Amendments The Revised Anti-Corruption Special Procedure and Rules of Evidence Proclamation No. 434/2005 is hereby further amended as follows 1/ Sub-article (1) of Article 2 of the Proclamation is deleted and is replaced by the following new sub-article (1) “1/ corruption offenses” means corruption offences provided for by the Corruption Crimes Proclamation No.881/2015”: 21 The existing sub-article (5) of Article 2 of the Proclamation is renumbered as sub-article (9) and the following new sub-articles (5), (6), (7) and (8) are added: 5/*Proclamation’ means the Revised Anti- Coruption Special Procedure and Rules ‘of Evidence Proclamation No. 434/205; 6/ ‘commissioner’ means the commissioner of the Ethics and Anti-corruption Commission; 71 ‘informant’ means any person who provides information, when he believes that corruption offences are committed, to appropriate organ or other justice organs, to the heads of public office, public enterprise or public organization or to anyone who has the duty to investigate times of corruption based on laws or directives and includes an auditor who audits matters relating to offences of corruption or an auditor who detects the commission of the offence of corruption in connection with the course of hisi. smarts W nen nwo % oh. BAAS ECE Mk NeZho PE AL FM, PUTO OME LAMA? 9-Condition for Restraining other Properties 1/ Notwithstanding that there is no evidence that the property is acquired as a result of the corruption offence, where an investigator ‘or prosecutor made an application for @ restraining order supported by an affidavit indicating that the suspect is enriched or others suffered damage as a result of the corruption offence being investigated or charged, the court may give a restraining order prohibiting the sale, assignment or transfer of any money or property deposited in any bank in the name of the suspect, his spouse or children under the age of 18 or any other property of such persons proportionate to the amount of enrichment by the suspect or damage suffered by others. 21 The restraining order given according to sub- article (1) of this Article shall not affect the suspect's right of using such property 3/ Notwithstanding the provisions of sub-article (2) of this Article, the suspect shall not have the right to use cash or property deposited in a bank.
