This document is a deed of partition and sale between Gerald Maglangit Tolentino (and heirs of Elsita Maglangit) as vendors and Fernando M. Loncion and Florisa C. Loncion as vendees. They have agreed to divide the property equally among themselves and the vendors have agreed to sell 200 square meters to the vendees for 40,000 Philippine pesos. KNOW ALL MEN BY THESE PRESENTS:

This DEED OF PARTITION WITH DEED OF ABSOLUTE SALE is made by and


among:

GERALD MAGLANGIT TOLENTINO, single, (FOR HIMSELF


and ATTORNEY-IN-FACT OF HEIRS OF ELSITA MAGLANGIT namely,
ROSEMARIE MAGLANGIT TOLENTINO-GONZAGA, married, MA.
REGINA MAGLANGIT TOLENTINO-REMOTIN, married, RENZ
MARION MAGLANGIT TOLENTINO, single, GLEEN MAGLANGIT
TOLENTINO, single) of legal ages, Filipinos and all residents of Opol,
Misamis Oriental, copy of the SPECIAL POWER OF ATTORNEY is hereto
attached and marked as ANNEX “A”, hereinafter known as the VENDOR;

FERNANDO M. LONCION and FLORISA C. LONCION, husband


and wife, both of legal ages, Filipinos and residents of Patag, Opol, Misamis
Oriental, hereinafter known as the VENDEE;

WITNESSETH

That the above – mentioned persons are the absolute and registered co-owners of a
parcel of land situated in Patag, Opol, Misamis Oriental covered by TRANSFER
CERTIFICATE OF TITLE NO. T-47855 containing an area of TWO THOUSAND &
SEVEN (2,007) SQUARE METERS more or less known as Lot No. 7705-J, PSD-10-027429,
machine copy of title is hereto attached and marked as ANNEX “B”;

NOW THEREFORE, the PARTIES / VENDOR, hereto being of all age and with full
capacity to contract, hereby by these presents, agreed as they agree to divide and
adjudicate the above described parcel of land in equal shares thereof;

That partition of the above-mentioned parcel of land is a simple partition among the
PARTIES / VENDOR and not a partition for the subdivision plan;

WITNESSETH FURTHER

That the PARTIES sold the portion of the above-mentioned parcel of land
containing an area of TWO HUNDRED (200) SQUARE METERS, more or less, under
subdivision plan no. ____________ known as Lot No. _____________ in favor of
FERNANDO M. LONCION and FLORISA C. LONCION, husband and wife, both of legal
ages, Filipinos and residents of Patag, Opol, Misamis Oriental;

That for and in consideration of the sum of FORTY THOUSAND (₱40,000.00)


PESOS, Philippine Currency, receipt of which is hereby acknowledge the above-mentioned
CO-OWNERS / VENDOR do hereby SELL, TRANSFER, CONVEY, absolutely and
unconditionally unto the said VENDEE, their heirs, assigns and successors-in-interest, the
portion of the above-mentioned parcel of land containing an area of TWO HUNDRED
(200) SQUARE METERS, more or less, known as Lot No. ___________, free from any liens
and encumbrances;

That the provisions of ARTICLE 1621 & 1623 of the New Civil Code of the
Philippines were complied with the VENDOR and/or VENDEE;

IN WITNESS WHEREOF, we the PARTIES have hereunto affixed our signatures
