CONTRACT TO SELL
KNOW ALL MEN BY THESE PRESENTS:
This Confract to Sell, refered to herein as the CONTRACT, executed and entered by
and
between:
RCD LAND, INC., a corporation duly organized and existing under and by virtue of
the laws of
the Republic of the Philippines, with office address at 5" Floor Suites 501 and 505
Chateau de Baie
Condominium Roxas Blvd. Cor. Airport Road, Parafiaque City represented by its
President, ROLANDO C.
DELANTAR, hereinafter referred to as the SELLER;
-and -
RIO JOY M. BARTOLOME single of legal age, Filipino citizen, with residence and
postal address
at Sgt. Danti St. Aplaya-Binakayan Kawit Cavite hereinafter referred to as the
BUYER;
WITNESSETH: That
WHEREAS, the SELLER is the registered owner/developer of that certain parcel of
land, refered
to herein as the PROPERTY, identified as Lot 8 Block 5 RCD ROYALE HOMES PH 1-B,
Brgy. Kalubkob,
Slang Cavite, containing a lot area of Seventy Five (75) square meters, more or
less; and a residential
house to be constructed thereon (DAFFODIL — SEMI COMPLETE) excludes ceiling, floor
tiles, partition,
hand rail, interior paints, carport, fence and landscape), containing a floor area
of Fifty Four (54)
square meters, more or less;
WHEREAS, the BUYER, after inspecting the PROPERTY and finding the same suitable for
her/his
intended use or purpose, has offered fo purchase the same from the SELLER, per
her/his Reservation
Application dated August 16, 2014, a copy of which is hereto attached and hereby
made an integral
part hereof;
WHEREAS, the SELLER, based on the representations of and documents submitted by the
BUYER,
has found her/him qualified and capable of purchasing the PROPERTY and has accepted
the
aforesaid offer;
NOW, THEREFORE, for and in consideration of the foregoing premises, the SELLER
hereby
contracts and obligates itself to sell the PROPERTY to the BUYER, who likewise
contracts and obligates
herself/himself to purchase the same, under the following terms and conditions:
1) CONSIDERATION & MANNER OF PAYMENT: the total consideration, or contract price,
for the
PROPERTY, shall be One Million Two Hundred Fifty Thousand Pesos
Only(Php1,250,000.00), Philippine
Currency, exclusive of additional improvements amounting to Two Hundred Sixty Nine
Thousand Five
Hundred Pesos (P269,500.00) and Miscellaneous Fees amounting fo One Hundred Twenty
One
Thousand Five Hundred Sixty Pesos (Php121,560.00) which shall be paid in full by
the BUYER to the
SELLER at 5" Floor Suite 505 Chateau de Baie Condominium, Roxas Boulevard corner
Airport
Road Parafiaque City and without the necessity of demand or services of a collector
in the
following manner:
a.) Four Hundred Fifty Six Thousand and Sixty Pesos (Php456,040.00), Philippine
Currency
representing full down payment upon execution of this contract;
b.) The balance of One Million One Hundred Eighty Five Thousand Pesos
(Php1,185,000.00),
Philippine Currency. shall be paid in One Hundred Twenty (120) equal consecutive
monthly
installments, amounting to Nineteen Thousand One Hundred Eighteen Pesos and Twenty
Centavos (Php19,118.20) inclusive of interest at the rate of Fifteen (15%) per
annum with the
first installment due and payable on March 30, 2016 and every 30" day of the month
thereafter until full payment. Non-delivery of a copy of this Contract to Sell to
BUYER shall not
delay the commencement of the payment of the monthly installment. Interest shall be
computed on a daily basis. If the due date falls on a non-banking day, the monthly
installment
shall be paid on the last banking day immediately preceding the non-banking day.
