 Terms and conditions of the Contract of Carriage

1.This consignment Note is issued by the Kintetsu world Express(India) Pvt. Ltd (Referred as "KWE"), registered under Carriage by Road Act, 2007 & Rules, 2011 and including any amendment thereof.

2.The Consignor or Consigneeshall arrange Insurance to ensure the consignment against transit risk or loss or damages in transit (including theft, pilferage & Non delivery, damage caused by strikes, riots & civil commotion, acts of God, accident, hijacking, rain,
fire, breakage & leakage).

3.KWEshall be entitled to effect transshipment where ever necessary & shall have right to cross-over the goods to any agent, associate through other mode of transport service for delivery at the destination on their behalf.

4.The Consignor/Consigneewarrants that he is the owner or the authorised agent of the owner of goods transported hereunder.

5.KWE receives the goods or package "said to contain basis" and further consignor undertakes responsibility that goods or package handed over to KWE for transshipment are of merchantable quality. KWE is nowhere liable for quality, quantity, description of
goods, packaging or correctness of invoice, packing list or any declaration or any related document. All consignment are booked by KWE by the Consignor in good faith, the consignment shall not contain any such items or material which are prohibited or
contraband by law. In the event of the consignment as said above items or materials, the consignor/consignee agrees and undertakes to indemnify the KWE for any damage, loss or penalty caused to KWE. Shipments are subject to inspection by the Department
of Transportation, Department of GST,and/or state police or any other Govt. authority, and if explosives, arm & ammunition, flammable products, narcotics, alcoholic beverages, jewelry, bullion, furs, cash, pets, plants, or contraband etc. are found in the
consignment, if circumstances appear KWEshall discard such article at Consignor/Consignees expenses and shall indemnify KWE.

6.The transit terminates on arrival of consignment at Consignee address/delivery address mentioned in Consignment Note & Consignment Note is signed (POD) by Recipient. Signed POD copy is prima facie evidence that goods have been delivered. In case any
damage apparently visible in the package same is to be remarked in the PODcopy and damage or loss intimation to be given to KWEin writing within 48 hours from the date receipt of goods.

7.In case of the consignee refusing to accept the delivery of the shipment, the Consignor wants the consignment back to the origin or advising that to be delivered to some other destination, then re-booking charges will be levied over & above the demurrage
charges and all the other charges that have already been incurred should be borne by the Consignor/Consignee.

8.If the consignee fails to take delivery of any consignment of goods with in a period of 15 days (6 hours or within shelf life period whichever is less in case of Perishable goods) from the date of notice/written intimation/e-mail given by KWE, such consignment
shall be deemed as unclaimed and KWEis entitled to sell such unclaimed consignment to realize all dues by issuing 15 days (6 hours or within shelf life period whichever is less in case of Perishablegoods) cause notice before making sale.

9.KWE is not responsible for any kind of delay or non-delivery of goods, or of loss to consignor/consignee or damage caused to the products due to existence of Force majeure which is beyond the control of KWEsuch as but not limited to (a). Act of god, (b). war
or act of public enemy, (c). Riots and civil commotion, (d). Strike, lock out or labour disturbances, (e). Arrest, restraint or seizure under legal process, (f). Order, restriction imposed by Govt.

10.The Courts of Bangalore has exclusive jurisdiction irrespective of cause of action elsewhere.
