This content includes the introduction to law, definition of law, kinds of law and its characteristics. It will
introduce you to some legal knowledge and its specific issues. Defining terminologies that supplements
your intellectual ability to make it broader.

IV.LECTURE NOTES
1.DEFINITION of LAW
 The legislative pronouncement of the rules w/c should guide one’s actions in society. The
aggregate of those rules and principles of conduct promulgated by the legislative authority,
established by local custom (Gifis Law Dictionary, Third Edition).
 The whole system or set of rules made by the government of a town, state, country, etc.
2.KINDS of LAW
a. Mandatory – it commands that something to be done.
b. Prohibitory – it commands that something should not to be done.
c. Permissive – it commands that what it permits to be done should be tolerated or expected.
3.FOUNDATIONS and CHARACTERISTICS of LAW
Law is founded and created by human intellect. The law is intended and created by man to serve
man and the society where he lives. They regulate the relation of human beings within a society by
defining the rights and imposing restrictions on those rights. The characteristics of Law are:
a. It is a rule of human conduct
b. Promulgated by competent authority
c. Obligatory
d. And pf general observance

3.1 Divisions of Law


Law is divided into two (2) general groups:
a) Divine Law – God himself is the legislator and is the one who promulgates the law
b) Human Law – promulgated by man to regulate human relations. This law is in turn
divided into two (2) main classes and these in turn are subdivided as follows:
3.1.1General or Public laws:
a) International Law, or that w/c governs the relation between nations or states, that
b)
c) is, human being in their collective concept.
d) Constitutional Law, or that w/c governs the relation between human beings as a
citizen of state of the governing power.
e) Administrative Law, or that w/c governs the relation between the officials and
employees of the government.
f) Criminal Law, or that w/c guaranties the coercive power of the law so that it will be
obeyed.
3.1.2 Individual or Private Laws:
a) Civil law, or that w/c regulates the relation of individuals with other individuals
for purely private ends.
b) Mercantile Law, or that w/c regulates the special relation produced by
commercial transactions
c) Procedural Law, or that w/c provides for the means by w/c private rights may be
enforced.
