Task 1: Investigating causes of the accident


1: Based on the scenario only, what management failures could have contributed to this
accident?
Answer: In the given scenario accident was caused by management's continuous negligence.
They many times neglected to take action to ensure the health and safety of its employees. In the
scenario following management failures contributed to this accident:

 The company employed no competent staff to perform the task accurately, vulnerable workers
(young and inexperienced) employed for task.
 The workers has High work load as the angry driver told me that not enough people being
allocated to large or difficult jobs. Therefore the limited workers work under stress.
 The management poor commitment contributed the accident, after accident when they called
the office for help, the manager instructed to try their best, no one else could help at the moment.
 The company prefer profitability/operations target over worker’s health as when the management
informed about the accident no one else help the injured worker; but a second work party was send
to the property to finish the removal.
 The company has no appraisal policy, in the scenario Management is completely aware of the
difficulties that employees face but even then no one appreciate them on the successful
completion of task. Therefore workers have low morale.
 In the scenario the angry driver told that the employees are provided with No sufficient
consultation that’s why the accident happened.
 There was no specific SSW (safe system of work) for domestic removal as the workers
working in client's residence has restricted access and driveway with gravel, for which no
system was available.
 Company has No documents review policy e.g. Risk Assessment. Therefore no record of
previous hazards and their control measures available, to deal the current situation.
 Many near misses occur from the young workers, but no lesson learnt from them.
 Management pays no attention to worker’s claims. Workers protested/complained about
working conditions, but were never taken seriously.
 Internal review carried by manager but no external review.
 When I was on leave, no spare HSE advisor to guide the management.

Task 2: Reporting the accident


(a) Why must this most recent accident be reported by the employer to the competent
authority?
Answer: The accidents deadly or not, must be communicated to the concerned legal authorities. The
accident in the scenario involves the young porters’ serious ankle fracture due to fallofheavy load.
The young porter admitted to hospital that’s-why it should be reported. The further reasons are:
 To the workers fractured ankle goes for surgery and this is the legal requirement by Law to report
serious worker injuries.
 To the accident reported, the competent authority could guide the company to identify the level of
investigation required for this particular accident.
 To the reported case will help the authority to generated real-time data base and safety statistics.
This will help to improve or update previous health and safety regulations.
 To the fulfil legal required it is necessary to report to the enforcing authority at to the earliest.
 This is responsibility of the employer to report the fatal accident including major injury and lost
time injury to the competent authority.

(b) How would you notify this most recent accident as the employer?
Answer: As an employer, this is a recent accident needs to be notified as well as keeping a
record to the accident, to the fallowing information need to be including in the record and the
same need to be notified through the following:

 Name and address to the injured porter.


 Date and time to the accident.
 Location to the accident.
 Detail to the injury.
 Detail to the treatment given.
 Detail of the person completing to the record.
 Witnesses, name and the contact details.
 Description of an event to the causing injury.
 Signatures.
 Detail any equipment and the substances involved.

Task 3: Suitability of the generic risk assessment


3: Based on the scenario only, comment on the company’s approach to assessing health
and safety risks.
Answer: The following is a commentary on the company’s approach to assessing health and
safety risk on a scenario basis.
 It is legal duty of the employer to the carry out suitable and sufficient risk assessment are
the primary management, it is legal requirement for any employer and should be document.
 The risk involved in manual handling, platform trolleys and sack borrows need to be
analyzed and sufficient control measures to be provided considering the number of porters,
drivers as per the heavy task and saprate risk assessment to be prepared as per to the
activity involved.
 There is also a near-miss incident and fallowing by an accident previously in the company,
but risk assessment is not reviewed, risk assessment must be reviewed following an the
accident, incident and ill-health event in order to verify if the control measures and level of
evaluated risk where appropriate or require amendment.
 Once completed a risk assessment should be reviewed periodically, and in any case when
to the either the current assessment is no longer valid and if any stage there have been
significant change to the specific activity.
 A suitable and sufficient risk assessment should be carried out before a particular activity or
task being carried out to eliminate reduce of or suitable control any associate risk to a health
and safety or wellbeing of persons involved to the task but management fails to the same.

Task 4: Improving organisational health and safety culture


4: What appear to be the positive indicators of health and safety culture at the removals

information from the scenario.
Answer: The following indicators on the health and the safety have been observed to the
Removals Company:

 Induction training also included health and safety matters and first aid arrangement and
information on relevant policies which is a positive indicator of health and safety culture.
 The induction training session has been done for new workers involving a tour to the both
sites (warehouse and compound site).
 Fully stocked first aid boxes are kept at each site and the contents are replenished of the
required.
 Two trained first aiders each at warehouse, office site have been allocated which is a
positive aspect toward health and safety.
 Two the driver must use banksman when manicuring to assist to the movement of vehicles
safely and a safe work system has been maintained which is a positive indicator of health
and safety.
 Frist aid work course and a one-day refresher course is attended by both first aiders who
are located at the ware house and the office site.
 The warehouse is well laid out with clearly marked pedestrian walkways and the forklift
routes are clearly visible.
 Manual handling training is the given by the third party company to a involved workers in the
manual handling.
 Worker are taking care of the cleanliness and tidiness in the ware house while working and
maintaining good housekeeping.
 The manager also visits the warehouse site every day to carry out the daily inspection to
check on capacity levels and directly speak with workers which shows two way positive
communication.
 Proper inspection is done by the manager to the workplace which shows the positive
indicator of health and safety.
 Management is ready to the carry out of investigation of this accident and provide a report to
the helps ensure to that lessons can be learned and the similar to the avoid in the future.
 The driver has reported to the incident to the manager at the earliest shows the positive
indicator of health and safety.
 The management responsible to the conducting frequent internal audits, is also positive
indicator of the health and safety.

would you consider in your review to determine if first-aid provision is realistic and

specific first aid equipment.
Answer: The following factors to the need to be considered of first aid arrangement reviewed at
the removals company are as following:

 There was should be a written procedure when any accident and the injury happens, how to
informs to first aider and first aider should be a mobile phone by the organization so at the
time of emergency can arrange the ambulance to the without losing the time.
 Considering the back and neck pain, brushes, etc. as there the plenty of work associated
with manual handling in the warehouse.
 The warehouse has some young and inexperienced workers so first aid arrangements must
also be arranged considering the vulnerable staff.
 There must be adequate first aider coverage, including to the night shift and weekends if
work is going on the inside the ware house.
 There should be at least 1 extra trained first aider in case of an existing first aider is absent
or on annual leave.
 Frist aid arrangements must be done according to the distance of the hospital and the
location to the warehouse.
 Enough required the number of fully stocked first aid should be provided at the visible

Answer: The remote location is an important issue to consider when determining realistic and
proportionate first aid provision, workplace with easy reach of the emergency services might
provide minimal cover but in remote areas where emergency services can take time to reach,
must have adequate facilities including skilled person available in this case.

 Each and every removal vehicle should have a fully stocked first aid boxes to help in case of
emergency in remote areas.
 The organization must be provide mobile phone to drivers and porters with emergency
contact number to contact quickly in case of any emergency occur.
 To the company must be provide first aid training for all the drivers so those driver csn help
at the time of the emergency while working in the remote areas and the organization should
be provide a first aid kit in every vehicle.

company that should be a cause for concern.
Answer: According to the scenario based, To the results of the company that should be
cause of the concerns as follows:
 In the scenario, Management is not committed to controlling accident rates because 2
accidents occur, and injuries and near miss are occurring very frequently.
 In the scenario describe, Staff turnover rates, absenteeism and sickness rates which are
consistent with report of increased musculoskeletal disorders are getting high in the
company is cause of concern.
 It can be seen from scenario, many protest were done by the workers complaining about
working conditions was never taken seriously by the company management.
 Scenario depicts that, After the near miss in the removal company management did not
appoint competent people to their job because there are many young and inexperienced
porters are present to the company.
 To the near miss incident there was not investigated by the manager and its ignorance
might cause to the accident.
 Management did didn’t concern have a proper safe system of the work and the risk
assessment as it was not reviewing for the last five years.
 Because to the earlier accident high compensation was claimed by the injured worker but
there is no improvement shown by the management.
 Scenario demonstrates that’s, The removal company didn’t concern about workers health
and safety so that’s legal authority gives improvement notice of the company, if then more
accident occurs in the future there may to be a prohibition and high penalty issue to the
company.
 Because to the frequent accident, medical costs and subsequent investigation incur greater
costs to the company.

Task 6: Role and responsibility of the manager


6: Within the health and safety management system, the role of manager has specific
health and safety responsibilities for assessing removal requirements. What could be
done to help ensure the manager is more effective in carrying out their health and safety

using relevant information from the scenario.

Answer: To the effective to the manager's roles and the responsibilities about health and safety to the
removal company are as follows:

 The manager is effective in reviewing to the documents of generic risk assessment and safe system,
of the work for the removal company on the domestic premises.
 The manager must conduct a weekly meeting with the workers and listen to their issues and
concerns about health and safety and their feedback be appreciated.
 Absenteeism and sickness rates need to the analyzed by the manager and the evaluate the reason
behind this is the reduce and improve to the working condition about health and safety.
 This is also a managers responsibility to appoint to the required vacant position in the company to
the minimize to the workload of the workers.
 It is also the manager's roles and responsibility to conduct and associate with the HSE advisor

condition and the should be keen to solve their issues as soon as possible.

works and the resolved their issues as soon as possible without ignoring them.
 To the role of the manager is avoid accident and civil claims as it will be a huge burden and could
face financial losses and the lawsuits.
 The manager must be focus of and prioritize workers health and safety issues rather than giving
pressure about production and completion of the work.

Task 5: Discussing moral reasons for managing health and safety

Answer: Duty of care is the moral duty towards the other human who is working with you or is
working on the premises with you or in any sense you are together, that they don’t get hurt and
you should be willing to do anything to help. It is the moral duty of a company to not be letting
employees become ill or injured in the workplace, this can be only achieved by providing a safe
work, and I felt that the company is less concerned about to the health and safety:

 The injuries and illness from working can demoralize to the employees so maintaining a safe
work environment at the workplace is mandatory.
 Complaints of the worker about to the working condition are not taken seriously by the
company and high turnover of the workers lead to the decrease in the worker's morals.
 The employer's moral responsibility is to take for the care of the worker on humanitarian
grounds.
 The employer should be given to the health and safety to the workers rather profits and the
targets.
 To the Workers sickness and the absenteeism rates are the getting high like workers are
complaining of musculoskeletal disorders.
 Work related injuries and illness may result in the trust issues between workers and
employers decrease in motivation may lead to low productivity and low staff turnover.
 Not enough workers were being provided for the heavy and the difficult task by the
management, when the more needed complete difficult job then the employer need to
provide more workers for assistance.
 To the impact on worker’s family, the effect of the accident will not stop on the worker only,
but also his family, because they will directly be affected physically, emotionally and
financially.
 The Poor safety culture, safety culture is norms, ideas and customs regarding safety in a
specific organization, which can be negative and positive. A negative safety culture is
morally unacceptable, as the injured worker may be ceased from working for a while or even
permanently.
