QUESTION 1

Both common and civil legal systems have its advantages and disadvantages. In your opinion
which one is a better system, give TWO (2) reasons for your answer.
(10 marks)

QUESTION 2

Ramly is a big fan of Akira Toriyama, a famous Japanese manga artist, well known for
creating the manga series Dragon Ball. Last month, he managed to attend the spld out
exhibition of Toriyama’s art work at Japanese Arts Gallery in Petaling Jaya. Fascinated by
Toriyama’s work, Ramly spend all his saving on the original first print of Dragon Ball poster
which was worth RM20,000. The Gallery sales executive, Marimoto, promised to deliver it
within a week. However, he failed to do so. Ramly is contemplating a legal action against the
Gallery.

A) Advice Ramly if he has a locus standi to take legal action against Marimoto. (10 marks)

B) Suggest the most suitable remedy for him to claim. (5 marks)
