S.O. 2723(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Road
Transport and Highways number S.O 78 (E) dated 4th February, 1999 & S.O. 196(E) dated 6th March, 2000 issued under
section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted
the stretch from km 93.000 to 479.000 of National Highway number 2 (Haryana/Uttar Pradesh border to Kanpur section)
and km 8.000 to km 24.000 (Agra-Gwalior section) of National Highway number 3 respectively in the State of Uttar
Pradesh to the National Highways Authority of India (hereinafter referred to as the “Authority”);

And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National
Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules,
2008, vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R
15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013,
G.S.R 26(E) dated 16th January, 2014, G.S.R. 831(E) dated 21st November, 2014, G.S.R. 02(E) dated 19th December,
2014, G.S.R. 220 (E) dated 23rd March, 2015 & G.S.R. 585 (E) dated 8th June, 2016 for collection of fee for the use of
sections of national highways, permanent bridge, bypasses, tunnels;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of
1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published
vide G.S.R 838(E) dated 5th December, 2008 and amended from time to time (hereinafter referred to as the said
“Rules”), the Central Government, hereby notifies that there shall be levied and collected fees on mechanical vehicles for
the use of the Four lane Bypass to Agra City (having Design Chainage km 0.000 to km 32.800) taking off at km 176.800
of NH-2 (km 0.000 of bypass) and merging at km 13.030 of NH-3 (km 32.800 of the bypass) in the State of Uttar
Pradesh (hereinafter referred to as the “said section’), on the Type of Vehicles specified in column (1) at 150% of the
rates specified in columns (2) (hereinafter referred to as “base rate”) of Table 1 below for bypass costing 10 Crores or
more, having net length of 31.995 km & at 100% of the base rates specified in columns (2) of Table 1 below for
equivalent length of 8.050 km of structure (having more than 60 m length)] and authorizes the said Authority to collect,
either through its officials or through a contractor, the said fee on and from the date of actual implementation or
publication of this notification in the Official Gazette, whichever is later.

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the length
specified for such Toll Plaza:

3. In addition to above, the following fee shall also be due and payable for the use of the following structures
having length more than 60 m at the following toll plaza(s), by converting the length of structures into an equivalent
length of highway by multiplying the length of such structures by an equalization factor of 10:

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes
and resides within a distance of twenty kilometres from the toll plaza is Rs. 235.00 (Rupees Two Hundred Thirty Five
only) for the year 2016-17 and is subject to revision every year as per the provisions of the National Highways Fee
(Determination of Rates and Collection) Rules, 2008.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the
fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road
is available for use of such commercial vehicles.

7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the said
Rules, shall not be permitted to use the National Highway for crossing the Toll plaza until the excess load has been
removed from such mechanical vehicle. The driver or owner or a person in-charge of such overloaded mechanical
vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll collecting
agency, equal to ten times of the fee applicable to such category of mechanical vehicles under the said Rules.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles,
service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual
amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the
basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the
same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is Rupees 685.00 crores. The capital cost is subject to variation as the
activities of land acquisition, utility shifting, tree cutting, completion of balance works, etc. are yet to be completed. The
final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through
user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be
revised annually in accordance with the said rules.
