ADR HOC, India


As the name suggests, ADR HOC is an
organization formed for the promotion of
Alternate Dispute Resolution (ADR) in
India. ADR is an extensive field having a
variety of alternatives for individuals willing
to resolve their disputes to choose from,
ranging from Arbitration, Mediation,
Conciliation, Negotiation, etc. It is becoming
a widely accepted mode of dispute resolution.
The organization aims to create awareness,
facilitate extensive research, and explore
possible career options in the field of ADR.
We regularly conduct national as well as
international webinars, conferences, panel
discussions with eminent industry experts,
certificate courses, and provide internship
opportunities. We are a one-stop avenue for
all ADR aspirants.
ADR BAR, India
ADR BAR is a trust registered under a Trust
Deed dated 15.09.2022 with its office at Goa,
India. It is a unique socialistic, holistic, and
reforming initiative to create an exclusive
platform for ADR practitioners, aspirants,
and beneficiaries for revamping, improving,
promoting, and developing ADR in our
country and make it the “PREFERRED”
mode of dispute resolution. It envisages on
achieving the aim of creating a unified
platform to bring both the ADR practitioners
and ADR users/ beneficiaries together,
thereby facilitating easy and efficient access to
dispute redressal options. It seeks to
proactively conduct research and formulate
effective measures for promotion,
development and improvement of ADR in
our country to make it at par with
international standards. It plans to create a
pool of trained and qualified arbitrators,
mediators and practitioners.

Day 1
1. Introduction to Mediation as a method of
dispute resolution, History of Mediation in Indian
Vedas and Origin of Mediation, Roots of
Mediation, concept, Importance and Significance
of Mediation, Why Mediation over other methods
of dispute resolution, Process of Mediation,
Qualities of a Mediator, Importance of
Confidentiality. Mediation: Evolution and
Access to justice during pandemic

2. Mediation: Indian Scenario and Evolution of


Mediation
How are the matters referred into Mediation?
What type of matters are referred to Mediation?
How is the dispute tried to be resolved? How
effective are the settlement agreements derived
from a Mediation? How has Mediation evolved
overall especially during the pandemic? Promotion
of Mediation and Online Mediation a way
forward, need for new rules, focusing on need for
mediation centers.

3. Psychology of Mediation
Day 2
4. Approaches to Mediation: Facilitative,

Evaluative and Transformative Mediation.


5. Stages of Mediation: Problem-defining,
Problem-solving and Settlement Stages. Opening
Session, Joint Sessions and Private
Sessions/Caucus. As a Mediator how to gather
information from the parties, analyzing issues and
interests of the parties, framing of issues,
generating options and proposals, resolving
disagreements, reaching agreement. BATNA for
each party in Mediation.

Day 3
6. Stages of Mediation with Role Play: Problem-
defining, Problem-solving and settlement stages.
Opening session, joint sessions and private
sessions.
7. How to negotiate with the parties, techniques
of negotiation, effective questioning and listening

8. Practical Session on Opening Statement (how
to draft and deliver opening statement)
9. Practical Session on ‘ Asking Effective Question’
Day 5
10. Why Mediation as a dispute resolution
mechanism? Role of lawyers in Mediation; Court
annexed Mediation; Mediation in workplace;
Mediation in family disputes

11. How to be a good Mediator? (The qualities


required, what a Mediator should do, how to carry
forward the dialogue between two parties, how to
communicate, opening statement of Mediator)
building rapport with the parties and how to
communicate with the parties. The art of effective
questioning as a Mediator.

12. Settlement Agreement in Mediation
