This contract of lease is between Don Nicholas B. Chua, owner of Powertruck Negros Prime Industrial Trucks and Motors Corp., as the lessor, and Cubixx 13 Builders Corporation, represented by Jean Paul Alexander B. Ortega, as the lessee. The lessor agrees to lease a prime mover identified by plate and motor numbers to the lessee. The lessee agrees to use the equipment exclusively for three construction projects. CONTRACT OF LEASE

KNOW ALL MEN BY THESES PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Bacolod, 8th day of February 2023 by and
between:

DON NICHOLAS B. CHUA, owner of POWERTRUCK NEGROS PRIME INDUSTRIAL TRUCKS AND MOTORS
CORP., of legal age, married and a resident of Brgy. Banago, Bacolod Cit, hereinafter reffered to as a
LESSOR.
and
CUBIXX 13 BUILDERS CORPORATION, operating under and by virtue of the laws of the Republic of the
Philippines, and with office address at Blk32 Lot 11 Josefina St., Eroreco Subdivision, Bacolod City,
represented by its Authorized Managing Officer, JEAN PAUL ALEXANDER B. ORTEGA hereinafter called
the LESSEE.

WHEREAS, the LESSOR is the owner of the Prime Mover with Plate No. _____________Motor No.
_______________;

WHEREAS, the LESSOR agrees to lease-out the above-mentioned equipment to the LESSEE and the
LESSEE is willing to lease the same.

NOW THEREFORE, for in consideration of the foregoing lease contract agreement, the LESSOR leases
unto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASES AGREEMENT, subject to
the following:

That the following equipment hereby leased shall be used exclusively by the LESSEE for its projects,
specifically for the following projects:

 Construction of Tuburan- Takas Road, Enrique B. Magalona, Negros Occidental (23GK0164)


 Construction of Road, Hacienda Gloria, Brgy. Conception, Talisay City, Negros Occidental
(23GK0166)
 Construction of Road, Brgy. Conception, Talisay City, Negros Occidental (23GK0167)

It is hereby expressly agreed that if at any time the equipment is used for other purposes, the LESSOR
shall have the right to rescind this contract without prejudice to its other rights under the law.

This CONTRACT OF LEASE shall be valid and binding between the parties, their successors-in-interest and
assigns.

IN WITNESS WHEREOF, parties herein affixed their signatures in the date and place above written.
