhannagar South, within the limits of Ward No. 37 of the Bidhannagar
Municipal Corporation (previously Bidhannagar Municipality) [vide Assessee
No. 015240], Sub-Registration Office Bidhannagar (Salt Lake City), District
North 24 Parganas, West Bengal (hereinafter referred as the “Said
Property”), for the assignment consideration mentioned therein and for the
unexpired assignment of lease period of 966 years, expiring on 12 th August
2983 [out of the total lease period of 999 years, commencing from 13 th
August 1984, as contemplated in the principal lease deed, i.e. Deed of Lease
dated 13th August 1984 registered in the Office of the Bidhannagar (Salt Lake
City), District North 24 Parganas and recorded in Book-I, Volume No. 70F, at
Pages 187 to 200, being Deed No. 04930 for the year 1984 between the West
Bengal Housing Board, as the lessor therein and (1) Mr. Anil Kumar Dutta
alias Anil Kumar Dutt (since deceased) and (2) Mrs. Basanti Dutta alias
Basanti Dutt, as lessees therein, in respect of the Said Property].

4. Now, we as Testators herein intend to create a reciprocal interest in favour of


each other in respect of the Said Property by executing this Last Will and
Testament. Wherein we, the Testators herein jointly bequeath to each other,
our respective undivided 50% or ½ (one-half) share and/or interest in the
Said Property to each other on the event of demise/death of any of us. That,
in the event of death of myself, Mr. Saila Behari Chakravorty (the Testator
No. 1 herein), my undivided 50% or ½ (one-half) share and/or interest in the
Said Property shall stand bequeathed in favour of my wife, Mrs. Santwana

Chakravorty (the Testator No. 2 herein), as the sole beneficiary in respect of
such share and thereby she shall become the sole and absolute owner in
respect of the Said Property and shall enjoy all rights and privileges till her
lifetime. Similarly, in the event of death of myself, Mrs. Santwana Chakravorty
(the Testator No. 2 herein), my undivided 50% or ½ (one-half) share and/or
interest in the Said Property shall stand bequeathed in favour of my husband,
Mr. Saila Behari Chakravorty (the Testator No. 1 herein), as the sole
beneficiary in respect of such share and thereby he shall become the sole and
absolute owner in respect of the Said Property and shall enjoy all rights and
privileges till his lifetime.

5. We, the Testators herein jointly hereby declare and affirm that it shall be only
upon the occurrence of death of both of us, the Testators herein, we hereby
cause bequest of the entirety of the Said Property in favour of our younger
daughter, Mrs. Baisali Mukherjee (AADHAAR NO: 2088-5750-6232), (Mobile:
9845701971), wife of Mr. Anirban Mukherjee, presently residing at Villa No.
97 Heritage County Sy. No. 138, Heritage County, Sarjapura Road, Post
Office: Thindlu, Police Station: Sarjapur, Bangalore-562125, Karnataka, who
shall be the sole beneficiary in respect of the Said Property subject to our
respectively life interest in the Said Property but to the exclusion of our elder
daughter, Mrs. Bidisha Ray, wife Mr. Soumya Ray, who shall have no right,
title and interest over the Said Property.

6. We, as Testators herein hereby appoint our aforesaid younger daughter, Mrs.
Baisali Mukherjee, wife of Mr. Anirban Mukherjee to be the Sole Executor in
respect of our Last Will and Testament in these presents, who shall subject to
our respective demise, file necessary application for the grant of an Order of
Probate from any competent Court of Law against our Last Will and
Testament and in such regard fulfill her obligations, as maybe required under
Law.

7. We also clarify that this Will and Testament of us shall not be affected, in
case, we make and publish any other Will and Testament in respect of our
other estates/properties, if any, which are not covered under this Will and
Testament.

8. This Last Will and Testament by us can be altered or revoked only upon our
joint action and execution by executing a Codicil thereof or signing a
Cancellation of this Will and Testament jointly. None of us on an individual
capacity can make and alteration or revocation of this Will and Testament.

9. We are making this testament out of our free will without any coercion,
influence or misrepresentation practiced upon us from any quarter
whatsoever and after fully understanding its contents.

10. We are in perfect state of mind and senses in disposing and making this Will
with reciprocal beneficial interest against each other amongst us, which shall
be effective and operational only after the occurrence of death on any of us.
