“AN ORDINANCE PENALIZING A PERSON OR GROUP OF PEOPLE WHO IS
INVOLVED IN RUMORMONGERING OR GOSSIPPING (TSISMIS) IN THE COMMU-
NITY, CREATING A TECHNICAL GROUP IN CHARGE OF INVESTIGATION AND IM-
POSING CORRESPONDING PENALTIES AND PUNISHMENT THEREOF”
WHEREAS, rumor mongering or gossiping is a Filipino habit that has been a detrimental force in the
development of our society. Rumor mongering or gossiping can start a fight between members of the
community that results in the humiliation or demoralization of one’s personality;
WHEREAS, rumor mongering or gossiping has been one of the major causes of misunderstanding
and fights in our families, and even in small communities such as the barangay. Gossiping not only
affects the person targeted, but also the people surrounding them;
WHEREAS, Article 26, Chapter 2: Human Relations of the Civil Code of the Philippines states that:
“Every person shall respect the dignity, personality, privacy and peace of mind of his neighbors and
other persons.” Said article also describes several acts and similar to it deemed as intrusive and offen-
sive and states that “though they may not constitute a criminal offense, said actions may produce a
cause of action for damages, prevention and other relief.” Said article further states” A civil action
may be instituted even if no crime is involved and moral damages may be obtained.”
WHEREAS, to be able to stop this practice of spreading of news about other people, regardless of ac -
count, this Barangay Ordinance has the legal basis to impose fines and punishment to any person or
group of people who committed and is directly involved in said act;
NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE
BARANGAY COUNCIL OF ANONAT, PARACELIS, BY VIRTUE OF THE POWERS
VESTED IN IT BY LAW, IN SESSION ASSEMBLED, THAT;
SECTION 1: TITLE. – This Ordinance shall be known as the “AN ORDINANCE PENALIZING
A PERSON OR GROUP OF PEOPLE WHO IS INVOLVED IN RUMORMONGERING OR GOS-
SIPPING (TSISMIS) IN THE COMMUNITY, CREATING A TECHNICAL GROUP IN
CHARGE OF INVESTIGATION AND IMPOSING CORRESPONDING PENALTIES AND
PUNISHMENT
THEREOF”.
SECTION 2: COMPOSITION. – The Technical Working Group shall be composed of the

MEMBERS - Chairperson, Committee on Family, Women and Children

SECTION 3: FUNCTIONS.
A) The Technical Working Group is to investigate and identify the root cause of the
problem of the offender as part of its function;
B) After investigation and validation, the Technical Working Group will make rec-
ommendations to the Punong Barangay on the degree of the offense and the rec-
ommended punishment;
C) The Technical Working Group will supervise the offender in the given punish-
ment by way of Community Service in designated areas;
SECTION 4: FINES/PENALTIES AND PUNISHMENT.
A) 1st Offense – A fine of Php 500.00 cash and 3days of Community Service
B) 2nd Offense - A fine of Php 750.00 cash and 5days of Community Service
C) 3rd Offense – A fine of Php 1,000.00 cash and 7days of Community Service
For offenders exceeding the 3rd Offense, the Technical Working Group will make the recommenda-
tions to the Punong Barangay with greater consequences or shall be brought to the Police Station for
proper disposition of their case. The penalty collected by virtue of this ordinance shall form part of the
general fund of this barangay.
SECTION 6: SEPARABILITY CLAUSE. – Let a copy of this Ordinance be furnished to the
Office of the Barangay Kagawad – Committee Chairman of Peace and Order, BPSO Executive
Officer and BPSO deputy and conspicuous in the barangay and other concerned offices for the
information, guidance and reference.
SECTION 7: REPEALING CLAUSE. – Any ordinance or provisions thereof which are found in-
consistent with the Provisions of this ordinance are hereby repealed accordingly.

SECTION 8: EFFECTIVITY. – This Ordinance shall take effect upon its approval.
