Module 1: NBC Rules 1-6

Presidential Decree 1096 (National Building Code of the Philippines)

Rule 1

Purpose of the Building Code

 To provide a framework of minimum standards and requirements for all buildings in


order to regulate their location, design, quality of materials, construction, and use.

Scope of application

 The National Building Code applies to the design, location, siting, construction,
alteration, repair, conversion, use, occupancy, maintenance, moving, demolition of and
addition to public and private buildings, except traditional dwellings and BP 220 projects.

Definition of terms

Construction

All on-site work done from site preparation, excavation, foundation, assembly of all the
components and installation of utilities and equipment of buildings.

Addition

Any new construction which increases the height or area of an existing building.

Alteration

Construction involving changes in the materials used, partitioning, location/size of


openings, structural parts, existing utilities and equipment without increasing the area of the
building.

Renovation

Any physical change made on a building to increase its value, utility and/or to improve its
aesthetic quality.

Conversion

A change in the use or occupancy of a building.


Repair

Remedial work done on any damaged or deteriorated portion of a building

Demolition

The systematic dismantling or destruction of a building, in whole or in part.

Ancillary building

A secondary building located within the same premises, the use of which is incidental to
that of main building.

Rule 2

Administration + Enforcement

The Secretary

 Secretary of DPWH
 Duties include:
o Policy making
o Memorandum circulars
o Prescription of fees
o Appointment of building officials in all municipalites

The Building Official

 Tasked with the enforcement of the Code in his jurisdiction


 Issues, denies, suspends, and revokes permits
 Undertakes inspection of buildings
 Acts on claims

Fees

 The DPWH Secretary prescribes the fees


 The Building Official collects the fees

Fee exemptions
 Public buildings
 Traditional family dwellings
o A dwelling intended for the use by one family and constructed of native materials
(bamboo, nipa, logs, lumber), the total cost of which does not exceed PHP15,000

Prohibited acts

 Proceeding with work without a permit


 Unauthorized deviations from the drawings during construction
 Non-compliance with work stoppage order
 Non-compliance with order to demolish
 Use of a building without securing a Certificate of Occupancy
 Change in use without the corresponding Certification of Change of Use
 Failure to display the Certificate of Occupancy
 Change in type of construction without permit

Dangerous buildings

1. Structural hazard
2. Fire hazard
3. Unsafe electrical wiring
4. Unsafe mechanical installation
5. Inadequate sanitation and health facilities
6. Architectural deficiency

Options for dangerous buildings

1. Repair
2. Vacation
3. Demolition

Rule 3

Permit
 A written authorization from the Building Official to proceed with work (construction,
demolition, alteration, renovation, etc.) issued to an applicant only once the plans and
other documents are found to be compliant to the Building Code.

When is a permit required?

 Before constructing, altering, repairing, converting, moving, adding to, or demolishing a


building.

Building permit exemptions

 Minor constructions
 Minor repair works

Minor constructions

 Minor structures, 6 sqm. Or less in area, detached from other buildings, for private use
only.
o Example: sheds, poultry house, greenhouses
 Open terraces or patios not exceeding 20 sqm.
 Window grilles
 Garden pools 500mm deep or shallower
 Garden masonry walls not exceeding 1.20m in height

Minor repairs

 Repairs not involving structural members


 Repairs of non-load bearing partition walls
 Repair not involving addition or alteration
 Repairs of doors, windows, floors, fences and walls
 Repairs of plumbing fixtures.

Permit requirements

 Permit application form


 Ancillary and accessory permits
 If lot is owned:
o OCT or TCT
o Tax declaration
o Current real property tax receipt
 If lot is not owned:
o Contract of Lease or Deed of Absolute Sale
 Five sets of plans and specs, signed and sealed by duly licensed professionals

Liability clause from the Civil Code


 Article 1723 of the Civil Code states:
o The engineer of architect who drew up the plans and specifications for a building
is liable for damages if within 15 years from the completion of the structure, the
same should collapse by reason of a defect in those plans and specifications, or
due to the defects in the grounds.
o The contractor is likewise responsible for the damages if the edifice falls, within
the same period, on account of defects in the construction or the use of materials
of inferior quality furnished by him, or due to any violation of the terms of the
contract.
o If the engineer or architect supervises the construction, he shall be solidarity
liable with the contractor.

Certificate of Occupancy

 Shall be secured before using occupying a building


 Requirements
o Certificate of Completion
o Logbook
o As-built plans and specs
o Building inspection sheet

Expiration of permits

 Construction does not commence within 1 year from date of issue


 Construction does not resume 120 days after suspension or abandonment of work

Non-issuance, suspension, revocation

 Errors in plans and specs


 Incorrect or inaccurate data declared
 Non-compliance with the Building Code

Inspection + supervision

 The owner of the building must engage the services of a licensed architect or civil
engineer to undertake the full-time inspection and supervision of the construction.

Rule 4

Types of construction

Type I

 Wood construction WOOD NO FIRE RESISTANCE


Type II

 Wood construction with fire-resistant materials


WOOD ONE-HOUR FIRE RESISTANCE
 One-hour fire-resistive throughout

Type III

 Masonry and wood construction WOOD ONE-HOUR FIRE RESISTANCE


 One-hour fire resistive throughout

MASONRY INCOMBUSTIBLE EXTERIOR WALLS
 Incombustible exterior walls

Type IV

 Steel, iron, concrete, or masonry construction ONE-HOUR FIRE RESISTANCE


 One-hour fire resistive throughout
NO WOOD INCOMBUSTIBLE EXTERIOR WALLS
 Incombustible exterior walls
INCOMBUSTIBLE INTERIORS
 Incombustible interiors (ceilings, walls)
(CEILINGS, WALLS)
Type V

 Four-hour fire resistive throughout


NO FOUR-HOUR FIRE
 Structural elements of steel, iron, concrete or masonry RESISTANCE
WOOD
Rule 5

Fire Zone

 An area within which only certain types of construction are allowed, based on their
occupancy, type of construction, and resistance to fire

Fire zone designations

1. Non-fire restricted zones


 All types of construction allowed
2. Fire restrictive zones
 Type I constructions NOT allowed
3. Highly fire restrictive zones
 Types I, II, and III NOT allowed

Fire resistive requirements

Fire resistive rating

 The degree to which a material can withstand fire


 Usually expressed in the form of a time period rating (how long a material can withstand
being burned)
