RESOLUTION NO. 10758

WHEREAS, the Commission on Elections (Commission for brevity),


in the enforcement and administration of all laws and regulations relative
to the conduct of election, plebiscite, initiative, referendum and recall, is
mandated to prepare and post the certified lists of voters ninety (90) days
before a regular election and sixty (60) days before a special election
pursuant to Section 30 of Republic Act (RA) No. 8189 “The Voter’s
Registration Act of 1996”;

WHEREAS, every election, plebiscite, initiative, referendum and


recall, the Commission promulgates the necessary Calendar of Activities
and Period of Certain Prohibited Acts which prescribes, among others, the

period for the conduct of verification and certification of the Election Day
Computerized Voters Lists (EDCVLs) and Posted Computerized Voters
Lists (PCVLs) and posting of the PCVLs as mandated in Section 30 of RA
8189;

WHEREAS, in the conduct of the system of continuing registration


of voters under Resolution No. 10549 promulgated on July 18, 2019 and
in relation to Resolution No. 10695 promulgated on February 10, 2021
entitled “In the Matter of Prescribing the Calendar of Activities and Periods
of Certain Prohibited Acts in connection with the May 9, 2022 National and
Local Elections”, the last day for the Election Registration Boards (ERBs)
to meet to certify the lists of voters is scheduled on February 3, 2022 and
the last day to post the said lists of voters is scheduled on February 8,
2022.

WHEREAS, due to the delay in the delivery of the continuous forms,


A4 papers, and toners needed by the field offices in the printing of PCVL
and EDCVL printing by the Information Technology Department (ITD), the
schedule of the approved activities in the immediately preceding clause
will be adversely affected;

WHEREAS, the Commission has clear authority to designate other


dates for certain pre-election activities, as provided under Section 29 of
Republic Act (R.A.) No. 66461 and Section 28, R.A. No. 84362 as amended
by R.A. No. 9369, which state that:

“Designation of other dates for certain pre-election acts, -


If it should no longer be reasonably possible to observe the
periods and dates prescribed by law for certain pre-election
acts, the Commission shall fix other periods and dates in
order to ensure accomplishment of the activities so voters
shall not be deprived of their right of suffrage.”

WHEREAS, the Commission will dispense with the sealing of the


Book of Voters considering the issuance by the Supreme Court, sitting as
the Presidential Electoral Tribunal, of the Precautionary Protection Order
covering the remaining election paraphernalia subject of the election
protest entitled Marcos, Jr. vs. Robredo, docketed as P.E.T. Case No. 005
and the Book of Voters which are in the custody of the P.E.T and other
regular courts with pending election protest;

NOW THEREFORE, the Commission on Elections, by virtue of the


powers vested in it by the Constitution, Republic Act No. 8189, the

Omnibus Election Code, and other registration and election laws, has
RESOLVED, as it hereby RESOLVES to adjust the timelines for the
verification, certification, and posting of List of Voters for the May 9, 2022
National and Local Elections, and to institutionalize the conduct of
verification and certification of the EDCVLs and PCVLs for Barangay and
SK Elections, National and Local Elections, and other electoral exercises.

A. Adjusted Schedule of Verification, Certification, and Posting:

1. The ERBs shall convene and conduct verification and


certification of the EDCVLs and PCVLs with the participation
of the Electoral Boards (EBs), Parish Pastoral Council for
Responsible Voting (PPCRV), or such other organizations
accredited by the Commission for the purpose.

The meeting/s of the ERBs shall be held in accordance with


the following table:

2. The adjusted schedule for the conduct of verification of the


names of voters and certification of the PCVL shall be not later
than March 24, 2022; and,

3. Posting of the verified and certified PCVL shall be made not


later than March 29, 2022.

In the event that the EDCVLs have not yet been received by the
Offices of the Election Officer (OEOs) in time for the ERB meeting, the ERB
shall suspend the meeting after the verification and certification of the
PCVL, and resume the same upon the availability of the EDCVL subject to
the issuance and posting of the required notice to the Members of the ERB,
Electoral Boards (EBs), PPCRV and such other organizations accredited by
the Commission for this purpose.

Resolution No. 10695 is hereby amended accordingly with respect to


the abovementioned activities.

B. Tasking in the conduct of verification and certification:

1. The ITD shall:

a. Prepare and generate the soft copy (pdf format) of the
nationwide PCVLs by precinct stored in compact disk;

b. Provide, FREE OF CHARGE, soft copy of the PCVLs to the


PPCRV only; and,

c. Prepare, generate, and print nationwide EDCVL in case of


National and Local Elections and BARMM Parliamentary
Elections.

2. PPCRV shall:

a. Reproduce and cascade the PCVL to their respective


chapters or affiliates existing in the cities/municipalities
and districts; and

b. Use exclusively the PCVLs generated by ITD for comparison


with the PCVLs to be generated in the Offices of the Election
Officers databases during the conduct of verification and
certification.

3. The OEOs shall:

a. Generate and print the PCVLs in case of National and Local


Elections and BARMM Parliamentary Elections, and both
EDCVLs and PCVLs in case of Barangay and SK Elections.

Please take note that, except printing, EDCVL and PCVL


reports can be generated only ONCE in the Voter’s
Registration System (VRS);

b. Set the date and time for the ERB meeting and shall send
Notices of the same to the other Members of the ERB, EBs,
PPCRV or such other organizations accredited by the
Commission for this purpose.

In the absence of local chapter of the PPCRV or


organizations accredited by the Commission, notice/s shall
be served to the representatives of civic organization and
non-governmental organizations; and

c. Post in the bulletin boards of the city/municipal hall and


in the OEO the notice of ERB meeting and printed copy of
the PCVLs.

C. Procedures in the verification and certification of EDCVLs


and PCVLs; and posting of PCVLs:

1. Verification of EDCVLs and PCVLs:

a. The names of voters listed in the EDCVL and PCVL shall be
verified, using as reference, the VRS database and soft copy
of PCVL in the custody of local representative/s of the
PPCRV;

b. In the event that discrepancy/ies is/are noted, the matter


shall be reflected in the ERB Minutes and a written report
shall be submitted to the Office of the Deputy Executive
Director for Operations (ODEDO), through the Election and
Barangay Affairs Department (EBAD). Pursuant to
Resolution No. 10737 (“IN THE MATTER OF THE
ADOPTION OF RESOLUTION NO. 10516 IN CONNECTION
WITH THE MAY 9, 2022 NATIONAL AND LOCAL
ELECTIONS”), Commission approved manual exclusions
and inclusions of names of voters in the EDCVLs and
PCVLs shall be effected.

c. EBAD and ODEDO shall prepare the corresponding


recommendation/s to the Commission En Banc;

d. Data Privacy Policies shall, at all times, be observed to


protect the sensitive personal information of voters
contained in the EDCVLs. As such, taking of photographs,
video recordings, and other methods/means of similar
import, which takes images or recordings of any part of the
EDCVLs, are strictly prohibited.

e. The suspension and resumption of the meeting for the


purpose of EDCVL verification and certification shall be
recorded in the Minutes.

f. Representatives of civic organizations, non-governmental


organizations, political parties, and other stakeholders may
be allowed to observe and witness the proceedings.
However, during the conduct of verification and
certification, the strict observance of basic health and safety
protocols is a must. Therefore, the EO may limit presence
within the venue to necessary parties to ensure that the
minimum one (1) meter physical distancing will be
practiced. Other interested parties may be allowed viewing
from outside the venue.

For this purpose, the Commission authorizes the Provincial


Election Supervisors (PESs), subject to the confirmation of
the Regional Election Directors (REDs), to approve requests
by EOs to transfer to a bigger venue for the ERB meeting to
accommodate a significant number of participants and
observers and to ensure strict compliance with basic health
and safety protocols.

For the National Capital Region, Davao City, and
Zamboanga City, the REDs exercising direct supervision
shall approve the request. All requests for transfer shall be
at no cost to the Commission.

2. Certification of the EDCVL and PCVL:

a. After the conduct of verification, the following shall affix


their initials at the bottom of every page and signatures in
the last page per established precinct:

For EDCVL:

1. Members of the ERB;


2. Members of the EB; and
3. PPCRV Representative.

For PCVL:

1. Members of the ERB; and


2. PPCRV Representative

b. In the absence of the representative/s of the accredited


Citizens’ Arm, any representative/s from civic organization
and non-governmental organizations shall sign as an
observer in the EDCVLs and PCVLs.

3. Posting of copy of PCVLs:

a. The ERB Chairperson shall cause the posting of the


certified PCVLs in the bulletin boards of the
city/municipal/district halls and OEOs not later than the
date specified in the amended Calendar of Activities for the
conduct of elections and other political exercises.

D. Applicability of other resolutions issued by the Commission

Resolutions Nos. 10549, 10695, 10737, 9655 and all Resolutions


issued by the Commission which are not inconsistent herewith, shall
likewise apply.

E. Publication and Dissemination

The Education and Information Department, this Commission, shall


cause the publication of this Resolution in two (2) daily newspapers of
general circulation in the Philippines. Likewise, the ITD is directed to post
the same in the COMELEC website.

Let the Office of the Executive Director, Finance Services
Department, Information Technology Department, Election and Barangay
Affairs Department, Education and Information Department, the
concerned Election Working Committees, Regional Election Directors,
Provincial Election Supervisors and Election Officers, implement this
Resolution.
